This is just part of the problem. People using 911 to do harm on an innocent person. Lies over lies in addition with cops and there easily bruised egos get people killed or thrown in jail. I will admit that the 1st cop on the scene handled it well. There needs to be repercussion against people who abuse 911. We have laws on the books. Who will enforce them? Cops, DA's, Judges??? The system is broken. It is unfortunate that this business owner did not know the law, but the woman who called 911 and flat out LIED, should be prosecuted. In ATA's words, "she gets an F"

The Karen needs prosecuted. She told the dispatcher, rather rudely, the gun was in his bag, then told the officer she "thought it was in his back pocket." She's clearly lying. People take the ride for far less.

i don't know if there was a past encounter with law enforcement with the dude recording but it sounds like they are familiar with that particular individual from him recording their station and have probably put out a internal statement saying know off the top of your head 1 2 and 3 in case you have an interaction with someone like this again so we dont have any more issues. on the other hand they did act professional and most of not all knew everything they needed to anyways. I'm going to be working as armed security on a government installation here within the next few months for a contracting agency and these videos help refresh on things that would most definitely help with different encounters ill probably come across.

That’s the thing with these type of videos. If the Karen or Daren just ignored the camera they would end up in a video called “Mulberry Wisconsin post office audit, 12/13/2020” that gets like 1.2k views and they would be in the background, but instead they choose to flip out and call the cops and they end up in something called “crazy Karen attacks me for my first amendment, right” that gets like 4 million views and they are the main focus. I don’t understand why they get so mad at the camera it just doesn’t make sense to me

​@@Real_Moon-Moon In my opinion calling and saying that someone has a gun is priming the cops for danger. It's like putting the alarm in their heads "Danger! Danger! You might get shot! Someone might get shot! He has a gun! Danger!" and then it isn't even about how the guy behaves when they get there, it's about how his behaviour is perceived! To make matters worse, the person being accused of this doesn't know about this. If You know that the police is coming and they are going to suspect that You have a gun then You'd probably keep your hands in a position that is clearly visible, but if You don't know then it increases the risk that your movement might be misread as reaching for the gun.

Cop: "Did you throw his camera?" Owner: "He was antagonizing me." Cop: "What was he saying?" Owner: "He refused to say anything"

but I think in all the recordings we heard she would always add "I believe" "I think" "It looks like". So, it's hard to probably convict if someone never said it directly. The same the video author says when police starts qeuestioning her. While it's annoying and pretty clear she did that on purpose, it's hard to prove. Exactly how owner was annoyed that someone is filming, and the filmers usually are doing that to get a reaction to make sure no one will challenge. But by the rules it's ok. So, her call is annoying, but based on rules probably is also fine to do dispite being annoying as filmers are annoying to people who they end up filming.

@@DisplayDefenders if someone says "I believe" and "I think" they imply that it's not 100% certainty. While we know she's lying, it's hard to prove in court. You even use the word "she heavily implied" which just another way of saying that she said he has a gun without actually saying it. Thus, how are you going to convict her? Changing the story I've explained, she can say she saw him to put something in the bag. For example, he took of his phone to put on the mount instead of broken camera, and she can claim she thought he put it into the bag.

The lady who called knew exactly what she was doing by making it sound like a security threat, using urgency in her tone, bringing in children & school, finally, abruptly disconnecting the call saying "I've gotta go" couple of times, to project that she was afraid for her safety & others, while standing there nonchalantly, possibly enjoying her little performance, all the while knowing there wasn't any gun involved. She should've been prosecuted.

the cops didn’t know the full story, she said what she thought it was from her point of view and from her experience but he didn’t tell them that he was just doing an IRL livestream hopefully when this case gets out there they will learn that this was just a civil case of a random “ suspicious “ guy was live-streaming himself going on a walk and he happened to see interesting cranes and he decided to show his viewers which then turned into a violent confrontation from a business owner who accused him of recording little kids and calling him a pedophile and spreading false reports just to twist the narrative of the fact that he was just doing an IRL stream, this could’ve been avoided but it wasn’t. ( i am using your number of likes to spread my opinion on what happened when the police woman accused the man of being a 1st amendment auditor I just copied and pasted what I said didn’t feel like rephrasing )

Almost everything. There were a few small but important actions taken by police that did NOT have to be. The frisk was NOT necessary due to the obvious lack of suspicious activity of the auditor. A couple of officers on scene actually berated the auditor saying he was 'trying to get under people's skin'. That was uncalled for and VERY unprofessional. His personal opinions should have been kept to himself. People's motives for their actions, if the actions are not illegal, are none of his business. The officers should have ARRESTED the woman for making a false report to 911, AND lying in such a way as to put the auditor's life in danger.

The cop even said I can see that you aren't a danger but this is just to he sure because of the call we got. As for the things the officer said about getting under people skin usually is 100% correct, and the police have freedom of speech just like we do. They don't lose those rights when they become police.

@J F. Fact is we have no idea if he filmed kids. I would suspect that he did record the kids but it was intended. The business owner 100% at fault. That being said I have no respect for the guy recording as he is out looking for this kind of interaction. when there is a response the guy recording could respectfully answer the questions and just move away. When they don't and focus all cameras on the business owner and even approach closer that is enough to know you are only there for YT cred. Most of the time nothing happens and the recordings are not worth posting.

So what if he filmed kids, the school lets them be seen from public, they must not have an issue with it. I mean what did they think he was going to see if he did film kids? People have those brain fart on kids being filmed. Kid comes up and throws rocks on your windscreen, your dash cam records him, OMG what a criminal you are filming that kid!

That female employee should’ve been arrested. There is no way she could’ve even seen if that man had a gun from the distance. It is clear and I believe a reasonable jury would conclude that she lied about the gun to get a response. The business owner should’ve been arrested for assault as well if the auditor would’ve supported it.

The Police were being highly one sided against the citizen. Good job to SLO for being the only one there in control of himself. I would call the business owner a jerk or worse ( only in keeping with LL request to “be nice”). Good job to the LEOs for putting him in his place.

I think the issue is that she said the right things when talking to the officer after the fact in a way that it's tough to disprove. "I saw something that I thought was a gun" is plausible. It seems really unlikely and is almost certainly a lie, but you can't PROVE that she didn't legitimately think there was a gun, which would make prosecuting her very, very difficult.

The officer that said "cause this is ridiculous" just made my day.

These police officers knowing the laws and peoples rights AND uphold them is nice to see. Other police departments, take notes. When the police went in and lost their sh*t with the people in the building, I side with the police on this one. Great job, officers. You are a shining star in a dying world. Edit: This is why I am not a police officer. I do not believe I could have stayed calm after having a response that big. I would have arrested the woman who kept going outside. She could have gotten that gentleman killed. To me, this is on the same level and just as serious as swatting someone. Very dangerous for all involved!

These criminals should be fined and jailed for; -assault; -Falsifying testimony of a crime; -Wasting time and resources for an incorrect allegation; -Potential harm of civilians due to the false allegations. I hope their business fails and end up on the street. Also I’m super proud of the cops defending the guy who was assaulted.

Well I agree and disagree, Silva did say SLO was trying to get under their skin, when there was no proof of that what so ever. Meaning in his mind that what auditors do Then back tracks, I don't know if that was what he was doing.

After having watched a bunch of videos i've noticed that some auditors are just nice guys that go around with their cameras and they are polite with officers even when those officers are extremely aggressive BUT there are other auditors that are pretty aggressive even in some situations where they are not correct about some law.

He also said he was there to get under peoples skins and that unintentionally he was putting this whole situation still on the auditor in a sense of he said this is all happining cuz of the guy trying to get a reaction... after the cop searched his property illegally and detained him in cuffs ( arrested ) , then did the cop see there was no gun and his frustrations was then turned onto the woman that false called, and yet he did not charge her. Even tho sheeeee was the only one on scene that broke the law. . but in a sense he was still blaming the camara guy for the whole situation by saying he is trying to get under ur skin, and to look at the response he got so it worked... cop did not charge her for false calling in a deadly weapon, and still blamed the camara guy in the end.. They still showed up and unlawfully searched a man on the side walk put him in cuffs and then still blamed the camara man in the end for causing this for GETTING UNDER THIER SKIN apparently, but failed to do his job when the lady false called this in.. This cop and situation was nothing of a fresh air , they showed up violated a mans rights for no good cause, and then failed to issue a charge to the lying lady... all in all its a fail.. the only tjing thst was a fresh of air was seeing a bs call like this come in and they dident MANHANDLE him first then do as they just did afterwards, thats the only ok good that they did was not fk him up right off the back, but what they did do right off the back was detain him in cuffs and serach a man illegally.. so no this is a str8 bullshit fail on everyone there but the guy standing there minding his own ..

@@JohnnyBravo303 when did they search him? Are you referring to the legal weapons pat down? When did they cuff him? I rewatched the video. Didn't see any cuffs. The police blamed the woman for this response because otherwise just a single cop would have likely showed up...casually... And based on the police knowledge of the 1st amendment, they would have recognized what's going on explained it to the business owner and left. They very clearly communicated to the caller that this was her fault. If you can't recognize this as a win then whatever. Have your opinion. This is leaps and bounds compared to cops arresting people for exercising their rights and acting like tyrants. Saying someone is "trying to get a reaction" is way better than abusing your power to arrest someone, detain them, confiscate their property and give them fasle charges. This is a win.

Did you miss the whole section of the video where the officer chewed the store owner for letting the auditor get to him, AND where the officer got on to the female employee for hanging up on the 911 call as well as miss using the 911 system. This officer asked to frisk the auditor and also never demanded ID which is different than most encounters

Intelligent through experience not studying. It's a big difference but they did handle that well. They even said he has been auditing them before which leads to believe the superiors have had extensive talks with their officers but this is a great day to train the young ones who rode along.

Good on these police officers! They know the law and they inform this man and they don't make this situation worse but actually perform their job perfectly. This is the best video of cops I've seen lately. Gives me hope

I had an interaction with a suspicious person with a camera at work once and it went so much differently. He had parked in the lot out front a few times and never came in. Eventually, he got out of his car with his phone and appeared to be sneakily taking pictures of the store front and signage. I went out and struck up a conversation with him and it turned out he was attempting to start some sort of local business photo shoot page and was embarrassed about taking pictures of buildings which is why he kept parking and leaving. He was actually a surprisingly good photographer for how nervous he was. If I or a nearby business employee had gone out there and been aggressive then it could have turned in to a bad day for everyone. Instead, I made a new acquaintance and he took some really stylish pictures of our shop. My point is, not everyone is up to no good. The vast majority of people aren't. Some people are just awkward.

"You are not allowed privacy in public." I love the cops delivery on that line!

That is not 100% true, some cases and in situations you do indeed have a "reasonable expectation of privacy" even in public [ this case is not one of them ] BUT , yes you do . Courts have even upheld that fact in many privacy cases, but again it is conditional

Key word in the law at least the way it is written in Florida is “knowingly”. This all come down to good faith so why would any officer pursue that charge? This cop knew, almost immediately. As for the owner, a simple citation was very lenient and was a product of the original video taker's demeanor about the situation. Well done all around. From the officer who made contact, to the auditor, and even the owner who learned something that day. So many ways this could have went WILDLY different, it's scary.

Calling in police for a gun gets a very specific response. Doing that to somebody without actually thinking there is a gun and a they are a threat is absolutely akin to attempted murder.

It's working, but you can see that they still think the point is to antagonise people into making mistakes, rather than holding people accountable to the law while doing something you're well within your rights to do. They act friendly with him, but it's only because he lets them pat him down and look through his bag. Could have ended very differently.

I've said this in other videos, If someone points a camera at me I dance, poorly. They laugh, I laugh, and we both walk away friends. How hard is this? There are at least two videos out there of me doing exactly this. I was in Connecticut and some guy with a camera was outside a police station. I happened by on my way to a taco place and this guy I guess thought I was going to the police station. He starts recording and I'll be honest, seemed a bit tense. I busted out with my moves and he nearly fell over laughing. That was a good day.

I had never seen... the first police officer who arrived... Excellent work and my respects for how he managed contact with the cameraman...

The Karen actually said to the dispatcher….”if the police aren’t here in XX minutes, I will be calling all of the news stations”. Sounds to me like she was pretty determined to get them there, and if it took her telling a lie to get them there, then so be it. And that’s exactly what she did. She KNEW damn well what she was doing.

Except she wasn't.... She should have been charged with reporting a false crime, but wasn't for whatever reason. I think it would have sent a more powerful message that, the police aren't your personal body guards... I swear every time I've called the non emergency line for help with bullshit going on I never get help because of fucking twats like her are tying up all the resources over absolutely fucking nothing.

Usually, I make a four letter comment about poor police work. But this was excellent police work in dealing with the cameraman. Everyone else requires the full force of the law.

Finally! Some Officers I can LOVE!!! These guys are AMAZING. This gives me hope.

Wow. I didnt think I'd ever see the day when, not just one cop, but a group of them, defend a persons right to film in public. It's really nice to see this happen. It just doesn't happen nearly enough. Great job by those San Jose Police officers!

It's also disheartening that even though these cops upheld the law and freedoms of that man there were still at least a couple of cops that I noticed who sounded disappointed that they had to do so.

That's pretty obnoxious when you're legally obligated to go through a bunch of steps to figure out what the fuck is going on so you can call in a response. And that's ignoring the mental anguish of having to even hear Karen speak, since I think that was a different operator.

As a former homeowner in SJ, I'm very proud of this measured response.

More people need to be educated like this. Kudos to the photographer for acting calmly during the entire ordeal.

It is nice to know that police departments are taking this seriously, and are educating themselves and others.

@@jamesgaughenbaugh1040 that is not how it could be done, at all. That makes no sense. All it would take to turn this video in to cop-hater bait is a different title and narrative. You'd show the complaints from the staff, remove any mention of a gun, and a little bit of footage fettling. It would not be difficult to remove the parts that side with the police. If I had all the body cam footage, phone calls etc, I could easily edit this to make the cops look bad. There is enough there to make it look like an unnecessary pile-on for a man with a camera - which obviously it was - but changing the narrative would be easy.

Man the first cop on scene did an excellent job. Absolutely incredible!

That woman that gave a false police call should be charged with a felony. That cop was great, he's what we need in our police force. The owner of that company needs to be charged with the destruction of property and made to attend a class on the bill of rights. Everyone that does business with that company should see this video. Avoid doing business with companies that think nothing of your rights. They can't be trusted as honorable.

Can't prosecute stupid and paranoid, as much as what she did could have resulted in SLO's death or serious injury and she would be culpable. Although, there could be something said for ignorance of the law isn't an excuse, on the other hand 95% of cops fail audits so... expecting anything better from a woman who watches NCIS and crime drama and CNN about school shootings, it is amazing it doesn't happen more.

I feel bad for neither the business owner, nor the lady who called the police. Ignorance is no excuse for breaking the law, and they easily could have known everything they did was illegal.

"Ignorance is no excuse for breaking the law" Its a shame that we don't have a system in place to educate those and alleviate ignorance. or a more uniform legal system US wide. ~(laws change from county to county/ from state from state. its stupid complex and diffacult to stay in compliance 100% of the time even if you are trying to do your due diligence.) or laws that are basic enough to teatch children. if lawyers have to go to school for years to understand our complex legal system then what chance does your average person have? I am not syting that you are necessarily wrong, but the system is is not correct ither, and not set up in a way to be helpful.

The business owner clearly didn't know about the 1st Amendment rights but, he absolutely knew he had no right to damage the mans property. Can you imagine his reaction if someone threw a rock through the window of his crane?? The woman absolutely knew she was making a false report and knew exactly the kind of response she would get being this close to a school. She should be prosecuted without a doubt and both she and the owner should pay damages and do community services along with a monthly probation payment.

Man it’s really refreshing to see these cops de-escalate a situation and defend the public, I expected the worst when she called in an armed person by a school but that first cop was awesome. Would like more of these lol, it’s good to see some positive things for once.

These people need to be held accountable for calling in a fake scenario. Accusing a man of two disgusting crimes is disturbing there almost as bad as the people who do those actually crimes.

It would have been outstanding police work had they arrested the real criminals - the guy who assaulted and broke auditors camera and the Karen who falsified a report and lied to get auditor killed because she didn't get her way. Paving the way for anyone to call the police and lie to get anyone they don't like killed. It could be you next time.

It's nice to finally see a professional and respectful response to the call from the cops. That lady should have been arrested for calling in a false report. She never went outside and couldn't have possibly seen a gun from that distance. That's how people get killed

Kudos to all the other police personal , but this female cops personal injected opinion was aimed at defaming the cameraman which is none of her business . I was going to comment saying that as much as the officers mention him, it would seem like their handling of the situation was largely due to his previous auditing activities.

Those shootings would have been stopped immediately had there been a good man or woman armed and willing to protect innocence...plain and simple

These cops are awesome. They approached the scene in a calm way and didn’t accidentally shoot an innocent man being wrongfully accused of currying a gun across from a school. Props to them. And props to the gentleman for calmly standing his ground with his camera, even though he was being attacked.
