Speaking from personal experience, an ectopic pregnancy is a perfect example of where a woman should be permitted and able to get an abortion prior to the point where the fetus grows so large in her fallopian tube that it explodes and she is in danger of bleeding to death very quickly. Doctors can see within an ultrasound or other tests that the fetus is growing in the tube and not implanting in the uterus. But if the law says she can only have an abortion abortion if her life is threatened, then that law will require her to wait a matter of weeks perhapsand go through a great deal of pain before that tube bursts and her life is in danger in a matter of minutes to an hour from loss of blood.

It is absolutely insane what women/families are having to go through all because Republicans and the Supreme court felt that the government should make these medical decisions rather than a women and her doctors.

Alito is demonstrating his total ignorance of medicine. If the fetus is sufficiently developed to survive outside the womb, and the pregnancy is threatening the health/life of the woman, they induce labor and the newborn goes to the NICU for treatment. If the fetus is not sufficiently developed to survive, and the woman's health/life is threatened, then yeah, she's going to have to have an abortion to keep her alive and perhaps able to try again. This happens all the time. But Alito's so ignorant he just wants to try to find some legal hairsplitting to outlaw abortion under all circumstances.

This is the typical problem with the complete and utter antithetical argument that Alito makes. He assumes, the ability of the medical doctor to make a decision that he himself is unable to make but only argues chicken and egg law circles. Alito, alone, shows in his argument that fallacy of his stance. How can a doctor make a judgment when the supreme justice of the nation cannot decide who has priority. The alive woman citizen is in every single case the primary and uttermost holder of ALL rights to life. There can be no doubt that any decision no matter how small or faulty that saves the alive citizen's life is just. It is without any recourse or of any issue of any other action by a medical team. The medical team in a decision here is considered totally infallible and can never be questioned or otherwise legally doubted. Stop Legal Mobo Jumbo and side stepping the protection of the alive woman!

Might as well call the fetus an "unborn adult."

Alito's proposition is absurd. If the woman dies because the doctor cannot safely decide whether the the mother's life is of greater legal "worth" than that of the foetus, then the foetus will die anyway. How does Alito suggest the foetus be kept viable after the mother dies?

Im pro choice. All day long. I don’t think Government should be the entity that decides when abortion is appropriate? A woman and her doctor should be the decider. However, if a mother is severely injured in a car crash and dies, a developed fetus can and often does survive and can be born. So, an unborn child can come out of a DEAD woman. Also….what is a woman? That’s a sanity test.

I believe the choices need to be given to the women and their loved ones. If the mother dies with 4 living children who chooses? A doctor takes care of the family health not the laws.

Alito should be removed. This should be an option. The Supreme Court is the only government entity without any checks and balances imposed from without. As we can clearly see from the likes of Alito and Thomas, this needs to change.

Considering that Alito cited an 18th or 17th "witch" killer when overturning Roe v Wade, and considering witches were said to prove their innocence by actually dying, the Idaho law is fitting. If the woman truly needs an abortion to save her life, she can prove it by dying. (Oh and check out the propublica article on idaho: they even refused a federal grant to study why matetnal mortality)

I think he follows: it's just that he has an absurd position and CAN'T acknowledge it. "Sending it to the states" was supposedly going to be so great for the country -- yet, each of these ridiculous state laws is showing how flawed sending it to the states was. The same thing happened with the Voting Rights Act. They voted that racism was over and that provisions of the Voting Rights Act were no longer necessary. What followed was chaos, with (Southern) states rushing to gerrymander and set up restrictive laws to disenfranchise black people. They will never admit that they were wrong: they'll just pretend they don't see all the problems their rulings have caused.

Not all pregnancies can or should be saved. Until a state takes over the care of an unwanted child and supports them until they're independent; then the court/state has no jurisdiction over legislating women's healthcare. Not all abortions are for birth control...a woman's health and mental status are relevant also. Alito, like most men, don't know how women's bodies or healthcare needs are relevant to their laws. Makes me feel like men dont care if women die or suffer horrific results. Even cattle can get vet care if they have a crisis in health while pregnant.

Even though a fetus has a heart beat it doesn't have brain activity and thoughts? If a person gets into a accident and the heart is still beating but there is no brain activity or thoughts the family has the right to pull the plug on that person. Thats their right no matter how hard it would be.

Samuel Alito seems to think that he is a Supreme Being, rather than a member of the Supreme Court. He is a woeful person to have such power.

Well done Ms. Prelogar! You represented women well. You didn’t get distracted by erroneous statements made by the judge, and kept the conversation on track. The idea that doctors aren’t allowed to save the woman’s life and/or health during pregnancy is a draconian interpretation of the law and unacceptable.

This is absolutely unbelievable. I cannot believe, in 2024, women STILL have to fight for basic medical care/rights. Religion doesn't get to decide what I do with my body and what's inside it.

Why is that an argument? That's extremely sexist and shows your misandry. You don't have to be a woman to know what pregnancy is in a theoretical sense. And you don't have to have had an abortion to know it's murder. Were the male judges in 1973 who ruled in favour of abortion qualified to do so? Be consistent. Any law that calls a fetus an "unborn child" is doing so based on religious grounds and violates the establishment clause which prohibits making laws that favor a religion.

While most good people can agree on common-sense time restrictions on abortion, the Supreme Court appears mostly divided along the two extremes of the debate.

It is abysmally and painfully obvious that Alito thinks he has enough medical "knowledge" to adjudicate medical scenarios legally. I would love to see him argue this with a trained medical obstetrician.

The Solicitor General did an outstanding job making the case.

What does an old man know about pregnancy. During my 8th month, I started spotting blood. I was hospitalized in the base hospital on Nellis AFB Las Vegas. When I went to the bathroom, my water broke, and it was 7 weeks early. The Base Hospital was not set up for premeture babies. I was transferred to a downtown hospital and placed under a neonatal specialist. My son was breech and had not decided on the birth canal. He was at risk of infection and they worried that his lungs were not developed enough for him to breathe on his own. I was at risk for infection because of my son. For five days I was pumped full of steroids to mature my sons lungs. I had a C section. We were lucky there were babies in the NICU that had not been so lucky. And mothers who had not been. Men should not have a say in situations that they can't be exposed to themselves.

The living breathing women's life and health is more important than a fetus that may or may not become a baby. If mother and fetus were both healthy she wouldn't be there at the hospital in first place.

All courts should be televised.

Alito got caught in a freak storm and travelled from medieval times.

Again, "unborn child" is a euphemism for a fetus -- and in some cases only a blastocyst -- that supposedly has rights over the body of the person carrying it. It's absurd -- because no person who is born has such rights.

It's actually so embarrassing to hear this line of argumentation from Alito. Not only is he absolutely clueless about the medical intricacies of this problem, but he's also clearly misinterpreting the intention of the statute discussed, either deliberately or ignorantly. Either way, it's not a good look for a justice of the highest court in the land.

There will be a lot of unnecessary deaths, suffering, and heartaches, allowing the government to decide every detail regarding medical decisions. This will consume the Supreme Court's time for many years.
