However, the more significant challenge with hiring immigrant workers is that there is a high probability that they have a bachelor's degree from a non-US university, which is where the problems arise.
USCIS's definition of beneficiary qualification is based on the US university system, so there is always a chance of receiving an H-1B RFE when you have filed a petition for a beneficiary whose bachelor's degree is from a university or college outside the US.
