Eminent Domain - Full Video

In 2005, the US Supreme Court took on the most important property rights case in the history of our country. The Kelo case pitted homeowners in New London, CT against city officials who wanted to use the power of eminent domain to redevelop the area in the hope of creating jobs and increasing tax revenues. The homeowners resisted, arguing that eminent domain power should only be used for public projects like roads and schools. Ultimately, however, the Court upheld the city's right to turn over the homeowners' property to private land developers.
Since that ruling, the use of eminent domain to transfer property from one private owner to another private owner has increased dramatically. The controversial Kelo v. New London decision sparked a nation-wide debate about the importance of property rights that continues today.
Eminent Domain tells the real-life stories of three Americans fighting to prevent their property from being taken in the name of redevelopment.

    My family and I have been fighting our city for the past 7 years. I'd never wish eminent domain on my worst enemy... well except for the mayor and city council members they can get bent.

    What's ironic is replacing a local restaurant which has long established revenue with an expanded parking lot actually just winds up with fewer people in the city having long-term jobs. The people contracted to tear down the restaurant and build the parking lot have stable jobs as contractors already- meaning that few if any people are actually gaining jobs under such a project. This leaves the employees of the restaurant with no jobs, and if more jobs aren't being provided to others in the city, then you now have a higher unemployment rate.

    Why do we never hear of eminent domain being used for low cost housing now the only way to get low cost housing is to share with someone else a single person has a hard time covering the cost the reason we have homeless people and it's only getting worse

    Here's a principal, theoretical issue with eminent domain... Think about it... If "fair market value"--generally the measuring stick for fair compensation in eminent domain cases--was all anyone's property was worth to them, it would be for sale to get that value for it. However, the properties in the Kelo case and others weren't for sale. Thus, the property was worth MORE to them than fair market value. So truly fair compensation is never achieved by forcing people out and giving them fair market value for it. The proper method for such activities should be to ask the owner what it's worth to them to sell and pay them THAT. Then everybody gets what they want, not just the government entity and whoever subsequently benefits. And if the price is too high, then that's too damn bad. That would make things very challenging for municipalities to do things. But do you own your property or don't you? (Hint: You don't. You pay rent to "own" your home in the form of property taxes.)

    The government on any level can not force you to sell your property, because of Eminent domain, unless it is for public use. Just because they may want to redevelop an area and give it to a developer, they can't do that. They can ask if you would like to sell, and if property owner says no, then it's no, period. They cannot use Eminent domain, to force you to sell to another individual for their private use. Can be take if it's for a school, highway, library, things like that which are public use.

    Idk where you're from, but in my city, if you're willing to sell your property, there'll be a payment of just compensation. But if you're not willing, the government would sit you down and talk to you about your wants, demands, and whatnot while offering you just compensation in order to buy the property. Plus, you won't be transacting with other private individuals, you'll be transacting with the government and after the government have the property, it is in the prerogative of the government whether to sell it to quasi-public corporations or not.

    I’m a fan of your youtube channel and a subscriber, and I loved your eminent domain video on the corrupt Kelo vs New London case. I’m going through an eminent domain case myself where the city of Inglewood is using ED to take my property to give to Steve Ballmer, the 5th richest person, for his new Clippers arena! Definitely not for public use because he’s going to make money off the tickets. Ballmer bought the Forum from Madison Square Gardens because the owner threatened to fight Ballmer for his use of eminent domain to take the forum. So Ballmer didn’t want to deal with the headache and bought the Forum off the other billionaire because he knew he could have the city use ED to take the rest of the property he needed from small property owners like us. I was going to start exposing this on social media and wanted to get your advice, since you have som much experience. Thank you ahead of time for any advice and help and looking forward to your next video!

    When I was growing up in Southern California, they were widening the 605 freeway near where I lived. I remember asking my mother what about all the people’s homes. That is when I learned about eminent domain. I felt it was so wrong. That someone could come and just take away your home and everything even if it was for a public purpose. It just seemed wrong and it still does. The finding of the supreme court in this matter was a mistake, and not of the people, by the people, and for the people. The ruling was wrong in every way. Shame on them.

    Glad to watch more facts about the Kelo case. A note to the Supreme Court's decision: it perceived "public purpose" as "public use" in view of "an unbroken line" of case law. Public purpose is more than just raising tax revenue, it also mentioned employment opportunities, and reviving an economically depressed area. Doctrinal argument dictated the outcome of the Kelo case. But this presentation made a one-sided argument for the local people, and ignored the government's side of story that the City was designated a "distressed municipality." The presentation further ignored the fact that although Kelo did not want to sell her property, at the end she received more than tenfold economic compensation of the fair market value when she purchased the property. People understand that money (alone) cannot buy an ideal home in an ideal community where people relationships that do not have any "fair market value." But such relationship is the result of government actions that warrant the use of the eminent domain power.

    Value at the end of the day is subjective. The government is objectively stealing her property by the threat of force (removing her from her property) without her consent. That is objectively immoral ,period end of story. The government could have offered her 1 trillion dollars for all I care if she does not consent than this should not happen, and is therefore theft as 1 of the 2 parties is not in agreement

If you discuss morality, you should go back in history to review the legislation and the overall cost-benefit analysis in the social contract (the US Constitution). Don't like the law, change it if you can or leave the country. That's how the US was formed.

    I’m going through this now. Miami Florida palmetto expressway is expanding and taking 20 homes including mine.. :(. I will be paying higher property taxes when I get another home forever. That’s not fair. Just compensation Does not cover higher tax payments forever.

    have you taken their offer? DO NOT! They will play chicken up to the court date- fronm my research 70% they fold BEFORE the trial; also subpoena others involved as they often "block bust"- pay the perceived younger folks able to resist, then waiting up to 2 years to offer as low as 5% of indepent appraisal; it sux; 5th amendment very clearly states "with just compensation"- read the DOT track record

    @@TheHeroicNinja For public services like roads and national parks. However it should always need a lot of justification and shouldn't be used in favor of private businesses for the porpose of "growing the economy" or increasing tax revenue.

    advice if you have a home thats a historical home.. make sure to register it... as such.. forver no one can touch it not even government.. only ting is you cant add too it or build just fix and keep the color.... also dont buy near stores or on streets with stores... this world sucks ass... the rich dont want us around but funny thing is we build their shit.. if you accept money and find out someones home was taken like this quite that job

    The uniform relocation and acquisition act prohibit the government from "taking" property. The idea that the government is going to force you out of your home or business is absurd. A comprehensive appraisal, appraisal review, and a third review is required in addition to a relocation study before an offer is even made. The business is interviewed, and a replacement properties are made available before the acquiring agency can present an offer to purchase. Relocation benefits are comprehensive and cover the costs of moving, re-establishment, re-branding and advertising. In addition, the business or property owner chooses where they will relocate and almost always end up in a better position than when they started. This video does not paint a full picture of what really goes on nor review the complex laws that are enacted to protect private property rights to ensure fair and equitable treatment. Yes, it sucks having to move, it's stressful, and your losing something meaningful that you've put your life into developing. But no one will ever be stripped of their land and positions and left with no where to go or no one to help without due process of law enacted by the officials that "We The People" elect into office.

    At the end of the day as long as 1 party is part of a “transaction” that they do not consent to, but are forced to do it under the threat of force, this is robbery. Whether they get compensated any amount of money in the world if they didn’t consent to this but are forced to sell by a monstrous entity that has a monopoly on legal violence (the government), it is and will forever be theft.
