    Legally this is only partially true. Courts have firmly established that it's acceptable for cops to lie about just about anything. But they have also firmly established that it's not acceptable for them to lie about the law. They can lie all day long about what they saw you do or tell you they have all kinds of evidence against you they don't actually have. But they cannot lie about what a law actually is or claim that you're required to do something or provide something as a matter of law in an attempt to trick you into complying with unlawful demands. In practice of course they lie about the law all the time and generally get away with it. Because most people don't know the laws in the first place and just go along with whatever a cop tells them they need to do. And even in the cases where people actually know the laws and know their rights are being violated very few have the means to pursue a lawsuit that would actually hold them accountable.

    42 USC sec 1983, 1985, 1986 18 USC sec 241, 242 Would love to see people fight the cops with these, especially title 42 as it says they have NO INSTITUTIONAL PROTECTIONS OR IMMUNITIES when violating the rights of another.

    The fact they are so easily willing to say "sue me" just shows the mentality that Qualified Immunity has given these tyrants.. "sue me... what do I care, I'll never accept wrong doing. You and the rest of tax payers will pick up the bill." Qualified Immunity should be abolished and every badge should carry liability insurance.

    And they don’t care a shred that it costs about $5,000 PER CHARGE for a decent lawyer to defend you, at minimum. So basically they can pin you with a false charge and just for the pleasure it’ll cost you $5k+ just to prove you didn’t do anything wrong. And if you’re lucky you won’t end up pinned with a charge that’ll permanently screw up your life. But they’ll do all they can to make sure you’re not lucky and SOMETHING sticks. That’s why they’ll charge you with every infraction they can possibly find.

    Qualified immunity doesn't even legally exist,it is a form of judicial corruption allowing corrupt officials to illegally get away with their crimes. The only legal lawful immunity that legally exists is for senators only.

    Believe it or not, just remaining silent without invoking the fifth amendment has been ruled by the courts to be deemed suspicious enough for detention. You must invoke the right to remain silent to be protected by the fifth. Screwed up, huh?

    It may not be illegal to remain silent, however, staying quiet is not an assertion of rights. The best way to not speak in a way that cannot be misinterpreted is to state I would like a lawyer present prior to any questions, period. Or… state “I invoke my right to remain silent” and then shut up; otherwise, it may be misconstrued and not applicable. The courts do not recognize straight silence as an assertion of rights, nor speaking after you invoke your rights. Just be quiet.

    @@blackredneck4378 it’s not until municipalities are on the verge of going broke or having to reduce services due to high payouts for rights violations that it may dawn on them that “hey some officers are costing too freaking much to be working for us”. Then maybe they will be inclined towards ending QUALIFIED IMMUNITY. Look at what has happened where it has ended. Bad Officers May quit and move to other jurisdictions and I say good riddance. They will soon get caught or have to change🙏🏾before they kill somebody(ALTON STERLING).🙏🏾

You may choose to selectively answer or not answer any questions before or after invoking your rights.     To give an update. I just finished the IA complaint process, and it ended like we thought it would. Nothing done. I pulled all records related to this and it turns out...me wanting to pull to a safe location and me wanting to keep the cop out of my truck convinced him I had drugs and that is what he was after. I just did not give him any RAS or PC to get in... and that pissed him off. The department never corrected him on the law, in which he had all the info on my DL. He even stated in his interview that he wanted a local address to satisfy his policy and what he wanted. Then I had the police chief call the base and try to get me in trouble this video and mess with my career. Thankfully, my leadership saw through what was going on.

The greater the ignorance of the law by those "subject" to the law, the greater the profits for the administrators of public policy and cops are used as the administration's collection agency.     That is Fairborn, Ohio, near Dayton and the home of Wright Patterson Air Force Base and the National Museum of The United States Air Force. They are WELL aware that military do not need to have DL with current addresses due to being moved around a lot! EVERY cop near a US military base is WELL aware of that fact!

    @@WeThePeopleUniversity Why don't the good LEO's expose the bad ones in your opinion? Seems like some shady business is happening in a lot of police departments. Almost as if the people running the show are all typically hiring little "henchmen" for themselves to do their evil bidding almost like their little cronies or something rather than upholding justice and the law in a professional manner. What's the problem? I mean how hard can it be to hire sensible, ethical, professional, hard-working, moral, kind, educated, and normal people to do the job correctly???... 🤔🤔 Do we seriously live in a reality in which this is simply not possible?     The officer is legally allowed to ask almost anything. He can ask for your sandwich and he can ask you to wash his car. He cannot legally order that you comply with those requests. The officer is asking to surrender your rights for his safety. Who will protect your safety?

    i dont live in the us. what is scary is EVERY us cop gets a gun. the good, the bad, the ugly search for an off duty cop who got into an argument with a citizen whose car broke down. lost his temper, didnt ID himself and shot multiple times killing the innocent man camera evidence indicted him though he tried to lie his way out what about houston tx, where 10-12 incl dumbass Groines shot semiauto weapons from outside killing 2 innocent citizens fast asleep after midnight

    Bonus fact: When in the military, your state license can be expire and still valid. Each state is a little different, but they all say your license is good for as long as you're in the military without having to renew said license.

    As you stated, having an expired driver's license depends on state laws. Some states only allow your licenses to be expired for up to 90 days while others may authorize up to six months. Are you actually saying that as long as I have an active duty CAC, I don't ever have to renew my driver's license? If so, that is incorrect. I lived in state A, my driver's license was from state B, and my car tags were from state C; and yes, if you are on active duty, this is legal in all states. Some states will allow having a driver's license without a photo; so if you have a DL from state A, then state A may allow you to mail in your DL and they will mail you your new DL without a photo on it.

    @@james3588 Unless the rules have changed recently, yes, you could go your whole career in the military without having to renew your license. You receive your "official" state of residence when you enlist. That never changes except when you reenlist and that's up to you to change. Thus no matter where you live after that, you can' have a license in one state, live in another state. You can't have a vehicle registered in a third state, unless you've established residence there.

    That is not correct, you cannot go your entire career without renewing your DLs. Each state has its own requirements on how and when to renew active duty members' DLs. And yes, you can have a tag in one state, a DL in another state, and a residence in another state, or at least prior to 2016 when I retired after 28 years.

    @@james3588 According to the laws in my state (IN) you can go your whole enlistment without ever having to renew your license. Most states are that way, but i will admit there may be a state or two with different rules. The variation is how long you have to get a new license once you end your military service. Then there's the idea if you drive anything military while you're in, you have to get a military driver's license, which notes what vehicles you're qualified to drive. Btw, while i didn't serve 28 years in the military, i did serve as a personnel admin specialist (75B) at company and battalion level. And the only way you can tag in one state, license in another and reside in a third would be on a temporary basis, dependent on state law, until you can get them all under one state. But that would be a pretty rare circumstance.

    A law enforcement officer not knowing the basics of basic law involved in his day-to-day routine such as traffic stops is equal to a Master Carpenter not knowing the dimensions of standard materials. You cannot possibly do your job efficiently or accurately without that knowledge.

    I was wondering why he was asking for an address if he already had they guy's license. I had a cop try to pull that with me once. The cop was asking if the address on my license was correct. I said I wasn't answering questions. The cop then threatened me with failure to ID if I didn't verify that the address on my license was correct. I said, "You're holding my license in your hand. It has an address on it. In order for this to be failure to ID at this point you would have to have probable cause to believe that address is incorrect, and I have every right to not answer any question you ask. Your move." The cop didn't press it anymore.

    He asked for his address because... I know that here in Oklahoma, you MUST keep your address current on your driver's license. You only have 10 days, by law, to change your address on your driver's license once you move from that address on your license. I'm not sure what the law is on that in Ohio, but it is the law here in Oklahoma. It is an offense you can be cited for if your address on your driver's license is not your current address. Never tell the cops it isn't, and if you have to, tell you just moved a few days ago. Just make sure you don't tell them it's been more than 10 days that you moved.

    He’s in the military and this investigation is about an address that’s clearly on his license, so what more do they want, do they want him to give addresses to every military post he’s been on or foreign country he has visited?     "Its a reasonable request" They dont use these words accidently. They know they can later say that they never forced him to give this information. They requested it and he volunteered. Make them order you, command you, compell you. A request is just that, a request. Its not a lawful order. You cant sue for making requests

    Unfortunately that only applies to us. For some reason the courts have said ignorance of the law is okay for law enforcement. That is the doctrine of qualified immunity. It's why people want it abolished.

    The issue with rolling the window down all the way is that now cops, who know they're being filmed, use the fully lowered window as an excuse to claim that they smell something and now have probable cause to search without your permission.

I'm not kidding, I know bc my lawyer told me after he read it. These cops now a days are not fucking around and not in a good way either.     I love his videos and break downs are spot on. He does a great job explaining what’s happening and what went wrong! My only complaint would be he should take the time to bleep out peoples personal identifiers and personal addresses when they are verbally dictated to the officers in these videos as a way of protecting the subjects of his video lessons private information. Thus far this has been my only criticism. Otherwise he does a great job!

    @@KevinSorbo. You are correct, I have missed the firefighters spraying people with hoses. Was that in China or Iran? When LEOs attack for recording, they are criminals. We have the "RIGHT", don't need permission, to record our public officials in the performance of their duties, while in public. I am not saying public officials conduct themselves properly at all times.. I am saying, when they do overstep their authority, they are breaking the law.

    if you ever doubted whether a law enforcement agent was a profession, this is a perfect example of why it is NOT a profession. the superior court has ruled that law enforcement is NOT a profession because it does NOT meet the definition. a profession is described as a vocation or occupation that requires advanced education and training and intellectual skills which definitely leaves law enforcement out of the definition. this decision was based on a lawsuit for membership in a clemency board which they loaded with police so no one could be granted clemency. state law defines a clemency board member to be a cross-section of professions of local residents to be a member and since only police were placed on the board, it would not act in the manner in which the board was designed to be manned and function.

    This older cop and this man, had a great back and forth. Not many have this patience and kindness, I hope if I ever run into a cop, that they have this cool level head and demeanor. He explains himself, and asks questions to further the conversation. Great dialogue. He stays aware, he is engaging. He isn’t totally dismissive of any questions. He doesn’t have an ego, he isn’t trying to intimidate anyone. Don’t forget to call notice the good things on both sides

    Years ago, in a small country town near mine, a new cop was hired who would bully, verbally abuse, disrespect everyone, and generally walked all over everybody - he was a cop, he wasn't bound by the law - he was the law. Eventually the people had enough of it. One night a van did a burn-out right in front of him. He hit his lights. The van ran, he gave chase. The van raced out into the country, and down a dead end road. He thought he had had them for sure. He stopped behind them, got out. Eight guys piled out and beat the crap out of him. Sorry, no witnesses. (That's why cops always call for backup when they stop someone now). That night, he learned that having a badge doesn't mean that he has a free hand to abuse people. If law enforcement was required to pass a psychological evaluation to weed out the bullies before they were hired, we wouldn't have these problems. If police held each other to the law, instead of enabling each other in abusing the law, and the public, we wouldn't have these problems. If police believed that they were just citizens like everybody else, who have a job to PROTECT THE RIGHTS OF THEIR FELLOW CITIZENS, rather than treating EVERYBODY LIKE A CRIMINAL, AND ABUSING THE RIGHTS of the citizens as a way of getting a power trip to stroke their egos, we wouldn't have these problems.

    I live in the Dayton Ohio area. I am very familiar with Fairborn and all of the surrounding areas. The Air Force base is here and I’m guessing this gentleman was here for something related to his duties there. The reason they want him to roll his windows down more is obvious. I have been pulled over a few times in the area and never once been asked to roll my window down more than halfway. It’s sad that this man is nobly serving our country and is treated this way by uneducated law enforcement in Ohio. Kudos to him for knowing his rights and knowing the law better than these tyrants.

    I say this all the time, when someone becomes a law enforcement officer, they must have at least one or two years of a law degree to become a cop, that way there is no misunderstanding of the law, because most of the cops I see don't know anything about the law

    If the state has a violation on the books for having an out of date address, then the officer asking if it's a current address is a violation of the 5th. Threatening the man with arrest if he doesn't verbally answer a question that could potentially implicate him in a violation seems like a pretty clear case of attempting to violate a man's rights under color of law. The license is on the address, as you say Abiyah, he's satisfied the requirements under the law. Too bad this officer is too full of himself to ever get how much of a POS he really is.

    Sid, here in Ohio when they ask you your address and they have your ID in hand that means they are checking to make sure you have kept up your info on your license. In Ohio, when you change addresses you have like 10 or 30 days to inform the Bureau of Motor Vehicles. So, they are looking to see if they can add another charge..

    That would be part of the investigation to which the individual has no lawful obligation to assist. And what do you say to an engineer or architect who is temporarily on assignment in a location that exceeds 10 or 30 days. Are they under some obligation to change their state of residency to satisfy the job? Or in this case an individual in the military. Doesn't make a lot of sense.

    That Ohio law doesn't apply if you are in the military. He doesn't have to get an Ohio driver's license or report to them that he isn't living in Florida. When you are in the military you are considered to be domiciled in the state where you enlisted not in the state where you are stationed and currently living.

    And have a direct link to it in all cars, publicly announced that it is required to be in there, so they can't lie about not having access. They would not have a valid ras without a working and often used tablet, would have a key logger with a publicly available password. Any detained person can check the current laws against what the leo is accusing/detaining them for on site, No more qualified immunity without meeting very strict requirements.

    Cops sign up to enforce laws where they’re hired. Who cares about laws in other state. No confusion they will always play the stupid role to get you to talk and get upset when you play the stub role and don’t answer their questions or challenge their “authority”.

    The police just want to win against the citizen and often, against the citizen's rights as we seem to see here. Look at the many KZread videos where police officers have been arrested for different offences --- their attitude is always one of, -- but I am a LEO -- can you give me a break? --- almost to the point of begging! Priceless!
