The way Professor Wokocha put it very clearly, even a child would understand. The other commentator, Samuel Ogeh, got it terribly wrong, very terribly wrong.

Martins Amaewhule is the current speaker of the Rivers State House of Assembly as it stands, because of a judgment of the Abuja Federal High Court headed by the honorable Justice Omotosho. The judgment recognizes Amaewhule as the speaker, and it has not been set aside by a higher court.

Maintain status quo means what? At what point in time does this status quo takes place? You’re an Ottele which means Anus. Status quo will start from the court order that stopped them from parading themselves as lawmakers. It was this order that led Amaewhule to go to court to challenge the o. So, your lawmakers have defected to APC and sworn affidavits to support their claim of defections. So, you are an Ottele.

There is nothing to be ashamed of. The law is all about interpretation and every party is at liberty to interpret from his own side of the prism. For an instance, Rufai and Abati would always have a view that is anti-APC, and they are entitled to it. In fact, for me, Oseni Rufai is a nuisance and a disgrace to the fourth estate, yet he is celebrated by quite a number of Nigerians, including your humble self. That's the way issues as this are.

Why can't the court treat the issue of the defection once and for all in accordance with the Constitution. So which party are martins and his men now? What do you mean by assuming that there was defection, was there not defection which the speaker himself was among the defectors,?

The court has no power to declare the seat vacant according to the law. It is only the speaker but the speaker is among the defectors. So the remaining 3 members have declared their seat vacant. Governor should deal with the 3 remaining members pending on when INEC is ready to conduct bye election to replace them.

These Nigerian Lawyers should stop misleading the public because they are called Lawyers. Even a lay man like me knows that there is a clear difference between someone vacating a position and someone who is being suspended from a position. The yeye Lawyer foolishly drops the functional word 'vacate' to start using the word 'suspended'. In the context discussed are both functional words one and the same? Nigerian Lawyers na waooo.

The professor differs with mr ogeh, what the prof said is clear, the issue of defection is not a court affairs, once the legislators defected and their seats were declared vacant by the chairman it remained vacant. They can only approach the court if they feel their motives were based on consitutional facts. we were told they even sworn to an affidavit that they've defected. Mr Ogeh is not economical with the fact.

According to Court, parliament has no power to sack or suspend elected members of house. Only the court can do that.

You guys should take sentiments out of this matter. The said decamped members sworn to an affidavit that they've defected and celebrated on national tv chanting on your mandate we stand. They were misled by whoever is leading them. By law they ceased to be members of the River State house of assembly.

Am sorry you’re wrong, the law only says the Speaker of the house or the Court can pronounce their seats vacant. But the problem is that the current assumed speaker was not the Speaker known by law because only 2/3 of the actual House of Assembly can elect a new speaker. So it’s a real problem now because with this judgement the old Speaker is the Speaker of the Assembly simple.

Please let me give you an assignment, investigate how a Speaker of the House of Assembly is nominated. Then you will be able to answer the question yourself.

They have also decided to aid politicians in multiplying their confusion since they have made judiciary their tools and burdened them with useless litigations.
