Femi Falana, SAN speaks on INEC, Tribunal, Sowore and Elzakzaky

There have been several reactions trailing the verdict of the Presidential Election Petition Tribunal upholding the victory of President Muhammadu Buhari in the February 2019 elections. Some Nigerians have queried the judgment while others have hailed the tribunal's verdict, saying that Atiku's petition was filed with many contradictions. Today, on the program, we'll speak to a Senior Advocate of Nigeria, as we do a holistic review of the Presidential Election Petition Tribunal Judgement with the erudite #FemiFalana.
#Presidential Tribunal, #INEC, #Sowore, #ElZakaky

Those who voted next level hasn’t seen anything yet! Obasanjo and Jonathan didn’t try hard to amend the law because they were beneficiaries of the flawed laws, now Buhari has taken those flaws to the next level and using it to replace Nigeria indigenous people with foreign Fulanis. May this next level hit hard on those who voted or rigged Buhari in this second tenure.

Do you know that it will help on security levels too, because many will be able to install gadgets like CCTV in and around their businesses and houses? Think about that drinking that nice cold water or juice in that hot tropical country! You can’t run a successful economy or country in this 21st century without electricity. With that alone it’s fair enough to say Ghana surpass Nigeria.

@@plentywater773 Thank you for writing clearly, so I can understand. I have read the "Judicial Oath." The 1st line is just a preamble for the oath taker to insert his/her name and office to be occupied. Point 1 is about being faithful and allegiant to Nigeria; this is vague and makes no mention of methods of achieving said faithfulness and allegiance. Point 2 is about properly exercising judicial functions entrusted to oath taker, and doing what is right to all people in accordance with the constitution. I am not sure what your point is about reading this oath, but I infer that this oath is vague until you get to the point about "...in ACCORDANCE WITH THE CONSTITUTION of the Federal Republic of Nigeria as BY LAW ESTABLISHED and in accordance with the LAWS AND USAGE OF THE Federal Republic of Nigeria...." This is the first mention of an actual formula to follow in exercising juridical duties. Prior to this part, all the oath specifies is the character with which the oath taker is to carry him/herself [i.e will be faithful, bear true allegiance, well & truly exercise judicial function....] Suffice to say the judiciary has a formula to depend on which is the constitution. It is not an infallible document. Our US constitution has 27 amendments + judicial precedents + legal statutes passed the congress. US law is same common law foundation as Nigeria, so I believe similar process apply in Nigeria as well. Thus, Nigerian Judicial officers swear to obey constitution + amendments + judicial precedents + legal statues. Is this not common sense? Here is a link to the oaths www.commonlii.org/ng/legis/num_act/oa79/

dominic andrew all this plenty write ups don’t even matter ... faithful and Allegiance to Nigeria ... so it does not really matter your innocence or guilt as long as Nigeria is in danger or at risk , upholding the constitution will come later and you will be compensated if necessary but Nigeria has to be secured FIRST!!!! Now you see why Sowore who ought to have known better will remain there as long as Nigeria seem to be at risk as they claim...further more , how do you release Sowore on bail ???? The only man that knows where Kanu sleeps , Kanu that left the country shaming the intelligence as they still don’t know how he did it despite they were watching him...it’s only normal for any country to hold Sowore because he definitely will have access to that back door escape Kanu used... The Constitution was perfectly made for the fulanis to favour them in future because they knows that they don't go to school but they must rule by all means, the Constitution said if the electoral body can allow you to run if they feel that you can govern a nation even when you have no certificate

All that has been heard is a proof of the unworkability of the Nigerian political system and by extension that of Nigeria as a country as there are no easy solutions to the problems raised. The people are not ready or patriotic to make Nigeria work.

I told you people that you're all messing up. This is because we should all know that the people destroying that country is not just jagaban only. The directors of law are also corrupt. The corruption in Nigeria is motivated., and mentored by the law makers themselves. The country is in existence without without law. Law in that country in Nigeria is applicable only to the poor mases.

Do you know the section of the Nigeria Constitution that excluded the production of certificate/s as proof of educational qualifications? You may be aware that a Constitution is a framework of fundamental legal principles embodying or encapsulating the entire laws of a country. Further laws are developed from these principles. Example, the Nigeria Electoral Act 2010 as amended by the 2015 Electoral Act. These amendments were meant to cure a mischief not provided for by the 1999 Constitution. Example, the requirement that candidates must depose to an affidavit stating educational qualifications with photo copies. Mr Falana should know that the 1999 Constitution did not debar or disallow the amended sections of the Electoral Act. As a matter of fact, Section 131(d) of the 1999 constitution specifically provided thus ''he has been educated up to at least school certificate level or its equivalent''. Section 318 was silent, and did not support his claim about the Constitution. How do you prove your educational qualifications? The 1999 Constitution could not have excluded anyone from presenting his/her certificates.
