That would only be the case of earth shifted more than a couple of degrees, and it doesn’t? So the axial tilt wouldn’t be enough to change it that severely. Between 22.1° and 24.5°. So only a couple of percent. The earth hasn’t moved 22° from the plane since the moon formed; which is waaay before life formed
