INJUSTICE FOR ALL: Prosecutors blame SCHP's mishandled evidence for losing felony DUI conviction

INJUSTICE FOR ALL: A NC man was paralyzed in a drunk driving crash in Kershaw County, SC in 2013. Troopers charged his friend with felony DUI and the case file sat, collecting dust in a courthouse file room for the next decade.
Now, a man who once faced 15 years in prison got a deal from the South Carolina Fifth Judicial Circuit Solicitor's Office: if he'd plea to a first offense DUI - a misdemeanor - prosecutors would not seek a jail sentence.
The deal was finalized on April 21.
The solicitor's office blamed the South Carolina Highway Patrol Recruiting's evidence handling as the reason prosecutors dropped the felony DUI case to a misdemeanor. The paralyzed man believes prosecutors gave up on the case and let the driver walk away with "barely a slap on the wrist."

    Really sad dude ended up paralyzed, but personally not sure why dude is so sour about his ex friend not doing jail time. Personally I would have been much more upset if dude that ended up paralyzed had nothing to do with the driver. Heck, if dude would have put no his seatbelt like the driver did there is a good chance he would be walking today. Driver had NOTHING to do with dude not putting on his seatbelt.

    Not sure how jail time would help this unfortunate young man. The state screwed up. But the mistakes prevent a fair trial. Buy our standards, we let a guilty man go to protect the innocent. And this reporting is too much drama. The statements of the reporter are repetitive and at times silly.

    It sounded to me the prosecutor’s office misunderstood the statute in regards to Arrest vs incident. That was the most compelling evidence and the state let it get tossed? Not a good day for that office. Highway patrol lost evidence but they had him with the blood test.

    I hope that the victim sues Bobby Freeman, the police and the city! I pray that he gets millions, but it's NEVER ENOUGH for the traumatic life he lives.     He wasn't given a break by not being given a break because of mishandling evidence...he was actually taking a plea that because of that mishandling was inadmissible and he wouldn't have even been convicted of had he not plead...

    Who were the troopers related to? And/or how much cash did they and their families slip to Paulding? Is there anyone that works for the SC criminal justice system that CAN actually read and write? If so, they clearly were not on the scene the night of this wreck. This is one of the worst cases of malfeasance and incompetence in criminal justice history! The prosecutor is going to make damn sure the only estate left working for the people in South Carolina anymore is the Fourth Estate.

    Clearly the guy should have been charged, but I lost the vast majority of my sympathy once it was clear in the story that this was a buddy driving, and the so-called victim knew his buddy had been drinking. At the onset of the story I thought the guy was a victim of some drunk driver in another vehicle, and I was really sympathetic. But when you get into a vehicle with a drunk driver, I'm not that sympathetic.

    thing is they could sue the driver themselves, sadly facts are drunks got in car got into wreck its all civil between them. aka civil court, he got the guilty plea needed for a civil suit which thanks to mishandling is the best he could get and is more than enough to finalize a lawsuit just no promise how much blood you can squeeze from a turnip.

    Well it's not a simple DUI if you injure someone. Someone doesn't even need to be drinking to cause an accident either. My father lost a leg in car accident for instance and had to take the other driver to court though neither driver was drinking my father was still awarded some compensation though. Obviously the "evidence" was mishandled then if they are only focused on the influence of alcohol and not the damage done. That's how people get repeatedly victimized when the court sides against them.

    Freeman has a lousy lawyer! As stated in the report, the U.S. Supreme Court was on record with a decision that would have made the results of the blood draw inadmissible even without the broken chain of custody! Another argument for dismissal is the defendants right to a speedy trial, which after 10 years was violated. The victim is paying a terrible price for his mistake of getting in a vehicle with an intoxicated driver, but he is responsible for that decision.
