I once got yelled at by the owner of a dvd shop for opening the case to check the disc. He was all "I have quality stuff. You don't trust me. I don't trust you. You could be stealing" and I'm near tears cause I just came to have a good time and get some cool stuff but was being treated like I committed a horrible crime by wanting to see if a copy of the Charlie's Angels movie was in good condition! I dropped the armload of dvds at his feet and walked off. Next time I went to where that store was, it was long closed down. Guess he pulled that act with too many people.

I heard of a district manager that would walk around the store with the main manager, assistant managers and department managers. If he saw an item that didn’t have a price he would grab it and give it to a customer that was nearby and tell them it was free because it had no price on it. He wasn’t messing around.

Dude, regarding your first issue of seeing one price on the item and then the cashier tells you it's more, in some states by law, they are required to sell it to you for the cheaper price-assuming you are in a state that has such laws and said state enforces them.

This is also true in Canada. We have laws against Red Flag #1 mentioned. Thats why i have never come across this issue. Not only they would have to sell it at the sticker price, we are entitled to a $10 discount as well. So if an item was priced at $10 and they try to upsell it at the counter, we could actually receive it for free.

This is a law in almost all states the item in question is always sold at the price marked if lower than the register rings. Another issue was the seller checking e-bay to sell it for a higher price that would be call a mark up a very disreputable business practice. I would not buy his merchandise and report it to the management of the flea market.

Bait and switch is ILLEGAL. The legality of a business charging more than the price marked on a product varies by jurisdiction, but generally, it is considered illegal and falls under consumer protection laws. Here are some key points regarding this issue: ## General Principles 1. **False Advertising and Overcharging**: Most jurisdictions have laws that prohibit businesses from charging more than the advertised or marked price. This practice is often referred to as "false pricing" or "overcharging" and can lead to both civil and criminal penalties. For example, California's Business & Professions Code § 12024.2(a) makes it unlawful to charge a customer more than the price advertised, posted, marked, or quoted for an item[3]. 2. **Consumer Protection Laws**: Many states have specific consumer protection laws that address pricing accuracy. These laws typically require that the price charged at the register must match the price displayed on the item or on a shelf tag. If there is a discrepancy, consumers are generally entitled to pay the lower price[11]. 3. **Penalties for Violations**: The penalties for overcharging can vary. In California, an overcharge over $1 can be considered a misdemeanor, punishable by fines and potentially imprisonment. Lesser overcharges might be treated as infractions with smaller fines[3]. ## State-Specific Regulations 1. **New York**: In New York, the law requires that the price charged must not exceed the lowest advertised, written, posted, or marked price. Violations can result in civil penalties, and repeated offenses can lead to more severe consequences[9]. 2. **Connecticut**: Connecticut law mandates that if an electronic price is higher than the reduced price marked on a sign, the consumer is entitled to one item of that commodity at no cost. This aims to protect consumers from electronic pricing errors[2]. 3. **Ohio**: In Ohio, while there is no explicit prohibition against charging more than the marked price, consumer protection laws require clear disclosure of product pricing. If a business complies with disclosure requirements, it may not necessarily be illegal to charge a higher price, but this is often subject to interpretation and enforcement by state authorities[12]. ## Reporting and Enforcement Consumers who encounter overcharging can report the issue to their state's consumer protection agency or the local weights and measures department. These agencies are responsible for ensuring pricing accuracy and can conduct inspections and impose penalties on businesses that violate pricing laws[6][14]. ## Conclusion While the specifics can vary by state, the general rule is that businesses are not allowed to charge more than the price marked on a product. This practice is considered deceptive and is regulated under various consumer protection laws. Consumers who experience such issues should report them to the appropriate authorities for resolution. My biggest pet peeve is when the studios don’t shrink wrap the slipcovers, and then the stores put their price stickers right on them. I decided long ago that I just wasn’t going to buy them if they did that. Best Buy lost a TON of my business by doing that, they eventually stopped but they’d already reduced their selection by then. I never buy a used copy of anything to save money, so if I pay more for a new copy there’s no excuse for putting a sticker right on it like that. I’ve even seen Amoeba do that which is pretty sad. I went to a store in Reno once that had laserdiscs which weren’t priced. I brought up the ones I wanted and most were reasonable in the $5 range, but the guy wanted $27 for one because “that’s what it last went for on EBay.” I told him I didn’t make the trip there to pay EBay prices, and good luck getting that much from anyone.

We have a "city wide garage sale" in Austin. I collect cameras, and I sell cameras. I was at a table, seller has mostly cameras out, no prices on anything. Condition is everything. I'm checking stuff out, looking for scratches, fungus, etc. in the lens. Seller gets annoyed and tells me I'm not allowed to look at cameras until AFTER I buy them. I ask how I am supposed to know WHAT I am buying if I don't look at it? He gets very rude and I walk off. A seller at another table actually got upset and complained to the sale's management on my behalf. I've never been back. The fun twist to this story is that years ago I actually bought something from this guy off ebay. It showed up broken. I asked for a return, he freaked out, but had to take it back per ebay's policies. He then blocked me. I didn't realize it was the same guy until months after he freaked out in person at the sale. I participate as a vendor at camera meets/shows. If I don't want people to touch something, I put it in a case. If it's out on the table, it's expected that somebody is going to pick it up and look at it.

Never encountered any of these red flags but I initially built up a sizeable blu-ray collection from buying from a national Pawn shop chain. I found the 1960's Batman TV series blu-rays at one of these stores, they were in their 3 separate blu-ray cases without the box but I bought them anyway, stupidly without checking all the discs. Popped the first season 1 disc in and it glitched and skipped and froze constantly, took it out and it was scratched. So I took it back the next day - they have a 90-day return policy and got my money back...no problem. Went back a few days later and they'd put it back out on the shelf for sale, with the same scratched seas 1 disc...

Then starting about a year ago, every single movie I bought there had scratches on the discs. And not just a light scratch. Lots of awful looking scratches. I used to sell to them as well and got a decent amount of money. They were usually pretty fair. Then I brought in about 20 movies. Blu-rays and DVDs. Most of them boutique films that should have gotten me at least $10 per film. They offered me $12 total. I was shocked! I told them these movies were worth much more than that and I just started selling stuff on eBay. It seemed like the owner started hiring really people who had no idea what they were doing. If it can be shown that the employees of a particular location all engaged in this misdemeanor it would then be conspiracy to commit a misdemeanor which is in fact a felony. It would be better to shop at place (Retail Store) where the merchandise is factory sealed. If you want to buy at a discount shop, just ask them if you can see the disc before you buy. If they say NO then let them know that they will be loosing a sale & future customer if they don't...!

I understand stores not opening items to allow a peek inside especially if it's busy. Its time consuming and the store can't sit there with people in line held up for someone wanting to "take a peek" or choosing "the best looking one out of five". #2 Pricing. Half Price Books where I live I haven't gone back to in months. They like to charge Amazon retail on all these used titles. I have even seen a boxset where they say a disc is missing and still priced at Amazon new. CRAZY. I only go back because they are 3 blocks from my house and I once got a SACD for regular CD price and some Vinegar Syndrome titles at a reasonable price. I though I would give them a chance to purchase some of my blu-rays I had upgraded to 4K, duplicates from another package deal and even 4Ks that I got because I later got them as part of a boxset. Their offer averaged out to $0.25 a disc. More often than not I leave angry at them being so crap.

GameStop was on this BS with the original Wii release of Xenoblade Chronicles (and probably some others). Since the game initially was localized for the US with a very limited print run, GameStop somehow became the EXCLUSIVE RETAILER to carry it. After a while, they “converted” all their leftover stock of it from new to “used” so they could charge MORE than the MSRP (marking it up to $80 or $90 for a “used” copy for something that originally cost $50-$60).

Very good tips! I went to a used book store once that had a comic book area. First thing I noticed was they were not sorted. Since it was near where I lived I told the owner that I had worked in comic book stores before and could sort them relatively quickly if he wanted and was willing to pay for my time. I said he would think about it. Then when I noticed there were no prices on the books at all he asked which one I was interested in and he'd look it up. I raised my eyebrow at him, he clearly remembered me telling him that I has worked in comic book stores in the past and he literally said out loud "Oh wait... You know what you're talking about don't you?" Never went back there.

Here's the problem: More people than not ARE still buying them despite all that sketchy stuff. Enough people ARE trying to steal the disks when they open them. It's enough people ruining it for the rest of us. No joke, this extends way beyond something like physical media stores. There are so many food places (Pizza, Chinese food, Indian food, etc.) where I live that refuse to either A. Deliver. or B. Accept anything other than cash because enough people figured out a way to fake payments online or outright steal food from delivery drivers that it's no longer an option for those of us who aren't complete douchebags.

If you are at a physical media store, this shouldn't be an issue. If the product isn't up to par, you bring it back for a replacement or a refund. If it happens more often than not, that's when you take your business elsewhere. It's a formula that's been practiced for decades.

@@HunterBoldingVideo that was on a major store. It´s in the law here, you pay what´s on the price tag and if you are lucky to find something wrongly tagged with a price , no matter where you buy the thing in a regular store, by law you are entitled to buy it for that price. The stores don´t even try to argue because they know in court they will loose. On a flea market type situation that does not apply and of course you can just take the whole thing back and refuse to sell, etc. But on a regular store, the price you pay is the price that´s tagged. No matter what you buy. I´ve purchased many things over the years at insane low prices because of that. Now and then you go through a store and see stuff with the wrong price. It´s been a Portguese consumer law for decades and decades and decades now. :) The most expensive thing I got was that stereo set up, with cd player, columns the whole thing. For $12. But over the years I got "good deals" :) on other things like clothes, cds, dvds, blurays, books, ( on major stores like "FNAC", "WORTEN", etc ); regular food stuff ( on the supermarkets you find stuff wrongly tagged all the time ), etc. It´s not even an issue here. You pay the price that is tagged and that´s it. Too bad if it happens for the store but the law is on the client´s side on this.
