    Adam, love your channel love everything you do. I just rewatched this video today, the reason for that I follow Roofing Insights. Dmitry just posted a viedo of some contractors going to jail and facing 45 years in prison for deductible waving. I'm in NC and I think some of your advice might have been what they were doing. Are you sure that yard signs and referrals are legal? Those guys had AOB and signed contracts that they were paying funds for advertising, but they still ended up breaking some laws. Sorry for long post, I just want to make sure what I'm doing is on the up and up, and a lot of what I pitch I've learned from you.

    This is a GREAT question. In Florida, neither are legal. In many other states, both are legal. I have never personally used the yard sign allowance, and I frankly am against it. But it has been done. Check your local laws. Referrals are OK in nearly all states - again FLorida it is not. Gotta stay current with the laws :)

    Isn't using the ACV line items fraud if you are collecting that money from insurance and not replacing the damaged items?

    My understanding: Any ACV items can be pocketed 100% legally. So long as the invoice (when you file for depreciation) shows the actual contracted amount for the work done... and so long as you actually collect the full amount... then that is 100% legal. Because they are doing the work for the proper amount. What happens to the ACV items they did NOT do the work on? They keep the cash, but can't collect the depreciation. And technically, those damaged items are no longer insured since the claim was paid out but the work wasn't done.

    No, the acv is the customer's money. They can use it for a keg party if that is what they want to do. They don't "have" to do anything. They can take the whole acv check and go on vacation. Their carrier may drop them and they may not be able to get coverage down the road, but they have options. We are in great USA. :-)
