The sad thing is, the stink of this will follow him around for the rest of his days. Women who cry rape to cover up cheating, avenge rejection or whatever should face criminal charges.

    I have no idea if she was too drunk to sufficiently consent or not. My problem with this case is that the criminal justice system that we have spent centuries building can be ignored for a civil court which does not hold to the basic global(almost) standard of 'beyond reasonable doubt'. If there was not enough evidence to even bring it to trial in a criminal court then that should be the end of it.

  • @falconhoof3421

    @falconhoof3421

    We have a unique court service. One of a kind. Believe it or not... The civil claim in law actually worked in his favour? Had he met the threshold and the evidence was strong enough to be put before a criminal jury, it would have been a whole lot worse. The incident occurred, of that there is no dispute. So even though there was not evidence to convict beyond a reasonable doubt, there was enough evidence to show on the balance of probabilities? Like if two men have a sexual encounter with a woman, and that woman was incapable of either giving or withholding consent because she has passed out due to intoxication, then it is up to the judge to convict or not, based on the balance of probabilities. The balance of probabilities this time showed they never sought consent. There was no balance of probabilities saying she consented, all evidence pointed to guilt not innocence? Even if the guilt was only proven to lesser degree than meets the criminal threshold, the balance of probabilities based on evidence put before the judge did show guilt?

RAPIST is just the misconception attached to his guilt verdict for an altogether separate sexual offence he was found guilty of committing... On the balance of probabilities.

    According to the court documents she remembered having various drinks (eg JD n coke and double JD and coke) and meeting the accused, but then her drunken amnesia strangely (some might say conveniently) kicked in right at the point when she became flirtatious, provocative and kissing the accused, something she had to concede in court when shown cctv. She was supposed to phone her brother to pick her up and had text him earlier in the evening, but then didn't and wouldn't answer his calls and texts, but did text other people. Then ends up in an unfamiliar flat and phones her brother, who has been driving around at night worried and looking for her, to pick her up. Is she going to tell him that she was cheating on her boyfriend and ignored his calls to go to the flat with the accused, or is she going to say "I remember nothing of the night" and excuse herself from self responsibility and agency?

How this guy has been vilified like he has is beyond words. Denise got fucked by two football players, saw pound signs tried to take it to court failed with that then went to civil court, which as David’s lawyer said THIS IS A MONEY COURT! but David in my mind you are guilty of one thing, not wearing a rubber with slappers like that. Great interview James and it’s time people end the witch hunt on this guy. He’s not been convicted, he’s not offended since, he has a clean record. If that’s not what rehabilitation is, then what is. He’s just wanting to get on with his life and support his family and play football. When someone has had suicidal thoughts, it’s clear that they are struggling with life. The SNP, the government and now all the councils are trying to continue to ruin a man’s life even to the point where he might end his own life. It all needs to stop and by the councils coming out saying they will ban any team who signs him are telling the world we don’t support rehabilitation for any offenders and that we will continue to ruin peoples life’s to the point where they commit suicide. It’s truly disgusting and they should be ashamed, hopefully this interview shows all the virtue signal callers out there that he isn’t a dangerous man and most of all a rapist. I for one was one of many fans who gave him it tight back in the day and this interview has shown me my own naïveté on the matter. I like to apologise to David and feel terrible that I joined the many thousands who said such chants at him, without really seeing how this could effect him. I hope David gets the chance to continue to play the sport he loves and that people see him for what he really is and that’s just a normal man trying to support his family and battle with the struggles of what life has giving him.

    Good attempt at trying to rehabilitate David Goodwillie. Your glossing over his criminal record of several assaults (“boys will be boys…” er - no, most young lads do not put people into hospital with grevious bodily assaults!) and emphasising that your conscience was clear about interviewing him because his conviction was in a civil case rather than a criminal court (are you not aware of how difficult it is under Scottish law to prosecute rape and sexual assault cases?). By the way, James, you owe an apology to the people of Stirling for describing it as a shit area: better people than you or I have come from Raploch, Stirling. Your soft questions and chummy approach in the interview do make David Goodwillie come across as personable decent gadj. But the men he beat up wouldn’t agree with you. And as for the rape situation… if you read the civil case report with evidence from nightclub staff, taxi driver, medical staff who attended the victim and ask yourself if you would’ve given a different judgement as the judge did.

As soon as someone claims rape regardless of convictions or not guilty verdicts, everyone loses.
