Extra Marital affair is like fraud within marriage which results in mental trauma and sometimes even physical trauma with many other offences. This law must be made as many lives are affected not just the husband and wife but also their children and the whole family. If you want to move on then get a divorce first and not do such things behind the spouse's back.

Yes, Adultery should be punishable. If two married people are not feeling compatible with each other than take divorce and part the ways. But, do not ruin somebody's life and emotions for your own pleasure. Marriage is a lifetime commitment of being together with loyalty. If you are not happy then challenge it in the court and then you are free to do whatever you want.

जो लोग कहते हैं कि अवैध संबंध निजी मामला है तो वह सही से कान खोल के सुन ले कि यह निजी मामला नहीं है यह पति और पत्नी दोनों की मामला है अगर अवैध संबंध को निजी मामला रखना है तो वह शादी ना करें। दूसरी बात यह है कि यदि अवैध संबंध निजी मामला है तो फिर दूसरी शादी करना भी निजी मामला है क्योंकि दूसरी शादी में भी शारीरिक संबंध बनाया जाता है और अवैध संबंध में भी शारीरिक संबंध बनाया जाता है तो इसमें दोनों में फर्क कहा है कि दूसरी शादी करने वाले को सजा दी जाती है और अवैध संबंध रखने वाले को कोई सजा नहीं दी जाती है। हमारा संविधान यह भी स्वतंत्रता देती है कि अपना जिंदगी अपने मर्जी जी से जियेंगे तो कोई दूसरी शादी करके जिंदगी जीना चाहता है तो उसको सजा दी जाती है और जो अवैध संबंध बनाकर जिंदगी जी रहे हैं उसको कोई सजा नहीं दी जाती है।

I am unmarried and scared of getting married due to this issue. To get a loyal partner is a blessing these days. Marriage is sacred and getting married is a blessing. Right to privacy or sex is not same as adultry...two un married person having personal life or sex is different from a married person involved in sex with someone other than wife/husband...

If Adultry as an offence comes back in IPC then it will be definitely gets struck down by SC bcz of following legal reasons: 1.Violates A.21 directly. Right to life & liberty & choice. 2.Violates A.14 indirectly though gender neutral. Bcz India is still Patriarchal in its core. Indian majority population lives in villages & in villages women r still illiterate & economically deprived & non-independent of patriarchical family structure. Most women still today don't have legal knowledge & if have, hard to collect evidence in patriarchal system and if evidence collected, but can't go to court against husband due to non-economical independence. Justice is not free. Free justice not effective & functional in India practically still. 3.Courts & govt. Can't interfere in personal life of a person & can't control individual choices. 4.Adultry can't be even civil offence as majority population of women in India are non-economically independent still. So Civil provision of Adultry violates A.14 directly. India is not just about it's city life. Main India lives in villages & villages are still patriarchal. Untill patriarchal system is not uprooted completely from India, gender neutral laws in India is a myth.
