I must thank his staff's amazing research abilities who assist in ferreting out so many troubling items that impact the selections of these judicial candidates. Many heretofore unknown to the general public unattributed opinions to these judges which are crafted in an effort to obscure the final opinions and in her case, failed to stay on the minor starting point of her interview. She dissembles on a very fine [even miniscule] point about children that 'may' be born with genitalia identification issues and then seeming applies it across unattributable decisions and then tacks on some nonsense about the separation of church and state [WHAT!]. Please show her the door and no door prizes for her playing at this game, as she can't be counted upon to even confirm her previous opinions, much less, apply the law evenly or fairly; never mind that she wouldn't answer Mr. Howley's question concerning her future recusals when these 'two-sex' case issues come before her.

Imagine you have a daughter who is born intersex and she is not allowed to join sports clubs at school or go into public bathrooms due to the fact she was born with typical female sex traits and an additional dysfunctional penis, for example. You'd not like that, right? They'd be blatantly discriminating against her due to some random biological trait she happened to have due to an unlikely event during fetal development. It's not really any different from people born with an additional finger or whatnot. It's some weird biology mishaps that happen due to the way human reproduction works, not something that defines their personal worth. It's important we discuss these things, even if they may make you uncomfortable or aren't something you thought would ever happen. When we don't specifically account for these rare cases, those children then will end up in a hostile environment that doesn't accept them for who they are. We do still care about the children, right?

No, it's not. While quite rare, intersex babies are born all the time. Out of 5500 births, one baby will be born with biological markers of both sexes. You can do the math. Then you don’t understand that genitalia develop at a point during pregnancy that can lead to ambiguity about whether the genitalia look like male or female gender. Doctors make their best guess. They need to check DNA in order to be positive. There are males, for instance born with 3 sex chromosomes, like not just XY but XXY. The doctors do make mistakes. An apparently female child can have labia, a slightly oversized clitoris, no uterus, no ovaries, but have undescended testicals. The doctor sees labia and a tiny penis. Doctor says female, his best guess. And it’s not a female. As the child grows up a bit, it comes to identify with either male or female, regardless of first glance of the genitals at birth gender assignment.

Actually I heard that she said that for about 5 babies born a day doctors will find it difficult to assign a gender. What no-one whose comments I've managed to read on this site so far appears to understand is that there is a human condition known as hermaphroditism, whereby in a small percentage of cases - I don't recall the exact percentage - it's less than one per cent, but larger than I had imagined before I read about it - i.e. not a vanishingly small fraction - pretty low, but if what she was saying was that, on average, 5 babies a day are born with or without sexual organs that relates to either gender within the USA or even, perhaps, within a populous state, then I could imagine that that might be the case. Please don't misunderstand me - I'm not a member of the wokerati by any means. However, about 40 years ago I was working in a theatre which on one or two nights a week showed arty or avant-garde or such-like films that were screened to a late night audience (at around about 11pm till 1 or 2am - that sort of time) and I saw some quite good ones. However, one night I went to see one called something like 'Private Vices and Public Virtues' which I would characterise as arty with more than a hint of pornography about it, in which hermaphroditic nudity and sexual acts were shown. I left once I realised that was the nature of the film as I found it not to my taste; I hadn't realised what the content would be and realised I was not sufficiently "open-minded" to sit through it. However it did open my eyes to the fact that some people are born hermaphrodites - I think that this is something that has always existed, but I suspect that until recently many people who suffer from this condition would have been loath, for many reasons, to talk about it, and would have kept it secret. I'm not sure that Mr.H.'s / SenatorH.'s / Congress man H.''s (I'm not sure of the questioner's position, being English) attitude was very helpful, as he seemed to me, from the short amount I watched of this clip, to be unwilling to let the judge in question finish a sentence; it struck me that this was all about point scoring, not about eliciting elucidation, or really much of a genuine enquiry (that's how we spell that word in my country btw) at all. I'm not intending to pick on you particularly, Angelo Santiago, in this reply - as far as I can see, not wishing to spend a long time reading all the comments - but all the ones I have read suggest to me that lines have been drawn, based on bias against wokeism (which is a slightly different matter from what I think should have been the issue at stake here) rather than genuine scientific knowledge. So this comment is directed to anybody who agrees with you on this post, if they think I'm wrong, not just a difference of opinion with you. So if you're all going to pile on to me with answers or insults - be aware, I have more pleasant ways of wasting my time than replying to anyone who just wants to insult or make stupid arguments, and I may well not reply if I think it would be a waste of time. Call that defensive if you like - but I'm not as young as I was, and I choose not to do too many distasteful or boring chores any more. In any case, I think we all probably need to be focused on more important things - such as is WW3 about to break out?, rather than the importance of scoring points or insulting those who don't agree with us about gender questions. As the old saying goes 'We have two ears and one mouth for a reason'.

@@robertdavidson8028 Dear Mr. Davidson, I read your comment, rewatched the clip 3X, then reread your comment, and may I say that: 1) It sounds to me as though she is trying to address the rights of hermaphrodites in America, which I never knew (in my 62 years) was a problem worthy of scrapping the laws already in place protecting women from men. 2) It seems as though she is attempting to overhaul our laws in favor of the very minute few. I question whether hermaphrodites even require this overhaul of our judicial system. Yes, we care and look out for everyone in our country - maybe not PERFECTLY, but it's better than anywhere else. I'm not a rocket scientist, obviously, but I have to question her motives for wanting to undo our God-given U.S. constitutional rights. Inclusivity? My foot. It is not inclusive whenever citizens' rights are trampled. I salute Josh Hawley for doing his best to keep our ship on an even keel during the most ridiculous, absurd, indecent, depraved, hellish, sinking time in our history.

What does she mean, doctors can't always determine the sex of a newborn? That is the most ridiculous statement I have ever heard. I am not a doctor, but I find it quite easy to determine, I have never failed to this date.

There are children that are born with both sex organs. These children are called Intersex. These are the children that the judge wrote her article about that Sen. Hawley was talking about. I suggest that you educate yourself on their existence as children have been born like this since at least the medieval times. Then go and read her article in Time magazine.

​Intersex births are extremely rare, individuals born with intersex chromosomal abnormalities always have a dominant sex and persent as either male or female. It's much more complicated than you've mention.

I have an even higher level of respect for Josh Hawley after that face off. That woman is insane, you can see it in her facial expressions and eyes. How do people of her ilk get nominated for these positions??
