Florida man finds he’s not a legal citizen 60 years after moving to the U.S.

Outside Jimmy Klass’s mobile home in Clearwater, symbols of American pride hang not just front and center but also on the side and back of his home. America is, after all, the only home this 66-year-old has ever known. “I moved to the US in 1959. I’ve been here for 64 years,” he recently told us. But after more than half a century in the U.S., where he’s lived, worked, gone to school, got married, had kids, paid his taxes, and even voted, Klass said in 2020 he discovered he’s not a U.S. citizen.

    Technically, you only qualify for citizenship by descent if one parent lived in the country for a certain period, even if the parent is a citizen. They seem to be operating under the old law, given the 10-year requirement. However, the current physical presence requirements are as follows: - The parent has been physically present in the United States or its outlying possessions for at least 5 years. - The parent met this physical presence requirement for at least 2 years after reaching 14 years of age.

    It's because birthright citizenship is only enshrined in the Constitution for those born on American soil. Those born overseas who may become citizens at birth through a parent, receive citizenship through Acts of Congress, not through the Constitution. At the time he was born, the law that Congress had passed, stated that not only did a parent have to be an American citizen, but they had to have had certain residency requirements in the US. This would have prevented for instance, someone who was born in the United States (and so had birthright Constitutional citizenship), but then who's family moved to a foreign country (say England) when they were young (say 3 years old) and they spent the rest of their lives in England, that person who was born in the US, had US citizenship, but spent the rest of their lives in England, would not be able to pass their American citizenship to their own children because they didn't have enough years living in America despite being a US citizen.

    He must apply to derived citizenship and then retroactively restore all the benefits he’s entitled to His father should’ve registered him at American embassy in Canada and made the American passport for him. Instead, he probably brought him from Canada either with a Canadian passport or birth certificate.

Also heard, must find interviews, or u can - if you are American and move here to Australia you still have to pay tax in America as well as here.i think it’s in any country they move to, not sure, must watch it again. Poor Americans were shocked when they found out. I did a quick google. *All U.S. citizens, regardless of other nationalities they may hold, maintain their obligations to the United States, including the requirement to file annual tax returns.

    No, not different, citizenship don't have different ranks like that, the only exception being running for US presidency! I don't know about back in his father's day if it was a thing, but nowadays, if you're ALDREADY a citizen, NATURAL or NATURALIZED citizen, then your BABY born outside of the US AFTER citizenship acquisition is AUTOMATICALLY a CITIZEN!     I'd be surprised if the US does not require children born abroad to a US parent to be registered with the US embassy in the country of birth. After all, the US needs to know where all their citizens are so that they can tax them every year regardless of where in the world they live and work.

    You are eligible for citizenship at birth if one parent is a us citizen but only if they fill out the necessary paperwork. if they don't till you turn 21 your out of luck. This actually happened to a lot of adopted children.

    ​​@@tiffanylamp100 specific paperwork has to be filed; a Consular Report of Birth Abroad, within 300 days of the birth, I believe. It's not automatic. There are other requirements involved, including, as mentioned in the video, that the parent with citizenship has to reside in the US or it's territories for a specific period of time prior to taking residence in another country.

    My grandma came to the US from Liverpool on the Megantic when she was 11 months old. Both her parents died drowning after their small boat in the land of a thousands lakes flipped over in a storm in the 20s. I heard she went through a similar thing in the 70s when she found out she wasn't a citizen. Luckily she was able to work it out when my WW II veteran grandfather passed away and she still received his benefits.

    His father was American and he lived all of his lifetime believing he was a US citizen. Why would he question it? Perhaps his parents weren’t aware of the technicalities of his citizenship status either. Maybe the father assumed since he was American and returning to America to live permanently, that was enough. He lived as an American, he paid taxes, he is an American!!! They should just give him his citizenship which he certainly has earned. They want to give away citizenships to illegal immigrants that are willing to serve in us military but they won’t give this man a citizenship? Unbelievable!!!!!

    His father never took him to a US embassy in Canada to register his birth to a US citizen or never filed a petition for him to become a US permanent resident. That is why he is in this dilemma. Knowledge, process and procedures are very important when a child is born abroad in order to obtain US citizenship.

As far as a retirement fund, that could be thru his employer, he can collect that but can’t collect SS until he fixes his immigration status. Any other bright ideas?

Joining the marines doesn’t make you a citizen either, he also did not serve in the marines. He was going to join but he got another job. Social security cards are not only given to citizens. The government is not going to update your immigration status unless the individual starts the process. Taxes are collected from everyone that works, citizen or not. That’s not a probability that is facts. Do your readers, the US is 35 trillion dollars in debt and it will take 5 generations to pay that back.     His parents dropped the ball. They should be the ones who get the immigration petitions filed for this man when he was a child. I had to do this for my daughter, who was born overseas and moved back here when she was 11 months old. She had her documents filed with USCIS and she was naturalized when she was 19.

Most countries don’t have all these requirements that the US does; I’ve never lived in Canada and I didn’t have my birth registered as Canadian living abroad or anything, I lived in the US my whole life, but because I meet the criteria that was in place when I was born of my mom having been born or naturalized in Canada; I do not have documentation of me being a citizen, but Canadian law is pretty explicit that I am a citizen now, and would just need to show evidence that my mom is a naturalized citizen to get documentation showing it

He lived most of his life in the U.S, and on top of that, the government *labeled* him a U.S citizen….that is until he asked for his retirement funds.     Same thing happened to a woman here in Canada. She is 30 something years old and they just told her that when her mom gave birth to her she wasn’t a Canadian citizen yet and she gave birth in Jamaica. I just don’t understand how can let someone live in your country, works there, they pay their taxes and everything just to turn around and tell them they aren’t citizens? Crazy.

    USCIS website states that if a person reasonably had grounds to believe they are citizens such as when you are a child and spent all your life in this country, then they may be forgiven if they claimed to be citizens to officials at some point. I read this on the website, ill post a link.

    Back in the '50s and the '60s it was very easy for Canadians to come to the US without showing any proof of citizenship. Social security cards can be easily fraudulently manufactured and hand it out like candy. Social security administration has no record of his number ever being in their system nor does the US immigration have any information of his status. But what is true at the moment is he is an illegal living in the United States, voted unknowingly or knowingly in American elections. That is a federal offense, voter fraud.

I worked for the free phone service back in 2014/2015 and the only docs accepted was id, birth certificate and ss card. non citizens had to show their resident card and work permit.

    This is disgusting. Different situation, but my father has fallen to something that happened years ago. He was in college in the 60s and paid his student loans. Last year, we started getting letters from some Federal loan company saying he owes student loans and is incurring interest. It's not from over the years, but starting in 2023. We called them and one of the questions they asked was "What email did you use? Do you have the documents showing you paid it?" WHAT EMAIL FROM 1965! The government and these companies are losing their paperwork and changing the rules to come after anyone!

    He needed a certificate of citizenship,because his father didn’t live in the US 10 years before he was born, he wasn’t born in the US and maybe his parents wasn’t married to give him that automatic citizenship. I’m facing the same problem and waiting for uscis to reply me.

    It's his father's fault, he should have had registered his son at the US embassy in Canada proving he had lived in the USA at least for 10 years previous to his son birth! The embassy would had given him a CONSULAR REPORT OF BIRTH ABROAD! I know that because I just had 2 daughter, one in Honduras and one in Brazil, I showed up to the embassy with my school records, my tax returns, sss and my ENTRY and exit records from border patrol!

    How could he not have known? He has a Canadian passport only. In 64 yrs he never traveled out of the US? If he had traveled at least once they would have caught it upon his reentry. Canadian passport, US address and no green card.

    When I was 23 I lost my social security and needed to get new one. Went I went to get my new one. My new social card said, something to the effect I was not a citizen. I look that woman straight in the eye and said, you got my damn birth certificate and my military records I brought last time I was here. Now fix it. Social Security will make many mistakes. I had to wait another two weeks but the problem was fix. I would also advise that people keep important records with the city or county records. They will certify them and if you house burns or is destroyed you will have your records on file. Many people are against this but I did it anyways and it's come in handy.

    Wow, my dad has the same story, he’s a Canadian but just got American citizenship 3 years ago and been in the USA for 20 years. My great grandfather on my grandmother side was American. So my grandma has citizenship in the USA and my dad just got his and I’m Canadian. Confusing?

    This happed to a guy I worked with his was only cause he was born in Germany in a German hospital but his dad was stationed in the military there and was American and his grandparents got him and his mom into the USA and had the same shit worked for years and had a social security card .When he applied they said he wasn’t a citizen and he had to write the senator or governor of New York at the time they ended up giving it to him .

    He just needs to get his father's birth certificate and school records. That's more than enough. If he can figure which county his dad went to school in New York along with his dad's birth certificate then it should be enough. His Canadian birth certificate should show his father's name. It just takes time. His father made a big mistake.

    They used to be so Lucy Goosy about issuing social security cards & DL. My mom decided to change her name one day & they just puylt it on her SS card & DL for her! Later when it came time to get Social Security security, it became a problem. I had to take her to court to get her name legally changed to match her documents. I'm sure they'll get it straightened out for this guy eventually but what a pain!

    ​@@dickiewongtkno which is the problem. The whole thing with a SS number is that it originally serves one purpose and that's what the man in the video is fighting for. (I have to double check on stuff, but you will get the idea) Because of the Great depression and because of how the US wanted to avoid something like that happening again in the future they decided to collect money from people and then just give it to them later. Which is why at the beginning SSN were not that specific and were even in numerical order. There was a point in time that you could figure out what state someone was born in based of their SSN. There is a whole complicated history with it. Now comes the part that you are asking for. And that's that no there is no central way to find out who everyone is in the US. Thats why your SSN has become such an important thing to find out who you are. Even though that's not the point of the SSN, this has to do with who in the US you don't have a national ID, but rather you have a state ID and how do you get a state ID? You get it with a SSN, I believe that there is other stuff so not every state requires a SSN I think? Part of this is because supposedly the US thinks it's a bad idea to be able to track people individually or something of the sort. It's just a real nightmare That likely didn't answer your question at all but you can look up videos about the history of SSN and some of the stuff I just said will be mentioned in those videos.

    I can do you one better. My dad was home birth in the US in the 1930. Back then you don't even need to register it and he had no birth certificate from the state, only with the detail (like photo and the name and the registration of the midwive etc), so when it come time to register his birth, they can't remember the day he was born, only the month and a year, and he was given a birth certificate (IIRC in the 60s) with only a month and a year and it also appear in his passport without the day. And then in early 00s after 9/11, the government send him a letter asking him to declare his birthday and they change his birthday by deed poll and they just randomly gave him March 31 as his birthday...

    In most states, you can just start using another name any time you want, and that becomes your name. Having a legal name change document makes things a lot easier though. Otherwise you'll have to prove you're that person over and over, and convince people over and over that changing your name through use is a thing. I used a shortened version of my first name for college, but legally changed it to that before graduating to avoid any problems.
