    I was approved for SSDI after 4 years of fighting. My Attorney received 7200 from my backpay which was to be expected. When it came time to have my dependant added to start receiving benefits from my record, the Attorney told me I had to do this on my own, which I did and it took 2 months more, however SSA paid my Attorney an additional 6000 as a Representative Payee on behalf of my dependant. I had to file as my dependants Representative so my question is.. Is it expectedbfor the Attorney to be paid from both?

    That's kind of strange. I know attorneys can make all kinds of strange arrangements, but I've never heard of one charging for a dependent.

I’m planning to retire @ 62 very soon, I have a very young wife & two minor kids, If my wife, not retired, living in the same household is working … does the earnings limit affect her or does her income make my minor kids ineligible?

    I have been the court appointed permenant guardian of 3 of my grand kids more than 12 years now. They are all diagnosed various forms of behavioral health and mental disabilities and are on different parts of the autism spectrum. The kids have qualified for DDD and SED but there seems to be no assistance available. I do receive stipend from the Department of Child Services here in Arizona of $12.95 per day. The kids mom (my biological daughter) died over a year ago. I had some severe medical complications back in 2014 and did become 100% disabled so we all live off of is my disability payment. Will there be something I could apply for to help with our situation?

    I'm 61 and 8 months and I filed yesterday, I have two kids 7 and 11, I believe I will be up against the family maximum, will the payment all be in one direct deposit? Or is it somehow separated as some "you tubers" seem to indicate. One "financial planner" claimed he just found out about the dependent children payments yesterday!

    I am 62 and retiring in a month. I have 2 minor children. I was under the impression that they would each receive 50% of my PIB up to the family max. However, the social security rep told me that the child benefits would be 50% of the family max minus the PIB, substantially less. What is the correct calculation? Thank you.

    I was divorced in 2009 with two children. My ex husband became disabled that same year. I didn’t know about his disability until he told me in 2012. I got disability for the children on his record but I didn’t know about the auxiliary child in care benefits. My daughter just turned 18 in February. Is it too late to file for auxiliary child in care on my ex husband earnings?

    If i file for my SSA benefits as soon as eligible at 62 and I have kids under 18 eligible for up to 75% of my benefit as a family maximum - if I start working again, I know my benefits wife gets reduced $1 for every $2 I earn…but does this also reduce what they can get? Thx.

    Love your videos and I'm learning a lot! Question for you: My husband was just approved for SSDI due to Parkinson's. We have an adult daughter who also has a disability since birth. She was on SSI but then was able to go on SSDI because she has worked some and she qualified. Is she allowed to receive benefits from my husband's social security disability (which might be higher than what she receives now)? How does that work with the family max? Thanks!

    Hi, I'm not an expert here but I also have a child with a disability and have been researching these SSA questions too. So I'll defer to Dr. Weir when his video come out but it's my understanding your child's eligible for the higher of the 2 between your child's own SSDI and their Disabled Adult Child (DAC) benefit on your spouse's record. So just the higher, not both.

My daughter also works part time as a grocery store bagger, and I’m afraid she’s going to go past the threshold where she makes enough that she will be disqualified from other programs such as snap and Medicaid Does the SSDI DAC benefits count towards her total income for These benefits?

    Her income won't affect the children's benefits at all, but she might not be able to get child in care benefits for herself

    I am on the last 6 Months of SSDI since I have returned to work. My wife is home; we were told we were not eligible for the child care benefits because we have custody of a biological grandson, but we have not adopted him. Is this correct?

    I am 55 with a 4 year old. I am looking at retiring when I am 64 and start drawing SS. My daughter will be 13. I'll have her start drawing SS based on my FRA (so over the 6 years that's going to be a substantial amount). I understand that the monies she receives has to be put into an account "owned" by her (and I can be custodian) So that we don't get a letter when she's 18 or 19 that we owe any unspent money back to the IRS. I asked my bank if I can open such an account and they basically said no. I will always be listed as a owner along with my daughter. Here is what they said: "Your daughter would need to have a parent or legal guardian on the account with her. She can be listed as the Tax Reported Owner and you could be listed as second on the account, however, you would still be considered an owner of the account" So, if my daughter would be considered the "tax reported owner" but I am still a co-owner, would that satisfy the IRS rules so that we don't have to pay any monies back? Hope that makes sense. Thanks Mark PS has anyone every done this? Have their child draw SS before the age of 18 (or 19 if still in high school)? What kind of account were you able to get so that the IRS doesn't ask for any unspent monies to be returned.

    Thanks !! Unfortunately I was not able to join the live stream. One big question I have is this. In your experience, has the SSA ever gone back and collected unused SS benefits from children once they've turned 18? My situation: Wife and I are married, all 3 of us living together. Custodial account is setup for my child to receive benefits (so they are the owner) when I start collecting at 62 (she'll be 11). So there is no co-mingling of monies. I've read and re-read EN-05-10076 Just curious how common that is. While not required (since our child will be living with us) we still plan on keeping records of monies spent. Anything left over monthly will remain in the custodial account (savings earning interest as outlined in EN-05-10076) So I am just curious how often SSA tried to collect unused benefits. Thanks !

    Hey Mark! Your problem, I believe, is solved with an UTMA account! You can deposit your children’s funds into the account for them, but when they reach age of majority, it varies by state, the money is theirs. This is considered a safe and effective way to show the SSA that they and not the parents, have complete ownership/use of the funds. I would check it out further before committing, but I believe this IS the safe way to avoid disputes with the SSA down the road! 😉

    Thanks for the info ! After I posted this I worked with one of my banks,Chase and they have just the account I am looking for. I can't start it until of course my kid starts receiving benefits. They will be listed as the owner and I am custodian and the monies are deposited directly into that account. But it's treated just like any savings account. Kid owns it for tax purposes. There were reasons I am not going with an UTMA but I can't remember. We aren't going to be looking at investments right now. UTMA seemed to have more rules to follow as opposed to the this straight account the kid owns. I'll research UTMAs more but Chase has the exact account we need that's not UTMA or anything like that.     @@TheK9Shepherd So glad you found a solution. The reason you might want to circle back to an UTMA account is for investment. Placing the money in an index fund alone should give you a sizeable return over time for your children. Something like VOO over time should give you over 8% return in an UTMA. Anyway, best of luck!

    Ed, I started app a week ago as you told me. Ill be 62 in September, wife 60, disabled daughter 20. Ss sent letter to my wife saying she wasn't eligible for ssi. ?? She is eligible for aux child in care benefits benefits, correct?

    SSI is the welfare program. So that denial letter is normal. As long as there is money left on the family maximum and your wife isn't working over the annual earnings limit, she is good for aux child in care benefits.

    ⁠@@MyGovExpert how are you doing today sir. I’m going to retire at 62. My wife will be 58 and we have three disabled kids at home. They say I make too much money now for them to get their SSI like two of them used to get. When I retire, we won’t be getting any of that money anymore and it shows that they would possibly get some money after I retire, but more money after she retires as well. She doesn’t work that much and doesn’t make nowhere near what I made. She just started working again after 20 some years because we can’t afford our bills are in we’re talking like nine years from now. All those kids were disabled before the 22 mark . Two of them are still younger have MS, autism, and hypoplastic left heart. I know have a 401(k) but it’s very minimal not looking forward to retirement with a lot of bills. If I make 90,000 a year right now I’m going to need to make at least that much in retirement in nine years. I assume this qualifies for the auxiliary child benefits disability? Does my wife have to keep working for the next nine years +4 more after because she’s younger than me. Hass to be home with the kids or we have to get a caregiver. Almost need a caregiver now.

    My wife of 20 years unexpectedly passed away in January 2024 from influenza. We have a semi verbal autistic son who just turned 15. Friends told me to look into survivors benefits from his mom to help with his care. I'm not even sure where to start, still kind of in a haze from my wife's passing. My wife hadn't worked since before our son was born, is a survivors benefit even a thing for him?

    Im in belize.....my son is 8 and i have applied for his SS...they told me i would get 828 US per month. They also called my belizean wife and told her.....she then decided to leave wirh rhe child, so she illegally has him. SS will not answer my questkons via email and calling rhem in costa rica is almost impossible

    Hi Ed. I have a question. I am 50 years old. I have a 13-year-old son. His dad was on disability benefits for approx. 5 months before he passed away. The paperwork is being sorted for my son's survivor benefits through the SSA right now. My question is if I can also claim "child-in-care" benefits since he lives with me and is in my care 100% of the time? It sounds like I may qualify based on your video but when I talked to the person at the SSA office, they didn't mention anything about this.

    Update: I meet all of the requirements listed on the SSA site for child-in-care benefits (secure.ssa.gov/poms.nsf/lnx/0300208005) BUT when I called the local office and asked about this benefit, I was told that only people with an income of $22,xxx or less are eligible. Weird how it doesn't mention income limitations on the SSA website. Is this legit?

    I just applied for social security . i have a 30 year old daughter who has been disabled and on ssi since 18 for her disability. I asked about my wife who age is 59 receiving ssdi for child in care benefits once my daughter is approved for ssdi under my social security benefits. My wife does not work.The lady from social security informed me it was only available for children 16 and under and that my wife would not receive social security under chid in care, because my disabled daughter was over 16.Is this correct? Family maximum is $6100 i will receive 3,000 a month daughter 1500. Thank you

    My wife receives SSDI my son is 21 and disabled ( since 5) he receives half her amount. I inquired about “ child in care benefits “ and Social security says they would just half his amount and I would receive the other half, another words still the same total amount. Is this correct?

    Hi John, it all depends on the family maximum. It never hurts to ask for a second opinion with someone that has access to the work record. You can request that by filing an SSA561, Request for Reconsideration. Hope that helps. Take care, Ed

    Hi Dr. Weir. I retired early and began receiving reduced Social Social Security benefits at age 62. In addition i started recieving Social Security benefits for each of my 2 biological children ages 3 & 5. Each child was given 50% of my reduced benefit amount instead of 50% of my full retirement amount i would have received had i retired at age 67. Who is correct here... Social Security ot myself in determining the correct amount? Thank you for your help

    They should receive 50% of your full benefit amount. But family max might be involved. You can ask SSA for a detailed accounting.

    Thank you for your reply Dr. Weir! According to the 2024 Family Max Payment Schedule I would still be under the limit of the Family Max cap with my children receiving 50% of my Full RetirementAge total. I have appealed my decision. Would it be wise for me to seek legal help knowing that SSA will probably rule against me? Do I have any other options? Should I call you to set up an appointment for further guidance?     @@anthonyspina5723One thing to consider is if you claimed your SS benefit at 62 then you are receiving approximately 70% of your FRA/PIA, however your full PIA is counted toward the Family Max. Example if your PIA is $2,000 and the Family Max is $3,500, then your check would is approximately $1,400. Each of your children would qualify for up to 50% of your PIA, I.e. $1,000 each, however your benefit would consume $2,000 of the Family Max, thus leaving approximately $1,500 to be split between each of your children, thus each child should receive approximately $750. Your $2,000 ($1,400 actual) + $750 +$750 = $3,500 Family Maximum.

Because I am in Mindanao area and I am very far from US embassy Manila it take us 2 to 3 days by ship and 2 to 3 hours by plane, and i dont have that much money to go there due to alot of debt from my husband hospitalizations and passing away. I really dont know what i going to do and i hope everything will be ok.

    My mother recently passed away at the age of 64 and 6mos. She was taking care of my 41 yo brother who has been disabled since 16 or 17 years old. She never got the chance to apply for social security benefits. My brother gets social security benefits due to his disability. Would he be eligible to get our mother’s social security benefits? Would our father be able to get my mother’s social security benefits to help care for my brother?

    Hello! I have a 3 yr old who’s disabled and was denied SSI. Could he qualify for SSDI? I have enough credits, I’m still currently employed and not of retirement age. Thank you!

    Perhaps he was denied because of your family income and resources, but if you file for retirement benefits, he can receive benefits off of your record, and income resources don't matter anymore.

    I’m 63 years old, my wife is 49. We have a 6 year old son. I make $63,000 working now and crunching the numbers I could collect $60,000 from SS. My PIA is $2896. Family max is $5,027. I not sure if I should collect now or wait until I’m 67 or 70. 10 years of collecting $60,000 approximately. Or working and waiting. I know my wife will get a larger check when I pass. What’s your take on this?
