The status of individuals as residents or non-residents determines whether or not they can claim personal allowances (generally referred to as 'personal reliefs') and tax rebates, and enjoy the benefit of graduated tax rates. Resident status is determined by reference to the number of days an individual is present in Malaysia. Generally, an individual who is in Malaysia for a period or periods amounting to 182 days or more in a calendar year will be regarded as a tax resident.

    Hi bro, after year end , if you paid more than your tax pay , you will get remaining payment, for example, if you are salary very High also max tax limit is 22 perse remaining 8 pers you will get it

    as per Rule Book Malaysia Tax Residency Requirements: Physical Presence for 182 Days Rule - If an individual is physically present in Malaysia for at least 182 or more during the tax year, they are tax resident. Less Than 182 Days Rule - You are physically present in Malaysia for less than 182 days during the year but were physically present for at least 182 days in the second half of the immediately preceding calendar year or in the first half of the immediately following calendar year. However, periods of temporary absence are excluded from the period of consecutive physical presence if the absence was related to your service in Malaysia, personal illness, illness of a family member, or social visits not exceeding 14 days. 90 Day Physical Presence Rule - If you are present during the calendar year for at least 90 days and have been resident or present in Malaysia for 90 days in any three of the preceding four years, you are a tax resident. Tax Resident without Physical Presence - You have been resident in the preceding three calendar years and will be resident in the following calendar year. But this is the only situation where you can be considered a tax resident without being physically present in Malaysia.

    HI Selma, After 6 month (182 days), you will become tax residence, yes you can traval outside Malaysia. Please inform and discuss with your company HR Regarding this, they will officially confirm with you and will detect normal tax

    Hi brother, if you stay more than 2 weeks in home country within 6 month, they will ask you to continue again. Can you check with your HR, this they will consider Medical emergency or not

    Hi @Magesh waran, as my understand, No need PCR test for now but you have to install MySejahtera app and add your travel information and make sure bring your vaccination certificate while enter to Malaysia.

    Thank you very much for very detailed info. I got offer from one service based IT company from Malaysia. This video helps me lot to understand the Malaysian taxation. . If possible, Could you please help me with below query. If I joined in job on malaysia at September 2022, I will stay only 120 days in malaysia for this year(2022). So when next year starts, whether these 120 days will be considered (or) again I need to stay 182 days in 2023(Till June 2023) to get tax resident status.

    Hello Saravan, The Answer is Yes. you have to pay again 30 % for 182 days again. For example, I started working from the Current company in Jan 2022 and came back to hometown for one month in March, again they are asking me to pay 30% from April till Sep month. so my travel plan to India after Sep month on this year:)

    Hi SRM bro, Hearty congratulations bro, if your company say basic pay as 1xxx RM means that is your salary, here they won't detect any amount other than tax. Normally EPF eligibility will be after 5 years, some company will give on hand 22 % of your basic pay as a EPF . please speak to your HR for more details
