David Hogg Says You Have No Right To Own A Gun & You Are Not A Militia

Ойын-сауық

David Hogg you have no right to own a gun
bit.ly/2CHLudt
The eternally pre-pubescent Gun-Control opportunist David Hogg just tweeted this:
"You have no right to a gun. You are not a militia. When you're talking about your second amendment rights you're talking about a states right to have what is today the national guard. The modern interpretation of 2A is a ridiculous fraud pushed for decades by the gun lobby."
I honestly don't like acknowledging this kid because anytime I do, it feels like I'm sparing with the intellectual equivalent of a 12-year-old wearing his father's suit.
But he has a big following and uses it to spew a ton of misinformation about the second amendment.
Because schools these days don't actually teach about the second amendment, I feel it necessary to take it upon myself to debunk this nonsense.
Apparently, David Hogg thinks he is smarter than the Supreme court because on June 26, 2008, in the case District of Columbia v. Heller, the supreme court explicitly stated that the second amendment protects an individuals right to possess a firearm for lawful purposes such as self-defense within the home.
If I don't have a right to own a gun, then the entire bill of rights means absolutely nothing because the right to bear arms is literally the Constitution's second amendment.
It says verbatim, "A well-regulated Militia, Being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed" you can't state it any more plainly.
It says the People. Not the government. The People. Not dogs and cats. The People.
So unless you're now identifying as a non-binary, cis-gendered dodo bird, you, I, and the rest of the people have a right to own a gun.
This is why I call David Hog eternally pre-pubescent because even at 22 he makes arguments like a spoiled child.
He doesn't even realize that he's literally saying you don't have a right to protect yourself.
The bill of rights isn't an a-la-cart menu where you can pick which rights apply and which don't.
You either have all the rights, or you have none of them.

Exactly Militia: (in the US) all able-bodied "citizens" eligible by law to be called on to provide military service supplementary to the regular armed forces. Does not say anywhere that they have to be National Guard or even trained. It is citizens that react to defend themselves and their nation in time of conflict or war. By taking all the guns away from the citizens, they remove the ability of the nation to have such a militia.

Yes guns are scary. But hearing a piece of shrapnel whizz past your is a lot more than just scary. That came out of a big gun. All of my uncles between the age of 18 and 32 got to experience the two way high velocity lead poison pastures. One of my cousins is a permanent resident of France. All of this woke dumb shit is what is going to get us back into the suck again.

The most generous interpretation of him is he was in another building on the campus, and never in any direct danger. Him and that "Emma" girl were just people who went to the school, and never even heard a shot fired there really. David is perpetuating a myth from a Kansas case that said that, along with other things about state/federal rights. On other subjects that ruling was invalidated, but since it never really touched on guns, other than in passing, it was never specifically invalidated on that subject. Federal jurisprudence has NEVER said that, not once. Only in "US vs Miller" (1939) did Short Barreled Shotguns were ruled as "Not suitable for militia use", and could be banned, everyone acts as if ANYTHING can be banned. There is no Federal rulings that say ONLY the National Guard can be armed, and as far as we can tell, never will be. It seems gun controllers seem to see silence on the subject (Guns and gun ownership.) as full acceptance of their view. It is not. The SCOTUS has ruled four times in a row "Arms" include private ownership, and public bearing of them for Self Defense is a Constitutional Right. His interpretation is his personal belief, not jurisprudence in any Federal court. Just because some Federal judges agree with him, and find excuses to uphold state laws that Bruen says are unconstitutional doesn't mean much till SCOTUS either refuses to rule on them (Defacto upholding them.) or takes a case, and hasn't ruled yet doesn't make him or those judges correct. It just means the SCOTUS didn't overrule them explicitly yet. He takes that as a "victory" for his point of view and his side of the subject.

when a militia was assembled, the reason you needed a regulation of the militia was to have a set standard where a militia member had all the necessary working equipment needed to go into battle, which they had to provide themselves. if half of your militias rifles mis-fired during a battle during a volley fire but all the opponents rifles fired. if both sides had 100 troops each ,assuming half would hit there target and cause a casualty, this would be the outcome 100----------100 first volley 75----------- 50 second volley 62.5---------12.5 third volley 59.375-----all dead an unregulated militia meant you were guaranteed to be slaughtered in a battle. it was of the highest importance that every civilian had there own proper equipment if the need for a militia was to be assembled. it was deemed necessary for the security of a free state that civilians have the right to bear arms

"Shall" is a tricky legal word and they arent making laws its a regulation from a regulatory body. "A well regulated"... This is what happens when a legal document grants or "affirms" rights, benefits, privileges or immunities to the "People". If you have the inherent right to go walk your dog do you really need me to "affirm" that you have that right? Doesnt it put me in a position over you if I "affirm" or "enshrine" in some way to solidify your rights?

  • @rabidsbr

    @rabidsbr

    Жыл бұрын

@Ahead Of The Curve The party doing the affirming of the rights in the 2A is the People, NOT the government. And yes, the government is subservient to the people. The Constitution is the people's charter to the government to grant them specific, limited powers. The inclusion of the Bill of Rights is the reminder to the government "just in case you didn't understand where your powers end, nothing said previously in the Constitution grants the government any power to violate any of the rights explicitly enumerated in the Bill of Rights." It's supposed to be an extra "don't even think about it" to the government, not a grant of all powers not enumerated are the Government's. In fact, that is precisely why we have a 10th amendment. The inclusion of the 2nd Amendment in the Bill of Rights is an explicit statement by the People to the government that, despite (i.e. notwithstanding) other very specific limited powers being granted to the government by the people elsewhere in the Constitution, the right of the People to keep and bear arms shall not be infringed. Full stop. Its inclusion does not in any way open the door for the government to renegotiate this right. It's not a negotiation. Like the right to life and liberty, the right to keep and to bear arms is unalienable and exists regardless of the 2A. It is included to make crystal clear that the idea of acting in any way so as to limit or undermine the right of the people to keep and bear arms or to encroach on the same is completely unacceptable, unenforceable, and intolerable. Attempts by legislators or other government officials to violate these rights should be punished via charges under deprivation of rights under color of law.

During the time of the Parkland shooting, I used to drive past Marjorie Stoneman Douglas H.S. on my commute to work and back. Although I could see HSD H.S., I never had occasion to visit. After the 2008 shooting, David Hogg was constantly interviewed by anyone that would listen. I owned no guns at the time but _I was so impressed with David Hogg that I immediately joined the NRA._ When the shooting went down, David Hogg was located at the other side of the campus and yet he claims to suffer from PTSD. My story is a little different. In 1971 I had hired on as a brakeman on a railroad in Hialeah, FL. One night at about 3:30 AM, I had been up all day, I took a switch engine into a locked storage yard of the local power company and tried to couple up to three empty flat cars. The first car would not couple up and I banged it several times. I had been on the job about five months. I was dead tired when I heard, what turned out to be three gunshots, behind me. I turned to see a dark silhouette and a flash about 15 yards away and realized someone was shooting at me. I dropped to the ground and two more rounds came my way. I've never been in the military so this was new to me. When the threat appeared over I resumed my duties and pulled the three flatbed cars out and locked the gate. We stashed our cars and took the switch engine down a side track and saw the security guard cautiously returning to the scene of the crime with his revolver drawn. The engineer stopped the locomotive and the conductor hailed the guard. I remained seated in the cab of the engine, shaking like a leaf in a storm, and very angry. "Hey old timer! What's going on?" asked the conductor. "I got a prowler," he replied with slurred speech. "I think I wounded him." Although in his 70's I wanted to mercilessly pulverize the man but I remained seated. "Well you damned near killed my brakeman." Shortly afterwards a police officer asked if I wanted to press charges or just get him off the job. I took the latter option, not wanting to spend endless hours in an unpaid activity. I told you this yarn because I suffered no PTSD. Surviving this and an episode where a car being changed by a police cruiser smashed into my car, have only left me fearless and more appreciative of the blessings of life. *David Hogg is a fake.*

Critical thinking is not a skill hoplophobes have. Also, no matter how much they repeat this lie, the National Guard is not the militia. It is a reserve branch of the US Military. The militia as written in the 2nd Amendment has historically been defined as all able-bodied citizens eligible by law to be called on to provide military service supplementary to the regular armed forces. In letters and articles the Founding Fathers equate the militia directly with The People. There is no distinction, and membership in the National Guard has nothing to do with being in the militia. The narrowest possible definition of militia which could be legally sound is males between 18 and 35, since that’s the population which is eligible by law to be called up for military service… But Hogg and the rest of the hoplophobe swine wouldn’t find that acceptable because that is the specific group they most want to disarm. I do have to wonder if they’d be happy to disarm all women or if they’d find that sexist. Which leftist priority takes precedence? Finally, to everyone reading this, when we say the left is trying to take out guns, we mean it. The attacks on the Heller Decision are not intended to limit certain kinds of weapons, they are attacks intended to suppress the right to private firearm ownership and this would apply to ALL types of firearms, including muskets. They may try to hind behind euphemisms like assault weapons ban and gun safety, but going after the right to private ownership of firearms has always been the end goal. If they had the votes, they’d try to repeal the 2nd Amendment. Since they don’t, they’re forced to incrementally chip away at that right and normalize these infringements over the decades in the hopes that either they can establish public tolerance for their policies or at least hope to one day find corrupt legal processes to circumvent the 2nd Amendment, as they tried to do in the Heller Case.
