If Glynnis Breytenbach were Minister of Justice...

What would Glynnis Breytenbach do if she were the Minister of Justice? In a face-to-face interview from the Latitude Aparthotel studio in Cape Town, BizNews asks her for solutions. Breytenbach, the Democratic Alliance’s (DA’s) Shadow Minister of Justice, says that her first priority would be to ensure that the functionality of the criminal justice system was restored. “The entire system needs a serious overhaul, and that includes the police, the prosecution, the judiciary and correctional services.” Currently, Breytenbach is working hard towards the establishment of an Anti-Corruption Commission that would relieve the overburdened National Prosecuting Authority (NPA) of the task of prosecuting very high-level corruption- and organised crime cases. She is optimistic that the bill will sail through Parliament - with the expected support from the African National Congress (ANC) - and that the Commission could be set up within about a year - and that this completely independent Chapter 9 institution could start prosecuting these complex cases within 18 months so that South Africans can start seeing accountability and consequences. - Chris Steyn

    I attended a court case in Empangeni once. I can speak English, Afrikaans and Zulu. The black interpreter had to interpret from Afrikaans to English. What he translated to the Indian magistrate was not even remotely in line with what was originally said by the accused. it was a total mess.

    Not in an inhumane way but yes, great idea and use low security prisoners to ensure public area are clean, islands are mowed, etc. This lying around smoking dope in jail is not good for the soul.

    Step 1. The building of prion business would sky rocket. More tenders and building Mafia will definitely benefit. Step 2. Internal job fighting would escalate dye to volume of prisoners. Step3. Massive corruption within the prison service would require effective management with harrs consequences. And so it goes on and on. This is South Africa, nit Africa. Anc and cadres were given the goose that lays golden eggs. All they do is abuse the goose.

    I 100% Agree with Glyniss . When I go to to the Police station to write an affidavit I know to take my own pen as it’s very likely they don’t have stock of any to write you affidavit. Great interview.

    Foreign court Interpreters should be appointed per contract, sign language interpreters should be permanent employed and also casual interpreters should be employed permanent by the department.

    We had functioning systems prior to 1994 but people thought that destroying the structure instead of just integrating all the racial groups into it and building it to accommodate all. The USA made This same mistake when they destroyed the Iraqi army and their country's political system. SA should not have just been handed over to a terrorist organization.

    I was hoping to apply for the Aspirant Prosecutor Programme this year, and take up training to become a prosecutor, however, that programme was placed on hold due to budgetary constrain. It saddens me that the department of Justice would allow that. It needs to see to it that such an important skills development training is not placed on hold, and actually deploy all funds necessary to run that programme. Senior prosecutors are retiring, others are living for private practice, whilst others are being elevated to the bench to serve as magistrates and judges. This can only mean that soon enough, there will be a shortage of skills in the NPA. We can't afford to have a minister of justice who doesn't prioritise the NPA

    What’s the difference between a whistleblower and a informant? A informant gets paid for information while a whistleblower has to go into hiding. Where is the common sense in all of this. Double standards at its best. According to me whistleblowers should be held in high regard, but in SA they get treated like criminals
