    USPTO website outlines the schedule fee. The actual cost of a patent vs the fees for the lawyers is similar to auto parts vs labor cost. Learn to do the labor and you'll save a bunch of money

    I like the analogy. If I may add some more color. There are of course a lot of choices of where to go get your auto repair. You've got the back-alley cash-only discount jobs, and then you've got certified technicians at dealerships. If you've got a old beat-up car that's not worth much 1975 Pacer (i.e. an "OK" idea), then yeah - maybe the back-alley is the best way to go. But, if you've got a one of a kind 2022 McLaren GT (i.e. a "Bold" idea), then you bet you are going to the highest end dealer for certified service.

    @@boldpatents I noticed you redirect it from "learn to do the labor" to "pay the right people". A patent costs less than $1,000 barring extreme examples. Learn to be your own mechanic and you only pay for parts. Learn to research and write patents and you only pay USPTO fees. Thousands, to tens of thousands saved. If someone is making substantial money hourly, then they may wish to pay someone to do patent work. But to average joes who have an idea, your information, or lack of actual fee explanation, can be very discouraging. I understand you're trying to sell services.

    man finally found some good info without having to register to a site or pay a fee. I have and idea for a golf training aid spoke to a couple of teaching pros and the think its a good idea i have a picture of it and i know how it would be used, in your opinion am i ready to move forward with the patent search and whoever i choose how can i make your my idea wont be stolen.

    Great video with tons of valuable Information. Inline with the I have a question, if you could help. I believe attorney would change if one their idea to them but sadly its already patented. Is there a quick way for to check if anything similar already patented? I know it'd need a deep search to find all related prior art but one should be able to find if something very obvious already out there that help save time and money.

    Although it is reasonable and a step by step cost , by the out come it’s really quite a big cost, for someone with no solid foundation it’s almost an unaffordable service . Someway to look at it it’s blocking innovations

    It is a lot of money, which is why we recommend people get partners and investors, or you could do it yourself. But it does take a lot of time. The reason it costs so much is because of the time and expertise it takes.

    @@boldpatents it is reasonable that look at value of the time , and right to look at this process this way . time is the only asset that everyone has obsolute limit, still , it is a lot of money , and time , i just think that this system seem to be over complicated and not promoting inovation.

    So if I had a machine that is based on another already in existence, but has 2 or 3 new attachments that are improvements and not yet in existence, would I need to file for different patents for each improvement, and would those be all separate fees like they were independent of each other?

    If your improvements share a common core functionality, then yes, it’s feasible to have one patent filing cover multiple embodiments/versions of the machine improvement.

    I feel ya. I say that as long as you as the inventor are confident that the invention will work if it were built, and you can describe it in such detail (even if its not built yet), then seek patent protection first, and file a provisional application (after performing a search of course). Then work with a designer to work the invention into a final design that will be received best by the market. And, if done well, then you can roll the final design/tweaks/changes/improvements into your nonprovisional. I know that's a lot to digest.     My wife and I have an idea for an app. We have the IT team ready to develope it. I have some investors with deep pockets that are interested in funding it. It is an app to save lives. But I dont have 40,000. right now to do this. I was thingking of filling for a provisional patent myself just until I get funded then file for the non provisional when I get the funds from investor. Is this a good strategy?

    $40,000 is the upper limit on how much it may take to go from patent search, provisional, nonprovisional, 3-4 USPTO office actions, and through to issuance (typically takes 2-3 years for complex software/method claims).     $30K is ballpark estimate. And of course - that’s the cost of over 2-3+ years, the first set of research and initial filings are $5-10k in the first year or so. Even that can be split up into payments.

    Congrats on your patent, first of all. What's your patent number? Did you have a search performed first? Or just roll the dice and hope no one had done it before? Did you just protect one version of your design? Or did you submit several? If you "saved money" on your design patent filing, then you likely "shaved service", and your protection is limited.

    I have an invention I brought to the attention of my company. They want to patent it. Do i ask that I should be listed as the applicant and inventor for the patent. It's a medical device that treats diabetic nerve pain and circulation issues. I'm concerned they want to be the applicant instead of me? That might take away my rights of ownership. However they will be funding it. So I don't know how to proceed and not get screwed. Any advice would help.

    If you are the inventor, then you should be named as the inventor, regardless of who the applicant is. It's quite common for companies to be the applicant and the assignee (owner), but there is an obligation to list any/all inventors who contributed to the claimed invention.     Great question, Nathan! It really does depend on a lot of factors, like the complexity of the invention and the patent attorney you choose to work with.     Yes, you bring the invention, we will help you flesh the invention out (think about all the versions and applications and make sure its fully defined). We do that in the invention disclosure document. Then we do a world-wide search to confirm novelty and nonobviousness. If we find that there is "prior art" that seems to cover all or most of your invention, we will give you the hard truth that you should not file as it is currently described. While we will not co-invent with you - we do have resources/referrals to designers who can help you go back to the drawing board (with the prior art knowledge) and redesign/change/improve your invention so that it will have patentability - then we help you get a patent on it!

    If you are the inventor, and no one else has invented it (independently) and filed before you, you can still have ownership. However, the best way to go is to file a patent application first, then have a discussion with a company who may way to commercialize it and pay you a royalty or flat sale.
