I’ve had great agents and terrible ones. It’s so hard to find one that is honest, reliable, and looking out for you. An agent refused to show us any house in our price range because she decided we could afford to spend more. Not her call. I’ve had two great agents that I would totally trust to give me the straight scoop but more I wouldn’t trust under any circumstances.

Pretty cynical view of our Realtor community. Maybe in New York it is more dog eat dog, but in the Midwest and other parts of the country, great Real Estate agents are out there working their tails off to service the client and be fiduciary to the people they represent. How will the public ever trust our value with reports like this?

I agree. For example, in South Florida the waters are tough to navigate. However, I've found that by being honest and up front about things with my clients, specially Sellers, the transaction/relationships have a much higher chance of being successful.

You can be sued on that whole termite thing (here in florida). If an agent knew or *should have* known about anything about material defects he/she is made liable. Now on the murder/death part, at least for Florida, that is incorrect. You do NOT have to tell them about deaths because it does not considered a material defect by law.

Yep the murder (or any other psychological stigma) disclosure isn’t required in Pennsylvania either. That’s why buyer agents always advise their customers/clients to do research

I don't do open houses. There are much better ways to find a buyer than this. If somebody is qualified to buy a home, they are going to make an appointment and come see the property anyway. Safety is another issue (for my clients and myself.) I'm also not interested in using my client's home as a means for me to generate buyer leads, that would be unethical and not in the best interest of my client. Bad clients? Not willing to stage? Please. Bad clients are those who lie to you about delinquent taxes, HOA dues and shoddy repairs. It all comes out in the wash, so you shouldn't bother lying. Likewise, home owners that refuse to stage the home, clean the home, make repairs, or price appropriately won't get listed by me.

It's quite the opposite actually. If you work for a firm and don't produce enough, you'll get canned. This makes Realtor's desperate to try anything to get a sale.

I would imagine this is reality TV and there is some stretch to the truth here... I have found that most agents who have been in the business for a great length of time have found success in treating clients with integrity. Best source of business is repeat business.

Karl Hans You have to take a real estate course which has 2 parts. One is general real estate knowledge and covers the specific laws of your state. Some states are reciprocal in that their laws are similar so you could apply for a license there if you carry one in your state. However, some states differ so much that you have to study and learn their specific state laws and take their test in order to receive your license. A real estate license is basically a license to practice law but in a very narrow and limited arena of real estate.

Here in Texas, if the agent doesn't disclose material facts the agent will be stripped of license & the injured party can sue.... dishonesty goes against the fiduciary duties of an agent n has sever consequences... sounds like NY needs to do better......

As a Realtor, some of the things mentioned in this video might be true but it makes agents sounds like bottom feeders! The agents I have worked with and organizations I have done business with have never been as dirty as this video makes it look! Honesty and integrity are the ONLY way to do business!

Phill and I are nothing like this video portrays. No wonder we have a really difficult time getting people to trust us. We genuinely care about the families we help. We really enjoy when we have help two people find a solution to their real estate needs. The seller who needs out of the property and the buyer who wants a new property. Matching a buyer with a seller is a win for everyone. And it is a great feeling to be an instrument to assist in the enjoyment for everyone. It is not at all like this video portrays. This is sensationalism for entertainment.

There is bad with the good. Unfortunately, nobody cares about the hard working honest Realtors. Bad sells ratings and gets attention. I didn't hear anything about those of us who have convinced Buyers to walk away from a bad purchase they were emotionally attached to. In Tucson home inspections are highly recommended, as well as termite & Roof inspections. If there is concern or suspicion, structural inspections, mold inspections, and more. Seller beware if you fail to disclose. I like to point out what to look for while viewing; discolored ceilings, water stains along a room next to a bathroom, exterior hole where bees can colonize, etc. Previewing homes that have claims that are suspicious so Buyers won't waste their time, video taping homes for out of state clients so they don't waste a plane ticket. There are lots of things Good Realtors do everyday that goes unnoticed. We have a saying here, "We don't need more Realtors, we just need good Realtors." Home Buyers and Sellers may tell one person if you're good. They will tell 100 if you're bad. Not worth the risk to be shady. New York can keep those Realtors shown in the report.

You or someone you know definitely had or have had bad experiences and that saddens me. I was going to respond to your post, but I am having a hard time breaking some of it down. 1.Who's taking money off the top? you referring to the commissions of the Realtor? 2. "Investment is laughable" are you referring to a home is a persons biggest investment? 3. What needs to be highly regulated? In regards to having a sales sticker per se - That is what a Seller's Property Disclosure Statement form is for. The seller is required to fill this out. The Realtor cannot assist in that, they can only tell the seller they must by law disclose. Taxes are always posted on the MLS at least in Arizona they are. All other items that are material to the buyer is available on the internet or at your local zoning dept. I guide the buyer in the right direction and assist in finding those items of concern. Sometimes it takes hours or days to get the information. Sometimes you make the offer and have a 10 day inspection period to find those items that are of material effect to you. If you find something that you do not wish to deal with you can walk away.

I am not understanding the "not illegal" part...sorry...as far as the "you can walk" it is soooo broad and way to long to even type out. Yes there can be penalties depending on the situation, but based on what I was referring to earlier in the 10 inspection period, if it is at no fault of the buyer and they see something that is of material effect, they can walk. There a number if provisions in the contract to protect the buyer. It would interesting to see what predicament you or whoever you know were involved in to get a better grasp as to what happened. Ever situation is unique in and of its self unfortunately to give you a better answer.

I wish I knew what you got involved with.......It's just a term...it means 'to cancel'. It's spelled out in the contracts. I have to sit down with my clients and give them the first steps of what they are about to embark on before and after a we have a contract agreement to purchase. They get to see the what ifs and steps they have to take in order to stay on track and within the contract to protect them. I didn't understand the 10% penalty part. Yes I am concerned and have to be concerned about my buyers and not the commission. If I weren't, I would have dumped half of the clients I work with for so many reasons. Some take up to 2 years to buy, but it doesn't bother me. Many agents think I am nuts, but that's what separates me from the rest. I am a very patient agent and counselor. Legal terminology can bite, I agree. Unfortunately in this post I won't be able to steer you. You had a bad incident and that's too bad. As my colleague said the other day there are good and bad Realtors out there. It's par for the course unfortunately but fact in every business. Those that are bad have major character flaws, but I can't fix that. I can only bring the best experience for those that work with me to help them and to bring a better light to the industry.

In NC it is not a material fact if someone has died or if there were bed bugs. Agent are more liable her but that doesn't mean there are no unethical agents. Know too many of them. I worked for many years, don't recall those being a fact to be disclosed as well.

All of the scenarios talked about here has happened to me...stubborn sellers; overpriced house; buyers having zillow as their guide, gives me more work since information on other real estate websites are misleading. If you are a great real estate agent, you will survive all these minor annoyances. Every business has them.

That's just the cold hard truth ...doesn't matter where your from. I'm surprised at some of these comments. I'm a Realtor. Yes, an unscrupulous, dishonest agent might try to do something unethical, but there are laws in place to protect the homeowner and buyers. If you are dishonest or unethical you can lose your license or even go to jail! Realtors (not every agent is a Realtor) voluntarily submit to a higher code of ethics by joining a local Real Estate Board, where they can be fined or lose their status of good standing if they act in a manner that is not in the best interest of their client. The contract between you and your client states clearly that you are bound by law to represent their best interest, not yours, not the buyers and not any other person. In addition EVERY OFFER is required to be submitted to the Seller. I don't know where all these people practice real estate. Maybe they're all in NY. Wherever it is, I'm glad I don't live or sell real estate there! This is flat out false.

This gives agents like me a bad wrap. The first male agent is on the show Million Dollar Listings and has to be a shark to succeed in New York. However, I like to believe that agents are taught fiduciary duty and stand by that code.

Not trying to make a killing, trying to survive. The average agent makes $40,000/yr. This is high stakes real estate, not everyday suburban sales in the rest of America. Keeping a listing up after it’s gone is unethical.

This is not true at all in Hawaii. We do have termite inspection, it is mandatory unless buyer refuses it. This site makes real estate firm look bad.

also another thing that pisses me off is the ads i see for "rent to own" i am someone into only renting homes at this point in my life because i like to move and there is always some stupid real estate agent trying to get me to buy through "RENT" to own programs when that is not an option for me!

***** I have spoken to a handful of Realtors and Brokers and was not very impressed. They are just trying to sell like any sales person. Only a very few dedicate themselves to being a Realtor. I was shocked of how many crooked Brokers and Realtors I meet this year. The people who have been in real estate warned me about this and they where not kidding. Most Realtors and Brokers are almost the same.

do not buy a fixer upper property. chances are they're spending minimal money to cover up (rather than to fix) the underlying problem. the home inspector will not be able to see through the cover up. you're definitely not going to know what the underlying problem is until it's too late. // and never buy an auction property as they never let you see the inside. repairs can double the cost of purchase.

This was a very interesting episode, but does not portray all what a GOOD Realtors can do for you. We do negotiate for the Buyers and Sellers. Fiduciary duties are a must. In regards to the 'Open House' is really for the agent....That was entirely misleading in this article. Agents hold an open house for the benefit of the Seller first...the Seller's come first . At least for this realtor it does. It's another way to promote the Seller's home! Yes, an open house can bring forth a possible client for the Realtor, but the promotion of the home is first. In regards to home inspections...Caveat Emptor "buyer beware" should be curbed by the use of a GOOD realtor. Home Inspections are a must! Everything that encompassing the heart of a home should be inspected by a qualified person. We GOOD Realtors are constantly surfing the net for our clients to bring things that are of material effect to the fore front. In Tucson we work differently it looks like. I have no idea what this 'Shark' mentality is here in this episode. I treat all fairly, regardless of what side you are on. It should be note that I have had the opportunity to speak with New York-Manhattan Realtors that have since retired here in sunny Arizona and have decided to continue on the path of Realtor... Many comments have been made that reflects the Realtors here in a good light if I am being told "You folks do a lot here." "Why yes we do." Tucson Realtor, Tucson Proud!

Real estate agents do not make money by selling any one house--your house--for top dollar. They make money by selling more houses. That means less time on each house. If a lie of commission or omission will help the agent sell a house, they will do it. Buyer's agents aren't much better. I've experienced this over an over in my 70 years. BE present for the home inspection. Hire an inspector that real esate agents do not recommend.

I’ve had great agents and terrible ones. It’s so hard to find one that is honest, reliable, and looking out for you. An agent refused to show us any house in our price range because she decided we could afford to spend more. Not her call. I’ve had two great agents that I would totally trust to give me the straight scoop but more I wouldn’t trust under any circumstances.

I've been in the business of real estate 28 yrs and a broker/Realtor 16 years, there is a whole bunch of uncertainty here. I love what I do and I have never, ever lied to a client. Ethics is the name of the game. Now I've had clients lie to me.
Being a real estate agent is a lot of hard work. You need to be determined, competitive and persuasive to be able to close the deal.
Aren't there a lot of corrupt jerks in all professions. doctors, attorneys funeral directors.

Maybe in New York it is more dog eat dog, but in the Midwest and other parts of the country, great Real Estate agents are out there working their tails off to service the client and be fiduciary to the people they represent. Keeping closed listings in MLS is malpractice.
You can be sued on that whole termite thing (here in florida). If an agent knew or *should have* known about anything about material defects he/she is made liable. Now on the murder/death part, at least for Florida, that is incorrect. You do NOT have to tell them about deaths because it does not considered a material defect by law.

Yep the murder (or any other psychological stigma) disclosure isn’t required in Pennsylvania either. That’s why buyer agents always advise their customers/clients to do research
Wow. That kind of stuff might fly in New York but things like misleading information or failure to disclose information about something that is not in a clients best interest will get you ran out of town and get your license taken away down here.

I don't do open houses. There are much better ways to find a buyer than this. If somebody is qualified to buy a home, they are going to make an appointment and come see the property anyway. Safety is another issue (for my clients and myself.) I'm also not interested in using my client's home as a means for me to generate buyer leads, that would be unethical and not in the best interest of my client. Bad clients? Not willing to stage? Please. Bad clients are those who lie to you about delinquent taxes, HOA dues and shoddy repairs. It all comes out in the wash, so you shouldn't bother lying. Likewise, home owners that refuse to stage the home, clean the home, make repairs, or price appropriately won't get listed by me.

Agents gloss over crap all the time ,I have fired few agents . I have a agent that I like ,I only use her after I have done my home work and she cuts me a deal .
I would imagine this is reality TV and there is some stretch to the truth here... I have found that most agents who have been in the business for a great length of time have found success in treating clients with integrity. Best source of business is repeat business.

Karl Hans You have to take a real estate course which has 2 parts. One is general real estate knowledge and covers the specific laws of your state. Some states are reciprocal in that their laws are similar so you could apply for a license there if you carry one in your state. However, some states differ so much that you have to study and learn their specific state laws and take their test in order to receive your license. A real estate license is basically a license to practice law but in a very narrow and limited arena of real estate.

Here in Texas, if the agent doesn't disclose material facts the agent will be stripped of license & the injured party can sue.... dishonesty goes against the fiduciary duties of an agent n has sever consequences... sounds like NY needs to do better......

This is the difference between agents and Realtors. Realtors are held accountable to a code of ethics. I hate hearing these stories of deceptive agents.
As a Realtor, some of the things mentioned in this video might be true but it makes agents sounds like bottom feeders! The agents I have worked with and organizations I have done business with have never been as dirty as this video makes it look! Honesty and integrity are the ONLY way to do business!
I love Barbara. She is so right, we as real estate agents definitely have to be creative. I've definitely seen cut throat tactics. Thats the reason I love to share success tips with other agents and investors on my youtube channel. We can encourage and inspire each other to make it another day in this business.

Agents like that would never fly in California! Yes, of course we have unethical over anxious agents here but they stand out like a sore thumb. To be successful, practice ethically to your clients, then the money rolls in on it's own with less effort!

Great video, I agree with most of the points all these top agents mention. I like to be up front with my clients and set the expectation from the beginning.
There is bad with the good. Unfortunately, nobody cares about the hard working honest Realtors. Bad sells ratings and gets attention. I didn't hear anything about those of us who have convinced Buyers to walk away from a bad purchase they were emotionally attached to. In Tucson home inspections are highly recommended, as well as termite & Roof inspections. If there is concern or suspicion, structural inspections, mold inspections, and more. Seller beware if you fail to disclose. I like to point out what to look for while viewing; discolored ceilings, water stains along a room next to a bathroom, exterior hole where bees can colonize, etc. Previewing homes that have claims that are suspicious so Buyers won't waste their time, video taping homes for out of state clients so they don't waste a plane ticket. There are lots of things Good Realtors do everyday that goes unnoticed. We have a saying here, "We don't need more Realtors, we just need good Realtors." Home Buyers and Sellers may tell one person if you're good. They will tell 100 if you're bad. Not worth the risk to be shady. New York can keep those Realtors shown in the report.

You or someone you know definitely had or have had bad experiences and that saddens me. I was going to respond to your post, but I am having a hard time breaking some of it down. 1.Who's taking money off the top? you referring to the commissions of the Realtor? 2. "Investment is laughable" are you referring to a home is a persons biggest investment? 3. What needs to be highly regulated? In regards to having a sales sticker per se - That is what a Seller's Property Disclosure Statement form is for. The seller is required to fill this out. The Realtor cannot assist in that, they can only tell the seller they must by law disclose. Taxes are always posted on the MLS at least in Arizona they are. All other items that are material to the buyer is available on the internet or at your local zoning dept. I guide the buyer in the right direction and assist in finding those items of concern. Sometimes it takes hours or days to get the information. Sometimes you make the offer and have a 10 day inspection period to find those items that are of material effect to you. If you find something that you do not wish to deal with you can walk away.

I am not understanding the "not illegal" part...sorry...as far as the "you can walk" it is soooo broad and way to long to even type out. Yes there can be penalties depending on the situation, but based on what I was referring to earlier in the 10 inspection period, if it is at no fault of the buyer and they see something that is of material effect, they can walk. There a number if provisions in the contract to protect the buyer. It would interesting to see what predicament you or whoever you know were involved in to get a better grasp as to what happened. Ever situation is unique in and of its self unfortunately to give you a better answer.

I wish I knew what you got involved with.......It's just a term...it means 'to cancel'. It's spelled out in the contracts. I have to sit down with my clients and give them the first steps of what they are about to embark on before and after a we have a contract agreement to purchase. They get to see the what ifs and steps they have to take in order to stay on track and within the contract to protect them. I didn't understand the 10% penalty part. Yes I am concerned and have to be concerned about my buyers and not the commission. If I weren't, I would have dumped half of the clients I work with for so many reasons. Some take up to 2 years to buy, but it doesn't bother me. Many agents think I am nuts, but that's what separates me from the rest. I am a very patient agent and counselor. Legal terminology can bite, I agree. Unfortunately in this post I won't be able to steer you. You had a bad incident and that's too bad. As my colleague said the other day there are good and bad Realtors out there. It's par for the course unfortunately but fact in every business. Those that are bad have major character flaws, but I can't fix that. I can only bring the best experience for those that work with me to help them and to bring a better light to the industry.

In NC it is not a material fact if someone has died or if there were bed bugs. Agent are more liable her but that doesn't mean there are no unethical agents. Know too many of them. I worked for many years, don't recall those being a fact to be disclosed as well.

A Realtor told me that it is against the law for a Realtor to tell a client that someone was killed in a house.
It is not easy to be a Real Estate Agent for more than15 years. You need a lot of professionalism, persistence and many more... There are excellent customers and other ones that aren't easy to deal with, but, no matter what difficult it can be, I love to be a Realtor!

I'm an Agent from Missouri and unfortunately their are alot of "Agents " that could care less about their clients . Sadly, the only concern of theirs is the $$$. That's just the cold hard truth ...doesn't matter where your from. I'm surprised at some of these comments. I'm a Realtor. Yes, an unscrupulous, dishonest agent might try to do something unethical, but there are laws in place to protect the homeowner and buyers. If you are dishonest or unethical you can lose your license or even go to jail! Realtors (not every agent is a Realtor) voluntarily submit to a higher code of ethics by joining a local Real Estate Board, where they can be fined or lose their status of good standing if they act in a manner that is not in the best interest of their client. The contract between you and your client states clearly that you are bound by law to represent their best interest, not yours, not the buyers and not any other person. In addition EVERY OFFER is required to be submitted to the Seller. I don't know where all these people practice real estate. Maybe they're all in NY. Wherever it is, I'm glad I don't live or sell real estate there! This is flat out false.

This is not a realistic picture of agents. I was hoping for something real. It can actually be a lot worse and a lot better. This is a misleading compilation of snap shots taken out of context.
Integrity, the most important thing when you choose a realtor to represent you.

This gives agents like me a bad wrap. The first male agent is on the show Million Dollar Listings and has to be a shark to succeed in New York. However, I like to believe that agents are taught fiduciary duty and stand by that code.

Not trying to make a killing, trying to survive. The average agent makes $40,000/yr. This is high stakes real estate, not everyday suburban sales in the rest of America. Keeping a listing up after it’s gone is unethical.

You do NOT have to tell the client if someone dies in the house only if they ask. As for the termites and mold you MUST tell them.
This is not true at all in Hawaii. We do have termite inspection, it is mandatory unless buyer refuses it. This site makes real estate firm look bad.
I was interested in a home i seen on a realty site. When i went to the location it was partially burned. Is a partially burned home worth repairing? How much discount should i seek? Can i dodge the real estate agent? She mentioned the owner dealing with insurance company.... i appreciate it...

also another thing that pisses me off is the ads i see for "rent to own" i am someone into only renting homes at this point in my life because i like to move and there is always some stupid real estate agent trying to get me to buy through "RENT" to own programs when that is not an option for me!

Good stuff about realtors. Unfortunately most realtors don't even know how to run comparables on the MLS. I can't wait to be a Broker and a very good one.

***** I have spoken to a handful of Realtors and Brokers and was not very impressed. They are just trying to sell like any sales person. Only a very few dedicate themselves to being a Realtor. I was shocked of how many crooked Brokers and Realtors I meet this year. The people who have been in real estate warned me about this and they where not kidding. Most Realtors and Brokers are almost the same.
Real estate's a tough game.

do not buy a fixer upper property. chances are they're spending minimal money to cover up (rather than to fix) the underlying problem. the home inspector will not be able to see through the cover up. you're definitely not going to know what the underlying problem is until it's too late. // and never buy an auction property as they never let you see the inside. repairs can double the cost of purchase.

This was a very interesting episode, but does not portray all what a GOOD Realtors can do for you. We do negotiate for the Buyers and Sellers. Fiduciary duties are a must. In regards to the 'Open House' is really for the agent....That was entirely misleading in this article. Agents hold an open house for the benefit of the Seller first...the Seller's come first . At least for this realtor it does. It's another way to promote the Seller's home! Yes, an open house can bring forth a possible client for the Realtor, but the promotion of the home is first. In regards to home inspections...Caveat Emptor "buyer beware" should be curbed by the use of a GOOD realtor. Home Inspections are a must! Everything that encompassing the heart of a home should be inspected by a qualified person. We GOOD Realtors are constantly surfing the net for our clients to bring things that are of material effect to the fore front. In Tucson we work differently it looks like. I have no idea what this 'Shark' mentality is here in this episode. I treat all fairly, regardless of what side you are on. It should be note that I have had the opportunity to speak with New York-Manhattan Realtors that have since retired here in sunny Arizona and have decided to continue on the path of Realtor... Many comments have been made that reflects the Realtors here in a good light if I am being told "You folks do a lot here." "Why yes we do." Tucson Realtor, Tucson Proud!

Real estate agents do not make money by selling any one house--your house--for top dollar. They make money by selling more houses. That means less time on each house. If a lie of commission or omission will help the agent sell a house, they will do it. Buyer's agents aren't much better. I've experienced this over an over in my 70 years. BE present for the home inspection. Hire an inspector that real esate agents do not recommend.

I'm a firm believer that the good of anything will out weigh the bad especially in real estate. ..people are more educated now and simply check your answers to every question asked.
Ryan, NO, you don't have to tell them someone died there. Death in a property is NOT an adverse material fact. I love your stuff and I wish I were as good looking as you, but my small guess is that I'm selling real estate in Montana and I know a smidge more than you do about real real estate.
