I have had smartphones since iPhone 1 and other phones were text capable for years before that. Not a single time have I lost a phone, broke a phone or deleted a text message chain! We’re talking DECADES.

I have lost the content of my phone once. This was in either 2010 or 2011, within a year of getting my first cell phone. I lent my phone to my sister. I forget why she needed to borrow it, but she dropped it in the toilet and I was able to save the sim card, but nothing else. Everything was on the phone itself, so I lost all phone numbers I had on there and anything else they may or may not have been. I still have the phone I replaced that one with. It can’t make phone calls (because it’s a 3G phone) and I haven’t charged it in a while, but I still have it specifically so that I can access the text messages on it if I want to. I also still have the trash phone my phone company replaced that one with specifically so I can access text messages on there. And I don’t delete text messages on my current phone unless they are spam calls or for Richard . . . whoever Richard is (I have been getting occasional calls and text messages for him for thirteen years so I assume he either had my number before me or his number is a digit off of mine).

If the defendant has actual cell service she can pull up her records to show his incoming texts, not the message but the ph number. But she’s probably lying.
