In This Town "For Sale' Signs are Criminal

Commercial speech is defined as any speech which promotes at least some type of commerce.

    We had that law in our small town for a while. To no one’s surprise it was heavily supported by our local dealership, who was trying to cut out any competition. Luckily people here got together and got it reversed

    What you described is a microcosm of how all political corruption works. A local car dealer want to corner that market in auto sales so he slips some cash to his cousin the mayor or councilman and a new law is born in his favor..

    There's a good argument that the for sale sign constitutes a potential distraction to drivers. Especially since the vehicle was parked on the street rather than in the yard (the latter encouraging interested parties to pull over to have a look rather than trying to do so with a drive by). It's different than with sport/campaign signs in that you can get all the relevant information from them with a glance. For sale signs are usually going to have a phone number on them and anyone interested is going to want to give the vehicle a quick look over after seeing the sign. We have an ordinance here that requires that the sign and vehicle be in your yard or driveway rather than parked on the road. If where he lives has something similar, he'll likely lose the case.

    ​@@common.sense88With a business, seeing the name is generally all the info you need from the sign. While billboards are much larger and can be seen from quite a distance so any additional information you may need from them can be gathered with multiple quick glances. Personally, I've seen someone wreck or nearly cause one due to their paying more attention to a vehicle with a for sale sign than to the road on numerous occassions. I don't recall seeing anyone cause a problem as a result of a business sign or billboard. That said, I think the main problem here will be his parking it on the road as opposed to his own property. The ordinance here requires that vehicles for sale be parked in your driveway or yard and be far enough back from the road as to be beyond the city/county's easement. There is likely a similar ordinance where he lives as well as most places have such. It's not exactly an unreasonable requirement.

    Reminds me of going through little town in Maine. There were many pink flamingos tied up high in the trees, when asking why I was told local town board was out of control! Most people in this town go to Florida for the winter and like the pink flamingos to remind them of Florida, so much so that most residents put them out as lawn ornaments. This apparently pissed off one of the board members so the town made an ordinance that banned putting pink flamingos on your front lawn. So the snow birds in the community banded together and had them tied up high in the trees on there property where ladders will not reach! Hilarious

    Well, I think they're ugly, too - but it's their property! I don't like the colors that some people paint their house, either, but, again it's their property! These kinds of things should be, to my mind, banned in the Constitution. Which, as a nice side effect, make every HOA in the country illegal...

    Not necessarilly. Two things are going to be a problem for this case. One, the vehicle was parked on the road rather than in his yard. We have an ordinance here that vehicles for sale must be parked on your property and far enough back from the road as to be beyond the city/county's easement. Second, such a sign may constitute a distraction to drivers. Unlike sport/campaign signs, for which all of the relative information they contain can be had with a quick glance, for sale signs usually have a phone number and upon seeing the sign, interested parties are likely going to want to take a quick look at the vehicle itself as they go by (thus further drawing their attention away from their driving.) He really should have checked his local ordinances before he did it. Edit: If he had parked it in his yard, that would have encouraged anyone interested to pull over and check it out rather than try to look at it while driving by.

    I agree. On the street or his property, if a driver traveling past finds the for sale sign entertaining, you pull over, you look at the car, into the car, you write down the phone number or call it. To suggest a driver by would see the sign and then lose control of their vehicle because they CAN'T pull over and write a number down is pretty stupid. I don't spaz out when I see signs left vy landscaping companies on lawns either.

    @rosesmith6208 Calm down. There are differences between business signs/billboards and for sale signs. For business signs the name is generally all you need and a quick glance is enough to get it. Billboards are large and visible from a good distance so multiple quick glances will get the information. Also, both have ordinances they have to follow. In fact, most places have ordinances governing for sale signs as well. That's where he'll most likely lose his case. He parked it on a public street rather than his own property. On top of the obvious problem of it not being on his property, that encourages interested parties to try and get the phone number and look it over etc. without stopping. Most places I'm aware of require that you park the vehicle for sale on your property and far enough back to be beyond the city/county's easement. That encourages people to pull over to check it out and avoids the issue of it being off your property. The dude goofed up and didn't bother to check local ordinances or use common sense and he got a ticket for his effort (or lack thereof). It's a silly case to take under the circumstances since ultimately, the 1st amendment will have nothing to do with it. He should have just paid the ticket and treated it as a lesson to check the laws and make sure he isn't violating any next time.

    @@possumverde I see several problems with this: firstly, it doesn’t matter if it’s his or public property. He is allowed to be on public property and presumably to park on public property. Just like you or anyone else. That’s why it’s called public. Secondly, banning ‘for sale’ signs is a breach of the first amendment and seems to be where the IJ is going with their case. That’s protected speech, as would be a sign that says ‘I eat ass’ or ‘Fuck the police’. All protected and there’s case study to back that up. Thirdly, you seem to believe that the crime of ‘distracted driving’, which is a violation in some states is the fault of the person or thing that made the driver distracted and not, um, the driver being distracted. In your example, cute girls wearing short dresses risk lawsuits and we already know that is not the case. If you drive while distracted and an accident occurs that’s the driver’s fault. A reasonable person would park and inspect the vehicle for a phone number, not crash their own vehicle. Fourth, what you are aware of and what people do are irrelevant.

    My small town has a similar law. You can't sell a vehicle in a town parking spot. Or "camp" meaning no sleeping in a camper or rv while parked.

    In the long video it started because a guy was constantly selling cars that he had parked in the street. So instead of just getting him for running a business without a license they passed this law instead.

    I was a regular customer at a grocery store. I went there most weekends to shop. I had been doing this for months. I did that task with a for sale sign on my car. I was asked not to return for a year and never again with that car.

    There’s a small hick town in Minnesota that had the same law. It’s about 35 miles +/- west of Minneapolis. I got caught by it when I stopped there for lunch. Because I was not a resident I got off with a warning from the hick town cop. I assured him I would never come back into the town with the sign on my car.

    As he should do, this is absolutely ridiculous. Town pass codes like this to generate income for the City and to prevent people who sell things or vehicles often. Some guys buy ones they they fix up some and turn them over by selling them like that. Make a few bucks to pay for all the inflation so they can pay bills. It all s tarts by one or a few people, and they feel their personal feelings can be turned into law because they hold some city position. Go get them!🎉

    How does IJ intend to get restitution without a criminal conviction against the local lawmakers and prosecutor for conspiracy to deprive rights under color of law, create unlawful debt, and unlawfully convert government offices and property into instruments of crime first, from a criminal court proceeding under rules of criminal procedure? That would grossly undermine due process for the parties and the state. If that Court where to proceed, the orders would be void, as no civil court May award restitution without a prior conviction of crime. If they allow a payment of anything in exchange for criminal prosecution, that is a common law crime called compounding a felony. 18 USC section 4 to issue those criminal complaints on behalf of your client. Your attorneys are officers of the court with the first Duty to uphold the duties of the Court which is to enforce the law add uphold the Constitution and you are not immune from 18 USC section 4. You have been placed on legal notice as of right now.

    “Commercial free speech rights”. … Never heard of such a thing can you explain? The first amendment applies to political speech. If you think there’s no problem with a for sale sign on a car in the street, then do you have any problem with people building a retail business on their front lawn?

    Is it your opinion that a car dealership has the right to park their cars on highly populated street to sell them? If you say no, then what is the stop any car dealer from establishing a sister dealership? That’s an LLC with all the cars in a persons individual name and parking them on the street for sale signs?

    Now... was he a criminal? Or was he civilly fined? Either way it is wrong, but saying repeatedly he was made a criminal when it almost certainly was a civil penalty is inaccurate.

    According to Lawshelf Educational Media: Civil law deals with the disputes between individuals, organizations, or between the two, in which compensation is awarded to the victim. Criminal law is the body of law that deals with crime and the legal punishment of criminal offenses. He violated criminal law based on this. Even if he had broken only civil law, just based on definitions, the term "criminal" still applies.

    @@BigRalphSmith That's too simplistic. It depends on the state, but most places impose what are called civil penalties as punishments. Parking tickets are a great example. You can't go to jail for a parking violation, it is neither a felony nor a misdemeanor. But there is a civil penalty. Civil violations are not considered criminal activity. So if it is only a civil penalty for dislaying a for sale sign, it is wrong to say it made him a criminal. That doesn't in any way mean that it isn't an unconstitutional violation of free speech. Denying a permit to hold a gathering can be an unconstitutional suppression of speech that involves neither criminal nor civil penalties.

    @@robertpesche I have no idea whether there are any "consequences" for your mistakes in this instance. I don't know anything about you except what you've said here. I do know that there are almost always unforeseen consequences to being mistaken on just about anything if we look at the statistics as mistakes in one subject tend to overlap with other subjects. But, in this case, who knows? Therefore, "good luck with that."
