I am non-resident, living in UAE, applied through an attorney. I am single owner of LLC, receiving messages from a consultant in the USA for the submission of the ECE form to the IRS. As per my understanding, the entity I own does not require to submit form 8832 (ECE) but they are insisting that it is must to submit within 75 days after LLC registration. Your valuable input is needed, please.

Thanks for reaching out to me. Trademark is to be registered in each country where you want to sell on Amazon store. For example if you are selling in Amazon USA and Amazon KSA, your trademark has to be registered at both the places. It is possible that you registeted one trademark as SALMAN HONEY, in the USA sussessfully. But same is not available in KSA. So you may have to choose a, different name there. I hope it clrarifies your doubt.

So the viable sequence is: launch PL, then apply for trademark through IP accelerator.. is that right??

Yes. But if you have resources for both, first register llc, then apply TM against company name, instead of your personal name. Llc takes little time.

Yes. Without having trademark registered at USPTO, you can have it printed on your product and sell it as brand in amazon. But you can not register it at amazon brand registry and get additional benefits of registry.

In that case Amazon account will also have to be in his name and hence thw whole business. So it is not workable.

Is it permissible to register a trademark in only one class while selling Amazon products across various classes? As we have to deal with the products of multiple classes while selling on Amazon.

What is meant by registering one product under multiple classes? Let me explain that first. I want to sell a vanity mirror, that is fitted inside a car on a car wiser. I can register it under two classes. 1. Beauty products 2. Car accessories. Now I will submit my two class registration certificate to Amazon. Now this is how, it will benefit me: 1. Amazon will list it under two catagories. Consequently customers, while searcing this product will find it in either catagory. Hence chances to doubling my sales. Secondly Amazon will provide me Brand protection in these two catagories only. Now consider another person registers the sane product with the same name, yet in a third class/ catagory, he will be able to sell at Amazon. And you will not be able to stop him by complaining to Amazon. I hope I was able to clarify the point. Now come to ur question straight. By registering it in one class, you can't list it in amazon under multiple classes.

I have one doubt, if i listing product with logo and text brand name but in Amazon brand registry not approved also usa trademark registration not yet done, in this case in brand name instead of generic i can mention my brand name ? Yes. You can mention your brand name. But you need to submit pictures of the product with your trade mark embossed on it. It cannot be a sticker or a photoshop image. It has to be real product especially made for you. This picture is analysed by Amazon software and approved, only if it meets their criteria. It takes about 24 hours after sibmitting the picture, to get the approval.

If a trademark is registered for a product that belongs to category “baby products”, is that trademark enough for all products for this category as well as for other categories such as home and kitchen, health and beauty etc; or every product is bound to be registered with different trademark. By the way, in which country are you located? The procedure for USA based person will be simple. For non USA based sellers it may not be cost effective to ship small quantities of handmade product to USA.

As a seller you only need trademark. Patent is a totally different thing but being looked after by the same office in USA. New inventions are registered against a patent.

FBM can be managed only if you live in USA. You cannot ship evey item, from every order, from Pakistan. It will get late and Amazon will close your account.

If you are non resident of USA, then you have to hire an attorney to do this for you. I have explained this point in my video as well.

I am not an atorney. You need an atorney to file application for you, if u are non resident. In my related video, I have given profiles and rates of two such companies.
