This episode details the FAA's new 2021 guidance on how owners of experimental aircraft can receive training in their own aircraft.
Features the guidance itself as well as all of the issues the guidance does not address.
Near the end, an FAA scorecard is introduced to show the number of issues created by the FAA's ruling from the United States Court of Appeals for the District of Columbia Circuit.
This issue affects a lot of sport aviation including ultralights, hang gliders, paramotors, weight shift control trikes, gyoplanes, powered paraglider trikes, powered parachutes, weight shift control trikes, light sport airplanes and most sport pilot flight instructors. It is even a problem for Subpart H flight instructors who no longer carry second class medicals.

    Thank you. It's a catch - 22. Seems like the FAA doesn't want me to be a safe pilot. Or maybe a pilot at all. Maybe they prefer that I just bush it.

    By generating more paperwork to be reviewed and approved they can charge for the service and generate more revenue for themselves.

    They get paid either way, I suspect. To be fair, the paperwork doesn't cost pilots and instructors anything. It is just another time barrier in front of someone trying to do something great and become a pilot.

    I want to get my Sport Pilot Cert and was considering purchasing a LSA to be trained in. It doesn’t seem like that is a viable plan at this point. What am I missing?

    I will give my 2 cents and my understanding. Please somebody correct me if I am wrong. Basically, the federal courts ruling says flight instruction is flying the plane for compensation. Whereas before we were giving instruction for compensation. Remember the whole you have to have your pilot certificate to make our flight instructor certificate valid. Now remember all the limitations we learned all sport pilot certificate holders were bound by. The pertinent one is no flight for compensation. Basically, with this ruling their is no path, except the LODA, to (by the letter of the regulation) perform flight testing with a sport pilot CFI period. You would need a commercial certificate (which by the nature of sport pilot limitations does not exist) and the required second class medical. Again, I find the entire thing as clear as mud. I think they just want us to wink wink and keep doing what we do until they fix their mess.

    That's pretty much the deal. At this point it isn't about the aircraft, it is about the privileges and limitations of the sport pilot certificate.

    No. You don't need a LODA for an SLSA powered parachute. You are good to go as-is!

    I could of sworn I heard Dan Johnson Talking about the FAA expanding Sport Pilto a little by possibly increasing the Gross weight and number of seats of Sport Pilot Aircraft and allowing certain things like Aerial Photography and Banner Towing for Compensation.

    Dan has. That is one of the indications that that FAA has given us. The irony is that now the FAA has to acknowledge that they have been giving sport pilots limited commercial privileges the whole time as flight instructors. They might as well write it into the regulations!

    Yep, sounds about right. Still waiting for further clarification so I can start flying the share of the RV-12 E-LSA I just bought a share of. The other issue here is instructors are now shying away from any gray areas since they don't want to be the guinea pigs. They feel that the FAA is leaving ambiguity so they can bring the hammer down and deny liability when an incident inevitably occurs.

    I just read reports that CFIs are being prosecuted by the FAA for doing FREE training. The FAA is going crazy.

    when l landed one time w/gear up, faa wanted to fly with me, l took lancair up there, she said i do not hafta fly in this but l want too. She tattooed me for 2 days, i passed.

    Landing gear up has to be the worst feeling. Second worst is flying with the FAA to show that you know how to put the gear down...

    Doesn't this set the FAA up for a civil lawsuit? I mean if you are wanting to be trained in the aircraft you are going to be flying for safety, and you have to take extra steps to do this then the FAA has overstepped its authority as the FAA is in place for safety. Also all those CFI-S who put a great deal of money into getting their certification who are now scared to train new pilots in the safest way possible. Sounds like a setup for a huge class action lawsuit.

    You have to apply for a Letter of Deviation Authority when all they had to do was add the words "except for purposes of flight instruction" to the law. What a bunch of maroons!
