Thank you for a very informative video. I filed I-130 in 2005 for my sister. She is waiting for an interview date. All documents have been submitted and fees have been paid. Hi! Thanks for commenting. In the U.S. Most people choose their parents' address, however ny close relative or friends address where they can reliably send mail is a good option

If an applicant has had a family petition submitted prior to their current one, then they have had a petition submitted.

1. One 130a for every beneficiary and just 1 for the sponsor 2. Each beneficiary must fill out their own I-130a 3. If the beneficiary is unable to sign at the time of submission, they will be able to sign at the time of interview at the consulate.

I am trying to file the I-130 and I-130A for spouse that is overseas. I have evidence to prove marriage, such as photos, chats, etc. (Being that she is overseas, its impossible to put her name on a lease, or get a bank account together. Or for that matter, travel without a lot of hassle and added expenses) I do have my birth certificate, passport, marriage certificate and copy of the plane tickets. As well as affadavit from family. What other government forms need to be submitted with it? We plan to submit everything online. Just want to get this first crucial part started. She is not in the USA. So we are not filing adjustment of status yet. Should I file other forms with it...? If it would expedite things...

During the NVC process, 6-12 months after an applicant files the I-130s, the NVC will ask the applicants to submit an I-864 alongside their joint sponsor's I-864.

Thank you for the information. I have a question, which I cannot find anywhere. I hope you can help me. I am a US citizen and I filed I-130 online for my sister on February, now I want to file for my brother. However, the questions A-number and Account Number make it difficult... For my sister I didn't filled these 2 fields, but after the status became reviewed, it says I have A-number while entering the dates for my brother. Also, it says "if you need to apply for a benefit for someone else using the A-number you entered, you should sign out of this account and create a new account for them", however while I enter A-number, it allows me to continue. Now I wonder if I can use the same account for my brother I created for my sister. Or do I have to create a new one? Also the operators say that A-number and Account number are the same, however in the application it says they are different. so, they are the same or different?

Yes, one is needed if the applicant is doing adjustment of status. If the applicant is doing consular, it will be needed during the NVC stage.

This will depend on your application type, an adjustment of status applicant will differ from an asylum applicant. You can take a look at processing times on the USCIS website.

Currently it's only allowed to file the I-130 online. How will the petitioner sign in INK then?

If the beneficiary is married to a US Citizen and entered on a valid visa they may be eligible to adjust (even with a valid I-130 pending).

If you are still waiting for your spouse's visa to be processed when you receive your naturalization certificate, send the National Visa Center a letter stating that you have naturalized and that your I-130 petition is no longer subject to the yearly cap. Along with your letter, make sure to include a copy of your I-130 receipt notice (Form I-797C, Notice of Action) and a copy of your naturalization certificate. At this time F2A applications are being processed faster than CR1.

Generally it can take 12-24 months for a case to be approved from start to finish.

Yes, so long as the beneficiary has tourist intent. There may be more scrutiny at the border.

Applicants are able to travel on a visiting visa, but are only allowed to remain if a valid visa is granted.

Hi! I'm filing I-130 for my parents and in Part 4 (Information About Beneficiary), there is a question about "Was the beneficiary EVER in the United States?". Does this include traveling to the US with a TOURIST visa? Because in this section it's asking about I-94 or I-95 in addition to passport/traveling document information. Generally, most nonimmigrant visas are denied if the applicant has applied for a family petition. As they have shown immigrant intent.

This will depend, if the applicant is applying from outside the country it is just the I-130. If they are in the United States it is the I-485 and the I-130.
