Death of dancer who ate mislabeled cookie called "100% preventable"

Órla Baxendale, 25, moved to New York City from the United Kingdom six years ago to pursue her professional dance dreams. On Jan. 11, she had a fatal allergic reaction to a cookie containing peanuts. CBS New York's Natalie Duddridge reports.

I work in grocery store bakery department, and I package these types of things as well as print off important emails for my department. Whoever's job it was to read these emails and notify the store is responsible. They quite frankly ignored the email and it cost this entire store a lawsuit and the life of an innocent person.

It seems to me this is such an important thing that they needed to do more than just send emails. They should have had in person meetings and phone calls. An innocent person died and both companies are playing the blame game.

@@misstriciaskitchen8640Why? Did they require a game plan for how to print a label? Was it important they get together and remind each other just how not having proper labels could bite them in the ass? We can’t really understand where the failure occurred without knowing far more about the whole process. Including whether these sort of ingredient changes happen often. Was this a common occurrence that manufacturers send updated labels due to frequent changes? Have emails been sufficient in the past at informing those in charge? Could this all have simply been an honest mistake that maybe should have been caught by others but wasn’t? Did the company make a conscious decision not to address the change for some lazy or financial reason? Is there a sufficient explanation for why a company would ignore emails from one of their manufacturers? There’s more need to know. While everyone can speculate on blame till they’re blue in the face, we won’t be able to properly understand how this happened until we get the big picture. I do think declaring what should have been done instead is pointless. We don’t know what was done. We don’t know what is usually done. How can anyone say a phone call and meeting should have occurred as if that’s what the right thing to do would have been. Let’s also remember it is possible the failure was at the bottom. The bottom that’s paid usually the bare minimum. For some odd reason companies like to give big responsibility to workers yet pay them as if they aren’t a trusted and important part of the company. Like when there is a plane crash and the issue is traced back to a sloppy mechanic or one who made an honest mistake. Companies love having those guys to blame when in reality, it’s the companies focus on profits and less on proper pay and training and ignoring the realities of overworking people. That’s just speculation of course, but it certainly wouldn’t be surprising if they found a part time worker at the supermarket to lay the blame on.

No matter how careful you are it will still happen. You can’t grow everything you eat. You have to buy some of your ingredients and can’t know every possible cross contamination. I went into anaphylactic shock walking down a grocery aisle that had a torn bag full of the seed I’m allergic to that had gone airborne with the air conditioning system. You take your life in your hands every time you leave your house when you have a life threatening allergy, but you shouldn’t be blamed for dying when you take precautions and someone else’s mistake takes your life.

Except in this case it was NOT the manufacturer's fault. They did have the correct label (included the ingredient) in place. It was the store she bought the cookies from that re-labeled it and for some reason, failed to list the ingredient on the package. Go figure. Either way, no one with certain food allergies should trust merchants 100% on taking those "extra precautions". They should only eat and make their own snacks, eat their own created meals and only if they must, only go to places they know well and the places know them to get meals. Perhaps in the future, they can use a food scan of some sort.

I had bought it once before and it had walnuts but this time it was peanuts and sunflower seeds. When I looked at the description on their instagram page it still said walnuts. When I complained about it they reimbursed me the almost $7 and that was it. They just said oh yes we are now using peanuts. I explained to them how important it was to let people know because of allergies. They couldn’t care less. These types of tragedies can definitely be avoided if people were serious about listing their ingredients truthfully. My condolences to her family.

I would email a link to this video or print an article about this and mail it to them. Adding “this is why accurate and updated labeling is important”. It isn’t even about them, it’s about the people that could potentially buy from them and suffer due to the store’s negligence. Perhaps then it will click. Even though you don’t have a deadly allergy, if you kept coming in contact with peanuts (unbeknownst or not) sometimes an allergy can get worse and become deadly. So, you’re absolutely correct. Labeling is important and changes in label even more so.

I called the company, and they made the excuse that Celiac was NOT an allergy and since that was and allergy warning, they could ignore it. It was NOT an allergy warning. And they did not even know that the same amount of gluten can trigger both Celiac and allergies. It is disgusting what they get away with. I complained to the FDA but they will probably do nothing. @@mynameisworld Of course labels can be wrong. But people have to eat, right? So it's a matter of minimizing risk and having a backup plan in the even you ate something making you allergic. For example: * when you can, it's better to make your own food. Does that guarantee you won't have problems? No, like you said, labels can be wrong. But at least you made the food, so you're going to make sure there's no cross contamination and try to use products that don't have the thing that makes you allergic. But there's no guarantees even with that. So... * you need to have epi pens everywhere. And multiple of them. In your home. In your bag. In your car. Everywhere. And then that means you need to replace all of them when they expire, which is a pain, but it is what it is. * if eating out, go to places that don't have the thing that makes you allergic. For example, if you're allergic to fish, go to steak houses, but first call and ask if they can handle fish allergies. And again, take an epi pen with you just in case. Your strategy obviously can't be, "Since labels could be wrong, don't trust them" because you'll be left eating ice cubes!

A law was passed in the UK, called Natasha's Law, after a young girl called Natasha (of course) who had died after eating a sandwich which contained sesame seeds - there was nothing on the packaging which stated ingredients. Also on all packaging, allergens are highlighted in bold text and a statement on products which are produced in factories handling nuts, milk, eggs etc. The product may say something like: Not suitable for people with nut allergies as nuts are present in the factory. Maybe the US needs a law like that!

Back then, the kids that had severe allergies, died. Today we identify the problem and if the kid manages to survive the first encounter, s/he has a good chance of living a happy life. Plus, we avoid known allergens for babies and then test if a family has any suspicion. I also have a suspicion that we have sensitized kids with exposing them to so many chemicals in childhood that we induce allergies. It is very possible to be too clean.

There's more allergies and they are more severe (evidenced by increase in ER visits), there's more eczema, more asthma, more eosinophilic esophagitis, and more Celiac (but that's not an atopic condition, it's autoimmune). I think the increase in atopy might relate to a reduction in exposure to ectoparasites (lice, bedbugs, etc.) - IDK if that applies to Celiac, though. Another interesting thing is that human body temperature has been decreasing since the Industrial Revolution, based on US historical medical records.

So my wound, which was approximately 25 inches wide by 10 inches high, was initially debrided with pain meds daily but within a few weeks, they asked me to try it with only regular Tylenol for pain control. I tried it, got through it without crying, and told them the next day that I needed pain meds. Then the doctor told me that if I insisted on pain meds, I could have them but he would note in my chart that I was exhibiting "drug seeking behaviour." Coming from a medical family (3 MDs in my nuclear family), I know how the system works. Being documented as showing drug seeking behaviour can affect your medical care negatively for the rest of your life. So for the rest of my 5+ month stay on the burn unit, I endured daily debridement with just Tylenol. It still features in my nightmares and, occasionally, certain scents or lights or other triggers send me into a panic attack. Nationally, about 35% of patients who spend 3 weeks or more on a burn unit cone out with PTSD. A study a few years later of that particular burn unit showed that 75% of their patients came out with PTSD, the gift that keeps giving for the rest of your life. I've read that they increased their use of pain control medication for their patients after that study was done. Apparently having more than double the national rate of PTSD was bad for their reputation.
