    Yeah no. There have been tons of cases where cold-blooded teens or other below age people have murdered others for unreasonable reasons. Not every case is sympathetic, like this one. I remember a case where a teenager who was 15 or so stabbed her mother to death because of some guy and claimed that her mom abused her despite no evidence ever pointing to that.

    An abused, neglected, developmentally delayed 10-year-old child heard his abuser threaten to kill him and his sisters? His parents failed him, the system failed him-frankly, I would have expected anger and literal overkill. Instead, he did what he felt he needed to do and then ran and hid under his covers. The child needed help. While I'm sure he was better off in juvenile detention that he was at home or with his grandparents, but this was just the system failing him yet again.

    My thought exactly. The court was the last hope in getting this child what he actually needed while there was still time.... and they failed him again. We can only hope that this young man stayed true to his caring heart and that's what's leading him down his path as an adult. I have hope for this young man.

    I felt the same when I heard that, too. My chest ached horribly at the thought of that poor boy suffering so. I have 2 boys, 12 and 9, and to think of a child that young hurting inside like that is just so awful. All they want is love, no matter which flawed way they try to use to express that desire. They want so badly to be loved, instead of constantly rejected. That poor baby's life was over before it had even begun because his parents and the system were so unimaginably despicable. The children should've been removed and rehomed before it ever came close to Joseph reaching that boiling point. I hope he can find a way to be okay when he gets out.

    The idea that it’s even legal to interrogate a child without a lawyer present is disgusting. They aren’t capable at that age of understanding the consequences of speaking to police so anything they say to them without a lawyer to protect their rights should be inadmissible in court.

It goes beyond understanding the Miranda rights. A lawyer has a better chance of catching the cops doing any sketchy questioning, which should be of the highest priority. Especially for a kid with developmental issues at the age of 10.

I was neighbors with someone who had done 10 years for removing his stepfather. ...This was in TX, so only getting 10 implies mitigating circumstances. My neighbor never harmed anyone else, and treated his family well. Trailer-park grapevine would have told me if he'd done anything.

    It's going to be a big "If" in that Joseph can be rehabilitated enough to be safely let out into society becuase yeah..literally everything was stacked aginst the kid from becoming "normal" He was already born with a damaged and disabled mind with developmental disorders coming from his mother's drug and alcohol abuse during pregnancy and grew up in an environment of Violence , Abuse and Hate from his Nazi father. Is it any wonder why Joseph became a violent and hateful child? It will take some extremely good therapy and a whole lot of it to even begin to undo the Damage down from his first 10 years of life

    The ridiculous number of reports to Child Protective Services is unbelievable and shows how much the system failed. His parents were absolute trash. All that trauma and hate Joseph experienced plus the developmental issues doomed him. The police asking him about his Miranda rights was ludicrous, his stepmother was not at all helpful. What a mess

    the system HAS failed. you got parents that didn't manage to wash their kid's clothes once get CPS called on them by the school and the kids taken away... yet in this case nothing was done! the system is 100% broken!

    Ironically my best friend I had in childhood her step dad was into Nazi propaganda. The only thing we could watch at her house was WWII or Adolf Hitler shows on the History Channel or he would flip out. When she had kids of her own she ended up having over 20 unsubstantiated CPS reports against her. It took years for the father of her daughter, she had 3 kids, to legally take full custody.

    Joseph was completely justified in what he did to protect himself and others from his father's abuse, and the system made a serious mistake in placing him back with someone like his father in the first place.

    Joseph should've been sent to a psychiatric institution, not jail. At least then he can begin putting pieces together about his life and actually DEVELOP. My heart breaks for him. I wish I could just go back in time and scoop him up and save him from the system that failed him. He was given no chance to live an actual life. Nothing can make up for the years that were taken from him. This will affect him until the day he dies. Everyone that was supposed to help him betrayed him and the most depressing part about all of this- is that even after all of the tragedy and every change up until now, Joseph is once again back where he started. Alone.

    This is actually insane. Like, this is a huge miscarriage of justice. How the hell is a ten year old boy who doesn't even understand death supposed to know what MIRANDA RIGHTS ARE.     Yes and no. He is still a criminal murder is a crime and he knew it was wrong. I however dont believe he truly understood the severity of his actions. I think a juvenile detention center was the best place for him. With his anger issues and history of violence and mental health issues theres no way he would have thrived or been 100% safe for others to be around if he was with his grandma or in the foster care system. I think its pretty likely he would have ended up in jail for one reason or another either way. I just hope that he can be rehabilitated and that his awful parents didnt ruin him for life. Its always heartbreaking seeing a child become a victim to their surroundings.

    The question of Miranda rights is not an issue here. There was no doubt that the kid did the crime and being under age, he received an extremely fair trial.

    That boy was alone his whole life. Alone and abused. And that didn’t change in that interrogation. He was just as alone and just as abused. Detectives only caring about wanting confessions and getting convictions is fine when dealing with adults who can understand, but that was a delayed 10 year old boy. Shameful and disgusting.

    This baby was raised in hatred and fear. At 10 with diminished intelligence he still was unable to fully comprehend what he was doing. He definitely needed intensive, long term physiological counseling to counter the horrifying ideology of his father. I pray he received this help and found healing .

    My biggest issue with this case is that due to his age and developmental difficulties he was in no way able to understand his Miranda Rights. His stepmother in no way should have been acceptable as guardian because she is a victim and has no reason to protect his rights. So his entire confession should have been thrown out in court. The entire system failed this child beginning to end IMO.

    To be honest, his confession didn't mean much as it was so clear he did it. That said they still should have insisted he had a solicitor and his step-mom should have been no-where near when it was another family member that was the victim. A decent solicitor would have argued that that the serial abuse, indoctrination and poor intellect meant that he did the only thing within his power to defend himself and the other children from the violence. It was his father that taught him how to shoot and taught him that killing others wasn't just right but desirable. Also he would have thought that there was no point in reporting his abuse to the authorities as they had already failed to do anything about it on numerous occasions.

    Not sure if it'd apply in California, but in Virginia there's a statute pertaining to "spontaneous utterance"; in a nutshell, anything a suspect says of their own free will before receiving their Miranda warning is fair game for officers and prosecutors, provided they are not being directly questioned. "I can't believe I shot him" when being asked about what happened wouldn't fly, but if the investigator is walking into the room and the suspect says "I can't believe I shot him", different story. Based on how the story's presented here, it's possible that Joseph offered it up completely voluntarily and unprompted by detectives, and in so doing provided his own silver bullet. A confession isn't an automatic win for the prosecution, but it does make the defense's job considerably more difficult. Now, nobody in the comment thread is wrong in saying that it never should've gotten to this point, especially considering it was already clear that Joseph wasn't fully cognizant of the situation. Solicitor on deck, different adult in the room, and possibly not even walking in until the previous two points were resolved. But from a purely procedural standpoint, the confession would be admissible (at least in one state; as said, CA may play by different rules).

    Having a adhd child my self he has meltdowns the physical pain is too much, this poor child not medicated and also given a disturbing childhood even before his birth and lasted throught his miserable childhood it breaks my heart. He just saved his sisters from a further misery. I hope he got the care he needed while in prison and turned a leaf.

    When my past abusive husband threatened to burn our house down while we slept …. I took him seriously and left. This child believed his father probably laid there for hours thinking he could not leave and had to stop him. Tragic situation prayers he gets help and lots of love.

    The time for help and lots of love was 10 years ago. Most people do not understand that the same bad things that happen in male adult prisons also happen in male juvenile prisons... which would have only compounded his problems into being irreversible. There is no going back now; the permanant damage has been done to the poor little guy.

    The fact that Joseph dropped his shoulders upon hearing that the mother called 911, makes me feel like he thought "oh my God she called police on me while I was trying to help us" which might make him him very angry at her. I feel sorry for him

    Well, his dad beat the stuffing out of him regularly, how was Joseph to know his dad wouldn't act on that violent threat? I mean, if I was an adult living with someone who, when drunk, said they were going to unalive me? I'd either leave immediately or make an escape plan. There's a greater than zero chance Joseph's dad WOULD HAVE unalived one or more of his family members.

    thing is, families that are struggling & need support to provide a safe, caring home to their children SHOULD be kept together. non-hazardous households should not have to surrender their children unless they truly do not have the bandwidth to care for them. this is not that situation. i'm not going to sit here and pretend there are no systemic problems or even that these services are consistently delivered properly - that'd just be disingenuous - but the goal of "keeping families together" is for the benefit of parents who are genuinely trying to support their kids and the children who earnestly need their caregiver attachment. the mission to keep families together is because of those that have been unjustifiably broken apart by the state. this was by no means that mindset at work; to "keep families together" requires investigation that leads to an understanding of the core issues disrupting children's' welfare. this was an inapplicable situation characterized by a profound failure to investigate anyone other than joseph's biological mom.

    If after 10 years of abuse you are literally cornered to kill who abused you,you are still the victim and all you should need is help to recover. No one would be happy to kill someone(in a sane state of mind),and I bet he was not too when he realized,so yes,he still is the victim to the very end because its not much the prison that haunt him now,but the fact he knows what he did is wrong but he was "forced" by his abuser to make the "wrong choice" to survive. I just felt sad for him,I hope he is fine somehow now.

    How this case was handled is shocking. In South Africa, the child would have had a criminal capacity assessment by a panel of psychologists/psychiatrists rather than having inept lawyers decide on this with no understanding of child development, neurodevelopmental disorders and the impact of all of this and abuse on his ability to understand and take responsibility for his actions. Makes me so mad!

Most people don't understand that all the bad things that happen in adult male prisons also happen in juvenile male prisons. He was so young and small when he went in, he most likely was nothing but prey for the larger, older boys.

    Unfortunately thats not how self defense cases work. Killing someone in their sleep is likely never going to be considered self defense in a court of law even with the history of abuse and the verbal threat of his father killing the family. Its a very unfortunate case but i think juvenile detention is the best place for him to be. With his violent past and agression issues on top of other mental health issues if the charges were dropped and he was sent to live with his siblings and grandma or put into the foster care system i feel its likely that he would have ended up in jail one way or another. One can only hope that he is able to be properly rehabilitated not sure if juvenile centers partake in therapy to help these kids out or not but ultimately for the safety of him and others i do think its the best place he could be put.

    @@biipo4064 here in michigan (not sure how it works in California but most likely the same or close) he would go to a juvenile detention center (my buddy works at one). it is nothing like prison they receive mental help, schooling, meds if deemed necessary. the problem my buddy repeatedly sees is once they get out the meds stop and they wind up back in. the problem is not the juvenile detention center, its a lack of care once out in some cases. others cases juvie only teaches them to be better criminals and they wind up back in. total lack of proper mental health care here in this nation. i completely agree its the best place for him and good luck to him, it will be an all up hill battle. unfortunately "the nut doesn't fall far from the tree" i'm a nature over nurture type person.

I mean we don't have capital punishment in my country, and so it's common for cops, security instructors and self defence instructors to include the phrase "nobody deserves to die" or similar when talking about people who were killed or almost killed while, or as a result of, doing unspeakable things to other people. It's a line that has to be drawn, and it is supposed to reflect the laws and culture of where you are. To have a KZread channel about violent crime and give out the idea that you're cool with some murders isn't a good look. Besides, we don't know what would have happened if the pos survived; might the kid have been better off? We'll never know for sure.

    My only concern is didnt they get put with grandma if im not mistaken? Where was she when all the abuse was happening to these kids? If she was in their life in any way theres no way she thought they were living in a healthy and safe environment so why no calls to cps or action taken? Why did it take one of the kids killing their dad to get them out of that situation? I of course hope for the best and hope they are being well taken care of and loved but it does make me question a lot of things about this family.

    This is a heartbreaking case! I hate that a child is in prison, & prison is rarely the place to rehabilitate the scared, the broken, and the desperate.     You did a fantastic job of making clear what kind of people we are dealing with. Jeff reminds me of the Bully that was killed by the whole town because of their hate. Joseph was screwed from birth but still a victim. Two years before trial? Ridiculous. Why wasnt this tossed immediately by reading Miranda to a child? I wish they would show where stepmom was during the interrogation because she screwed Joseph just by being there because of her lack of intelligent. Also, Grandma is no angel either.

    To the contrary, Joseph truly believed he was in immediate danger when he killed his father. His father had threatened to burn the house down while they slept. The father was drunk and was known to be mean when he was. Joseph shot him before he went to bed. Most likely. he was truly in fear that his father would kill him if he went to sleep. To Joseph it was immediate. To him it would have been a choice of going to sleep and dying or shooting his father to stop him from burning the house down. It would have been staying alive is now or never. I don't know what occurred that night or what Joseph was thinking, but it wouldn't be out of the realm of possibility that Joseph, known to be a handful, had acted out and his father told him he wasn't listening. To a little boy with diminished reasoning power that would have made the threat a certainty.

    As an educator and a mother of 4 children (all now successful adults) the case of Joseph went straight to my heart😢 This case made me cry. Joseph could have flourished in different living conditions with possibly foster or adoptive parents despite his compromised cognitive abilities. It makes my blood boil how the police failed this 10-year old boy and wonder why he was not first psychologically evaluated? My fear is that Joseph was exposed to more violence and other negative behaviours while in juvenile detection, unless he received excellent treatment. I wish Joseph a better and successful life as an adult ❤

    I grew up in a very abusive home and I seriously considered this with my stepfather. I wanted to protect myself, my sister and my dad that he constantly threatened to kill.

    Stories with such young children breaks my heart. Hearing Joseph's crying on the 911 call was shattering. He knew what he had done but, in his eyes, he was simply protecting himself and his family. Raising a child his age has really made these stories hit so much harder.

    This poor lad was abused even in the womb. Programmed by his neglect and abuse, he still felt fear, when an adult threatens him (his drunken father) and his family, his poor mind never knew calm, warmth and love. I hope he is out from juvenile detention and at least having a life after this. So Sad for him and all his siblings.

    He should have spent that time in a psych ward for kids. He was abused emotionally, physically, and mentally from a very young age on. Nowc ouple that with his mental status...He needed a lot of mental support and love wherever he could find it. Very sad. 😢

    God i cant do anything but feel so sorry for Joseph.. The kid never had a chance at life. All he knew was hatred and destruction. None the less, Before Joseph killed his father, the father was threatening killing him.. I couldnt even imagine being in this situation.

    An adult would hopefully leave, either immediately or by constructing an escape plan. The stepmother was enabling Jeff's abuse of the kids by not reporting him. She was a victim of Jeff as well, though.

    He stood no chance in juvenile prison either. Most people do not understand that the same bad things that happen in adult male prisons also happen in juvenile male prisons. After ten years in prison, from such a young age, chances are that his mental damage is now irreversible and permanant. If he turns out to be a monster, only the legal system can be blamed.

    This is the firsst of your videos that has made me cry and made it very hard to finish. I am heartbroken for this boy, the shit family that stood to give him no chance at life, cps that repeatedly failed him and the justice system that allowed this young CHILD with disabilities to wave his Miranda rights. Heartbroken for this kid. This one hit me heard 😭

    I've been watching your videos for years and this is the first time I've taken the time to comment. I was in tears for this boy by the time the video was over. I have never felt this sorrow for anyone in your videos before and just wanted to comment that this poor child never stood a chance with the "parents" he had or the system for failing him the way they did. Grandma should be ashamed of herself too! I pray this child finds love and peace one day! This is just another example of what years of abuse can do to a child and my heart goes out to him. Absolutely no sympathy to the "parents" at all but all the sympathy in the world to this poor kid who got stuck with them!

    Unbelievable !… This poor little boy charged with murder … when his dad displayed to him nothing BUT violence his entire life .. Then threatened to burn down the house while he slept … wtf ?… The fear alone, added to the mind and maturity of probably a 6- 8 yr old … And him thinking he was just going to teach him a lesson fully believing he was just punishing him not losing him permanently… How on earth can that jury sleep at night with the weight of that conviction on their conscience ?… I feel so sad for that little boy … In his absolute fear and obvious ignorance as to how his actions would take his dad forever it just isn’t fair to punish him so harshly … It was his own father who put this fear in him and who instilled nothing but violence and retribution to him his whole life kind of got what he asked for I think .. Had he been raised in a loving compassionate home where kindness and thoughtfulness toward others was instilled … you can bet that man would still be alive today .. He wouldn’t have even thought to reach for a gun otherwise …🙏🏼😭 … I just hope he is able to overcome this deep rooted hatred his father modeled for him and come out a good man …
