George Building Collapse | 'Employer is liable for injury on duty even if worker isn't documented'
Deputy International Relations Minister Alvin Botes has appealed for financial assistance to help repatriate the bodies of foreign nationals who have sadly died in the George building collapse.
Representatives from the high commission of Zimbabwe and Malawi are also in George to meet with family members of the victims and oversee the repatriation process. According to Botes, repatriation is not covered by consular support services offered by DIRCO.
Let's now discuss strategies for handling the employment situation when an employee is injured while on duty. To discuss this, we are joined by Galeboe Modisapodi, an ER Consultant at Molatudi Attorneys and Molatudi Advisory Services.

Most construction companies hire undocumented workers who cross our border illegally
The Construction Regulations require the primary contractors to control access to the site. Sub-contactors sign S37.2 mandatory agreements regarding issues like COIDA. If foreign nationals are not specifically excluded (like in the UIA) then they have the same rights as SA citizens once in employment. The law being broken by the hiring of undocumented workers is the Employment Services Act. THESE LABOUR EXPERTS ARENT REALLY ALL THAT EXPERT!

Does anybody still have confidence that there was only 81 people on site, at the time of the collapse?
That's why it's very important to go to a country legally...for your own rights. Also in this case how are anyone accounted for in the country in case of emergency like this....example for finger prints, pensions, and tax purposes....

People employ foreigners because they are often educated, work well without supervision and are generally have a great work ethic. Nothing to do with lower salaries. Small business's generally find foreigners more reliable.

I have such problems with the above statement, the statement implies that south Africans do not posses the same qualifications or qualities. The difference with South Africans is that they ask questions and report issues to the department of labour. Foreign nationals don't because they fear deportation as a result of being in the country illegally. But this situation has played out in such that Employers will now learn. It's really sad because now the Foreign nationals family's are scared to come forward and identify their family members because they also fear deportation. But we all act surprised when unemployed south Africans raise these matters. And where are those Employers now who prefer Foreign nationals...I don't see them anywhere

Day labours for the day do not always have documents
Let this be a lesson to South African government. What happened to real Labour inspectors, whose duty was to oversee to such,thereby minimaxing such disasters. My condolences to all the families. South Africa, has indeed turned into a "real" piece of Work. Let's take a page from the book of Ibrahim Treore.
Operating any business in accordance with the Regulations = Bankruptcy. Competition is extreme, work is scarce, costs are through the roof. Are the Kleva gubbermunt commentators prepared to pay R500 per sqmr for tiling?

But they can't claim from the COIDA coz are not covered since we're illegal and the employer didn't sign the insurance documents for them.
So the employer is liable, but the government is not liable for those workers being in our country. The government should take responsipility for keeping them out of our country. Why are you talk about the employers responsibility while you are not taking responsibility for keeping them out. Hypocrites!

The employees themselves must assume responsibility, they know very well that they are undocumented. They were happy to work, and take the pay cheque. taking the opportunity away from documented foreign nationals or South Africans. They assumed the risk.

If you choose to employ undocumented workers so you can scimp on wages and they are injured on duty , I do believe you are liable for their salaries until the are back on their feet. That includes any long term disability payments aswell. Lets make sure the law works.
