I had a pinched operated on in 10/21, the slob that operated on me cut into my bowel in 2 separate places. Had emergency surgery to save my life after my bowels leaked into my stomach for 9 days. Someone was supposed to get their leg amputated but the medical staff removed the wrong leg which led to the patient losing both legs (because they still had to remove the correct one after). The compensation for it was around $6k. But a man lost one of his testicles in a botched medical procedure and his compensation was $800k. For context, he only had one functioning testicle before this so he would have to use testosterone therapy for the rest of his life. That's the main reason he got so much but the difference between that and losing both legs is massive.

How can we allow insurance coverage when the purpose of the damages is inhetenly punitive as to serve as a detterent? It would seem then that the only other way we have of deterrence would be for the state to invoke the police power and make malpractice a crime.

What happens is, the lawyers make a deal with the said entity's, and then deny your case. It is happening everywhere. Hard to find a law firm that will help until someone dies. They want small money deals (side bar) or big money (death). Egregious, startling, and unjust.
