I don't think a game theory video would count as evidence, because it's an analysis of Bluehole's claim against Epic Games- if you're using sarcasm or are making a joke, then I apologize. But I do wonder what kind of things would qualify as evidence in a lawsuit like this. I'm a bit more familiar with evidence in criminal law than I am with evidence in civil law.

Personally I support PUBG, for the sole reason that I can't look at any social media without being bombarded with posts about Fortnite. It has transformed KZread into one huge clusterf#$k of people making videos of Fortnite to get views and those sweet, sweet v-bucks (see what I did there). With only two combatants, it would be better to pit them against each other in a holmgang. Sort of like a duel, except you're confined to a very small island, that shrinks as the tide comes in, or a small ring the combatants must stay inside. The victory, defeat and forfeiture conditions are agreed upon beforehand. Not showing up has consequences. In the case of PUBG vs Fortnite: PUBG claims Fortnite has "stolen" their idea, and challenges them to a duel. If Fortnite does not show up, PUBG wins by default, because Fortnite doesn't defend it's claim that they didn't steal the idea, and PUBG is declared in the right. If however Fortnite shows up and PUBG chickens out, PUBG is seen as having NO honor, they will be declared a niding, a really despicable person, essentially a villain. If they both show up and have an honorable duel, whoever wins, according to the rules agreed upon earlier, is in the right. Either Fortnite stole the idea, or they didn't. The only exact rules I could find was regarding an insult of honor, and seemingly assumed a battle to the death, and they stated that if the insulted loses, in this case Fortnite, half the value of Fortnite is to be returned to Epicgames. If the insulted wins, the loser is greatly dishonored, and of course, nothing of the value of PUBG is returned to Bluehole, as they made a false claim. Of course, this is unrealistic today, but the terms of the duel wasn't set in stone for every holmgang, so I'm sure something could be figured out.

You have many great points. One thing now is that fortnite had suddenly had "simular" ideas to pubg with guns and vehicle wraps while pubg had skins for way longer. Another thins is that pubg has always had vehicles while fortnite never did.

The ads I got at the very beginning and very end of the video were an ad for PUBG things in the beginning and an ad for Fortnite things in the end...

Battle Royale has a vary strong understanding that they normally have a shrinking zone like a platformer has jumping in it. Thanks to Catness. Every battle Royale is based on that movie so bits from that movie would be implied as it is natural to see in a battle Royale type of game. Jumping out of something wouldn't be based on that movie and one can argue that is their expression.

The biggest reason Epic Games is at fault for the Battle Royal mode in Fortnite is a little deeper than "Fortnite copied PubG!" Bluehole purchased the license to use the Unreal engine from Epic Games, and as a part of that purchase, Epic Games assisted Bluehole to get PubG working properly. That is where Epic Games first got the idea for implementing Battle Royal into Fortnite. Well, in the contract, Epic Games was not suppose to make anything that would compete with the game they helped Bluehole on, such as PubG. Usually, I'm against the company making the copyright claim because they are so commonly overreaching. With the Fortnite Vs PubG case, there is a lot more than beats the eye. Fortnite was not only a fairly close copy, but also released during PubG's sweet period to compete with PubG, harming the sales of a company Epic Games was contracted with.

or, Or, OR, You just don't play the game that you don't support. I don't play either because I don't support battle royal genre - it's not my cup of tea. However, I do understand the case that pubg brings to the table. If Fortnight wins it will set a precedent that will allow games to copy each other; however, if Pubg wins it could spiral out of control with the ability to copyright entire genres. I feel this is going to have a huge impact on the gaming community stretching further than the battle royal genre.
