A truly exciting project you have going. Hope it works out as it would be a game changer. Appreciate your commitment and precautions in trying to keep this out of corporate or elitist hands.

So excited about your work!! OF COURSE you deserve to have you and your family benefit from the massive amount of effort you have expended! Only a moron would feel otherwise... Like many others I await the availability of seeds from your work.

Hey David, thanks. I've had a few "It's a plant. No one should have control over nature." type responses. That's ok. I sort of get that too.

Great video...greater commitment to something that you love to do and may someday be for the betterment of us all. Few can say that. A mutation of sometimes just one branch off of one tree or one tree in an orchard has given us Washington navel oranges or Hass avocados and others. Some a simple observation in the field and others the work of 'breeders' like yourself. Whatever the reason, thanks to you for your passion and good work and good luck.

Congrats. Looking forward to see your seeds on the market. In June 2013, the U.S. Supreme Court unanimously ruled that naturally occurring genes and genetic sequences are not patentable.

Ultimately, we'll have to see how it goes. We're working with a patent attorney versed in agriculture. I'd be interested in reading that decision if you can point me to it. I do know that major ag regularly patents cultivars of all manner of vegetables under a utility patent. Still, all I can learn helps. Thanks for commenting.

This is the first link after Googling: "Plant patents can be granted for the invention or discovery of any asexually reproduced new and distinct variety of plant. This includes cultivated sports, mutants, hybrids, and newly found seedlings, but excludes tuber-propagated plants or plants found in an uncultivated state." This is the second Google: "Plants obtained by technical processes are generally considered patentable under the law. This includes plants that have been genetically engineered or where a genetic modification (or mutation) of a plant is created by technical means."

Also, sorry for the influx of comments, but that new "Purple Tomato" Empress has been patented.

The rules are different for GMOs than for naturally evolved plants or done solely through biological methods of crossing and selection …but I am sure your lawyer will know better…

Looks like KZread does not let me post links, but you can google if you can patent genes.

I'm recording a "next grow" 2nd generation project video right now. I'll discuss briefly the disease-resistant determinates briefly now and them much more later in the year as I show them. This video should go up in a week or so.
