Under CrPC 1973, a muslim father is bound to maintain his legitimate or illegitimate children, till he or she attains the age of majority or if the adult illegitimate or legitimate child is not able to maintain him or herself or if the same child is suffering from infirmity

If illegitimate child of the father then the maintenance will be enforced on his father and illegitimate child of any other person then obligation comes on orphan.

In case of lilligetimate child, according to muslim law mother will be considered as guardian

Muslim law also does not provide for the guardianship of illegitimate children, but, it seems, in modern India, by judicial legislation, it has come to be established that guardianship Of an illegitimate child vests in its mother. I think it might be the answer but as the google says illegitimate children are considered as a child of nobody

4:45 Shia Law me koi guardian nahi hota illegitimate bache ka par sunni law me Mother hee Guardian hoti hai kyu ki sunni law ke hisaab se Maternity ek Fact hai. Sunni law k hisaab se bache ko bas Maa ki property hee milegi.

Muslim law doesn’t recognise an illegitimate child but upto the age of 7 years it will be the duty of mother to maintain the child. After that child is free to chose that he wants to live with father pr mother.

Islam does not recognise adoption. In Mohammed Allahabad Khan v. Mohammad Ismail it was held that there is nothing in the Mohammedan Law similar to adoption as recognized in the Hindu System. However an adoption can take place from an orphanage by obtaining permission from the court under Guardians and Wards Act,1890. Whenever their is conflict between provisions of Muslim Law & Guardians and Wards Act,1890; Guardians and Wards Act,1890 shall be applicable. So, Yes, she can Adopt by Court.

Muhammad Rasool had married his daughter-in-law (wife of his adopted son) and so to justify his mean deed , one verse got revealed dictating Muslims that adoption is Haram in Islam.

Agar bacche ko apne real father ke sath nahi rehna hai tab reh sakta hai because sabse upr child ka welfare hoti or consent hoti hai (Exceptional case me valid hoga)

Sir there is no guardian of illegitimate children in case of Muslim law they are called the child of no one therefore does not have rights of guardianship of a father only custody of the mother..😔 unfortunately.
