How today's copyright policy impacts me

    It's not KZread who is the problem, it's the record labels. KZread only makes money if people watch videos. They don't want to delete any content, especially not videos with millions of hits. But the record labels put pressure on them and they know they can't afford to fight every case, so it's easier to just pull the videos and the uploaders instead. Don't blame KZread.

    I agree. This is pretty straight forward: "Fair Use is the right to copy a portion of a copyrighted work without permission because your use is for a limited purpose, such as for educational use in a classroom or to comment upon, criticize, or parody the work being sampled."

  • @deanroddey2881

    What goes around comes around. Copyright law has been almost utterly ignored by the people of this planet since 1998'ish or thereabouts. And of course the real issue here is that sites like KZread have gotten filthy rich off the backs of content creators. Everyone knows this. BTW it's difficult reconcile fair use with use for financial gain. This type of video is for him to make money. That's not classroom use, or commetary or criticism or parody. It's using copyrighted material as part of a business. That really is something that should fall outside of fair use. I know it's a corner case, but still he's doing it for bucks and that puts it in a different position.

  • @photios4779

    @photios4779

    5 жыл бұрын

    @@deanroddey2881 You said, "That really is something that should fall outside of fair use. " *NO IT IS NOT.* Using copyrighted material as part of a business occurs every time an author of a book or magazine article quotes a copyrighted work or a documentary film producer includes short film clips for illustrative purposes....or someone comments upon or criticizes a song illustrated by individual chords played on his own guitar. What he is doing *is* a form of musical commentary for the purpose of educating others and that is fair use. Not all education happens in a classroom (and besides there are plenty of for-profit private schools and for-profit textbook companies that rely upon fair use all the time). It's not wrong to earn a living from one's work by monetizing one's videos, even if that work involves some "fair use." I agree that there is a lot of blatant, obvious, copyright infringement on KZread. That is a real problem. Not Paul Davids critically analyzing a copyrighted song for educational purposes. Strong copyright enforcement of actual violations can co-exist with robust fair use.

  • @deanroddey2881

    @deanroddey2881

    5 жыл бұрын

    @@photios4779 I agree it's often a corner case, though the use of other people's content being fundamental to the channel content is pretty different from occasional quoting of content and such. I don't think it's nearly as obvious a problem as reaction video folks who just play the whole songs and such by any means. But, anyhoo, as with all things like this, there's no mechanism to have someone look at every example and make a value judgement on it. KZread isn't likely going to spend the bucks to do that, and would probably have to do something more blanket mode as a practical matter. And, frankly, KZread probably sees it as being to its own benefit to over-play the situation and crack down too much. Are they going to get blamed? No, probably not, they will just let the blame fall on the folks trying to protect their copyright, as it always does.

    @@MarioSabljakovic No, not even close to the solution because the problem is far worse. Allowing anyone to invoke copyright ownership, and taking them at their word with no penalty for false reporting, is just asinine. Claiming copyright for a chord -AND GETTING AWAY WITH IT - is so fscked up, its unbelievable. What dumbass thinks this is copyrightable?!? This would be like trying to claim copyright on the word "the", or the first sentence of a book in the example of 8 notes in sequence. AND YET, the same labels are fine with artists using riffs or licks from other songs and tunes without fear of reprisal. This is common in the music world. I mean, seriously, most of Pop music is covered by four chords for ffs. You could almost destroy the ability to create pop music by claiming four chords. KZread - by extension Google - do not give a fsk about how you and I feel about this, because we continue using their products. As long as they still get billions of eyeballs every hour, they do not care even if a million of us leave. You almost have to make it hurt too much to continue acting in this way, and the only way to do that is to start a reverse campaign. Get a large group together that claims copyright on everything published by the labels that cause this problem Give them so much work to do that they start putting processes in place that prevent false - or spurious - claims. Or get a gofundme going and sue them. There is little more that they care about here.

    Let's not forget that the people running these companies are not exactly progressive thinkers. Rather than seeing the opportunities in the marketing reach of these platforms, they try to squeeze every last cent out of it by legal means. Mostly, they are angry and frustrated that KZread is making so much money with a business model that subverts their own... but they have no legal means against the platform as a whole, and they already depend on it in many ways. At the client end, the packets of data are then assembled in the correct sequence then the fundamental waves are recombined to create the sound that you hear.

I understand you are facing direct claims from certain people while mine were automated claims. All we want to do is teach and help people grow as artists and producers. It's the biggest "rabbit hole" of YT atm. I even got a improvised original beat I did (four bars) during a original production tutorial claimed... That's insane, can't even play drums for four bars and get claimed... The YT rules / workflow for copyright need to change. Superb video on the problematic of the current copyright system Paul. Fair use is a common law construct, and an open one at that. Most civil law countries don't have it, they have limited copyright exceptions. While I agree with Paul that these claims are ridiculous, spurious even, it is hard and expensive to fight, even if the jurisdiction was clear. After all, these companies net a lot of money, so they will use their deep pockets to smother any claim for a long and expensive time.

    What is wrong with these laws is that it should be the owners duty to prove it is not fair use. Not just by claiming it but showing why. Social media platforms should had never be held responsible by the content posted by its users in first place. Simply because freedom of speech is a value that should always be bigger than ownership. Then the law should consider all use of any content as fair use as long the reference to the font is provided (like it is done in literature). Unless proven contrary by the owner, of course. I did a homemade video of public domain music and received numerous copyright violation notices. I appealed and KZread said, (paraphrased) "The claimants said it's their music. You can appeal again but if you lose the second appeal we may delete your entire account." KZread didn't even do any research of their own, they just sided with the claimant. I was infuriated and filed the second appeal with trepidation, providing proof from the online website for public domain music that indeed the music was public domain and that the claimants were liars. I won but it was a lot of trouble for zero dollars that I get from KZread anyway.

Quite alternatively, before they made it, they were influenced by other musicians along the way. So what these musicians need to do is tell the greedy ones where to get off. Reason being, if they don't, then the next generation of musicians are going to miss out big time, along with subsequent generations. Surely sharing knowledge freely is the best way for our civilisation to develop, or would it develop better if the acquiring of skills had to be pay for? I think learning freely is a better way. Paul, first I love your videos and amazing playing. Second, I worked at Universal Music Publishing here in LA for about 13 years. And you are right, the situation is completely unfair to guys like yourself. I also have my publishing through Universal, and on one hand I'm grateful that they are out there collecting on my songs. But the truth is that companies like Universal need to treate guys like you as a partner, not a criminal. You have a platform that you've built here. And if you use someone else's copyrighted music in your video, there needs to be a fair and simple license system to give them a few pennies of your dollars. The fact that they receive a 100% gain on your creative work in these videos is the real crime. But Universal and all of the other major publishers have beat the crap out of KZread in court, and this is the result. For the record, I will happily watch your channel, whether you are explaining someone else's music or your own. I don't really care, I just learn a lot from you either way. Keep it up brother!

    100% agree! Companies like Universal should be happy you're teaching their songs etc because it promotes the material and extends the lifetime of each song which, in turn, makes the material worth more $$$ in the long run. The record industry however has a poor record when it comes to adapting. Look at the Billions they lost wasting time fighting Napster.

Now, I don't understand what is the difference of using examples of real music in the class room environment versus in KZread lessons...? The analogy Adam proposed in this video is spot on! I really appreciate your making your videos, I had no idea it was so bad. I thought you had to actually play the copyrighted music. And what's absolutely insane is, after watching your videos about a song, I will then go listen to the song on a streaming service in order to hear what you're talking about a refresh my memory, or just enjoy it. So you're freely advertising the music that I am going and consuming, that they are then getting paid for. You, talking about their music, is already benefiting them. I have rediscovered music I haven't listened to in years by watching your videos, I've discovered new music as well. I will consume whole albums after you talking about one song on that album. If they would leave you and others like you alone to talk about the music and dissect it, they're getting tons of free advertising by trying to shut you out they're limiting their own exposure.

    This issue is obscene and an affront both to fair use and common sense itself. The best way to seek change is to hit the most egregious claimants hard by blacklisting their product, singling them out, publicising the boycott and the rationale behind it. Get a campaign going. All publicity is NOT good publicity for the likes of UMG and they are actually killing music, not protecting it, ultimately.

We're the copyright holders. There is no way to contact anyone about it either. This world's obsessed with copyrights, filling everything with copyright law controlling bots, yet not putting any effort into actually making sure it works right. I do not feel there's any benefit to these automated copyright systems as I don't feel like they protect my work in any way, while such systems constantly threaten everything.

    One way to get around a copyright is to add parody into the lessons/breakdowns within your clips. (Comedy shows do it all the time) You can’t use an entire clip, but you can break it down in multiple clips).
