He wasn't banned for long. Although the FIA did ban him, Briatore took them to court in 2009, and the french courts overturned the ban in early 2010. The FIA was going to appeal, but ultimately the matter was settled out of court. Technically he's been free to return to F1 for over a decade, however at the time he did state that he was unlikely to come back to F1.

I think in last 25 years there were probably 50 taletend drivers like Ocon, do I agree that there is nothing special in him. And even a much more talented Montoya had no bigger chance in F1 with such treating a team mates.
