MANILA - Is Senator Grace Poe Filipino? Attorney Katrina Legarda, a law professor and consultant on children's issues, said the case of a foundling after World War II supports Poe's claim that she is a natural born Filipino.

    I DONT REALLY UNDERSTAND WHY THEY MADE IT A BIG ISSUE FOR CITIZENSHIP OF GRACE POE SHE IS A REAL FILIPINO AND IT WAS PROVEN SHE WAS FOUND IN THE CHURCH OF JARO ILOILO WHEN SHE WAS NEW BORN.     Hindi mo talaga maiintidihan kung Hindi mo alam ang batas ng pilipinas. Any foundling who's parents are unknown is not considered natural born citizens. Being a natural born Filipino citizen is a requirement to run for president. Grace Poe is a Filipino citizen but not a natural born citizen.

    +Reborn Onfire your statement is totally irrelevant to the topic. MDS almost flunked the BAR, yes, but was elected as a judge of the International Criminal Court. i don't think most BAR topnotchers would have achieved as much.

    She has dual citizenship, Filipino american BUT the issue is whether or not she's a natural born or just a naturalise born. Poe's not a natural born Filipino, she's just a naturalise born. Hindi siya pwede tumakbo dahil hindi siya natural born. She might be a Filipino citizen because she's born in the Philippines but she's not a natural born Filipino thereby disqualifying her from running for president.

    The Philippines adopts the principle of jus sanguinis not jus soli. Thus, natural-born citizenship is not acquired from the fact of being born in the Philippines alone, unlike in the US. Grace Poe must be able to show that either biological parent is a Filipino for her to be a natural-born Filipino. Being natural-born is a constitutional requirement for one to be eligible to run for the presidency. The Constitution --the fundamental law of the land to which all other laws must conform. The law is harsh indeed, but it is the law.

    +crewcutter2030 I assume you are referring to the case of Fornier v. COMELEC where the natural-born citizenship of FPJ was upheld by the Court. The facts of this case are far different from the facts attending the case of Grace Poe. In Fornier v. COMELEC, the Filipino citizenship of Lorenzo Pou, grandfather of FPJ, extended to his son Allan F. Poe, the father of FPJ. Thus, making FPJ, under the 1935 Constitution, a natural-born Filipino. In the case of Grace Poe, herself being a foundling, her biological parents are unknown. That is why it is unclear whether her mother or father or both her parents are Filipino or not. Until such fact is clear, she is a Filipino but not a natural-born Filipino. That disqualifies her from running for the Presidency and continuing to hold her position as a Senator.

    This brought back years ago,, a Filipina who give birth to aBRITISH AIRWAYS ENROUTE TO HONGKONG but it didnt say if the birthing was already at the Hongkong territory, upon touchdown she and her baby were brought to Queen Elizabeth Hospital here in HongKong

    To reacquire Philippine citizenship, one has to take an oath of allegiance to the Philippines and the text of oath does not include renunciation of foreign citizenship. One does not take an oath and say I am a filipino citizen and then automatically reacquired Philippine citizenship and renounced foreign citizenship!

    Unless the definition of natural-born is changed, Grace as president is unconstitutional. I am not anti-Grace since I like how she speaks, but this issue really shed some light about her character. I am sorry to say that she is going to be like Cory who will use Malacanang as OJT. Her advisers will rule and not her. I regretted voting for Cory before so I won't make the same mistake again. I will vote MDS. She knows the constitution. Grace's supporters keep saying natatakot daw ang mga tao kasi baka manalo. Yes, I do fear it because look at what happened during Cory's reign. Look at what happened during Noynoy's term. Noynoy also has no track record. Well, there will be a constitutional crisis if Grace wins the presidency. And if she does win, I am not to blame. HIndi totoo na dapat maiba naman ang iboto para may pagbabago kasi kung walang alam lalo na at emergency situation na, walang mangyayari. Look at the Luneta hostage crisis and Yolanda.

    Foundling cannot be used anymore because she had renounced already. Is she is under of foundling law and there are natural-born citizen's issues with works like Atty. Legarda said that cannot be accepted if not natural-born citizen, so what more if renounced? Then regain again?

    Plus the 1987 Constitution states in the Citizenship that natural-born citizens deemed if the mother of the child is born before 1973 and has Philippine elect of Philippine citizenship. There is no other rule to say, because if we apply the international law here of citizenship, the foundling citizenship, it really breaks the rule in our current constitution. So we cannot accept the foundling as a prime rule or supremacy rule over our fundamental rule of our land especially it is about government officials.

    It's difficult to think these two (2) scenarios which could make Grace Poe, a foundling, as not a natural-born citizen: 1st Scenario: Two foreigners, male and female, having an unwanted child and left this child to the church of Iloilo; 2nd Scenario: The child traveled from a foreign country to the Phl and ended at the church of Iloilo. Quite impossible. It's unfair for Mrs. Poe to be labeled as NOT natural-born citizen.

    just go back to Grace history, how she end up with the POEs, napakaraming case na ganito sa pinas, at karamihan eh, nate-trace naman talaga ang pinagmulan, and with the wealth of the POEs plus the help of their many supporters, madali lang para sa kanila ito, or may be??? they really don't want the public to know her real story.

    +norms “theBigDifference” saviour Since she's a foundling circa 1968, her biological parents could be long dead. Considering (and assuming) these parents abandoned the baby in front of a church, the child was either unwanted because of personal reasons, or financial reasons. This makes it extremely difficult to trace lineage. Her 'supporters' are frantically combing her birth region for anyone who could be related to her (aunts, uncles, cousins, etc). They've tried a few DNA tests - they came up negative, thus no cigar. And since the Philippine Constitution states birth nationality is "jus sanguinis", you cannot assume that she was born of Filipino parents, as for all anyone knows, she could've been left by passing Hispanic tourists. TL;DR They've done what you're suggesting. No dice so far, and it's not that easy.

    Atty. Legarda has to slow down on her legal mantra, saying only natural born citizens are qualified to become lawyer or any profession for that matter. In 4:05 of the video, Atty. Legarda said that to become an attorney, or doctor or any profession here in the Philippines, one has to be natural born citizen. That is a total lie! Or a display of ignorance of the law, at the very least! Section 2, Rule 138 of the Rules of Court provides "Every applicant for admission as a member of the bar must be a citizen of the Philippines." It means both natural born and naturalized citizen may become a lawyer, and not exclusive only to those who are natural born. Atty. Legarda should be really careful in her legal statements because her superstar status makes her listeners or fans take her legal claims as gospel truth.

    +CHEF GERRY She is not good as Miriam Santiago. Even MDS said Grace has a problem with this issue of jus sanguinis. We can be Filipino citizens as natural born or naturalized. So as long as you are a Filipino citizen you will have the rights of the being a citizen of the PI, natural born or naturalized. They twist this fact to support Grace's claim so this is the reason, I lost a little respect for Grace, although she does speak well and calmly.

    +WHATEVER GOES FOR ME - Would you please read my comment a hundred times. I was not talking about Grace Poe. I never mentioned anything about Poe, save to point out the legal grandstanding of Atty. Legarda and her clear mistake in saying that only natural-born citizens are allowed to be a lawyer or a doctor, or journalist. What Atty. Legarda claimed was a blatant lie. She lied. As a lawyer she knows the law, and the law says that to become a lawyer, one must be a natural born citizen, or a naturalized citizen. Nowhere in there have I mentioned anything about Grace Poe. And, oh, do not be misled by my passion in culinary arts, beacuse inside that chef's toque is another graduation cap in the college of law, from which I also graduated, and supplemented at U.P. College of Law. So, when I talk about the law, I know whereof I stand.

    No matter what your parents are if you are born in the philippines then you are a "'NATURAL BORN" filipino. Same goes to the states. I have 2 NATURAL BORN American Citizen sisters born and raised by Natural Born filipino citizens but legal RESIDENTS of the city of Los Angeles. You can NEVER run for presidency ACCORDING TO THE CONSTITUTION if you are not A NATURAL BORN FILIPINO CITIZEN. If you have doubts please look into it before you jump in the bandwagon of fools.

    I am not a Poe supporter nor any other candidates but there was a gross misinformation on how Legarda state some of the facts. Around 3:50, she mentioned that foundling has no citizen, yes that is true because we could not trace or verify the foundlings parents if one of them is a Filipino. Furthermore on her statement, "cannot be a lawyer, etc. because we have to be natural born citizen" which is a sugar coated opinion. I look into the Integrated Bar of the Philippines and PRC, the requirements of being a lawyer nor registering to become a professional requires the applicants as Filipino citizen which is different from Natural Born Citizen. You are stating a sugarcoated lie that only natural born Filipinos are allowed. Foundling will become citizens as naturalized citizens but not natural born citizen and can still become professionals because the requirements only states "Filipino citizen" without restriction. Meaning natural born or naturalized citizen could become professional. Please lang don't interpret the law that would suit your camp's need.

She uses Poe which is a trapo tactic since she rides on the popularity of her father. I used to like her but this issue really shed a light about her character.
