DA defends plea deal in Delke case; 'This has never been a slam dunk case'

Daniel Hambrick's family wanted to see former Metro Nashville police officer Andrew Delke tried and convicted of murder for the 2018 shooting death of their loved one.

    Well citizens don't have the authority to pursue fleeing suspects, so that's going to make a big difference in how the jury weighs these cases.

    I agree that the sentence is really low... However (1) we need to show similar sympathy and compassion to whites who are vicitmized by blacks (2) WTF🤷🏾‍♂️ ... I think Delke erred but Hambrick wasn't an angel (he had a violent record). Delke erred in identifying the car he was pursuing. But the past evil deeds of Hambrick caught him and made him take off once he saw the cop. I do think shooting fleeing criminals is warranted, but since in this case Hambrick wasn't the original target, it was wrong to shoot him. ---- Three years is a bit low, I would have gave him five at minimum. But let's not forget that the criminality in our community is a huge problem.

    This has absolutely nothing to do with race. He shot a guy who was running away from him (the police) and was armed. He happened to be black. Do you think Delke told him, "Hey, I really want to shoot black people, and you're black, so can you please be uncooperative so I get a chance to kill you?" smh...you people with your race-baiting are pathetically dishonest.

    When races is involved, White people (racist) always seem to make something simple very complicated. The supreme court is clear about officers not being able to shoot fleeing felons in the back. On film this officer wasn't in fear of anything or anyone. if he was he would have taken cover. While standing up straight (similar to how officers stand in a shooting range) and not seeking any cover, he simple took his time to aim and then fire his weapon. In amerikkka, a police officer murdering a Black man equates to a work place infraction (not a serious crime) worthy of termination. In 1963 MLK had a dream, in 2021 we better wake up, stop dreaming, and see amerikkka for what she always will be.

    There's no clear cut rule about shooting fleeing criminals in the back. The totality of circumstances needs to be taken into account. And you need to focus on the record criminality in our community before spouting hatred against whites. We are the worst citizens of America. 🤷🏾‍♂️ ... WTF🤷🏾‍♂️ ...     The simple fact is that at the time of the shooting he was not a direct threat to the officer. Therefore I would have no problem saying guilty in a murder trial. I'm white and used to wear the blue.

    Wrong, he was running with a gun in his hand, Im certain he was told to stop running, he didn't and a reasonable juror may have found reasonable doubt or would have been hesitant to convict a police officer. Me personally, I believe he did not have a gun, that it was planted there by police. But without witnesses or close up video evidence, you cant prove it.

    Fine...but the Accused would have to Justify why he got, how did he get there and what was the reason for the pursuit of the Suspect for? What was the "Threat to your Life" when the Suspect has their Back to You... You dont just end up chasing after someone as a Cop for NO REASON...lets say he wasnt armed and he was still pursing after the Suspect? If the Murderer felt okay with his decision to shoot at the Suspects back multiple Times, if the Suspect had been unarmed how long would it had taken the Murderer(cop) to shoot the Suspect then?

    He got what the law provided under the offense for which he was convicted of, a conviction makes it easy for the family to win a civil judgment, they broke asses will settle and all them unemployed as family members included his dope fiend ass dad will get money and blow it in less than a few years and be back in the same low life ass position they are in now.

The Suspect never pointed the Gun at the Murdering Coward, and the Murdering Coward never had a SINGLE reason why he just started to Chase after the Suspect...he never saw The Suspect commit a crime or had reason to suspect. They are hesitant to send a police officer to prison under such circumstances. I would think the criminal running, should just stop running, the gun he has if illegally possessed should not be in his hands, and as an officer chasing this criminal scared as hell, I'm thinking I should be allowed to shoot him to protect myself and the general public from him. A jury will think like this, resulting in an acquittal or a hung jury. 3 years in prison and the loss of his job and a felony conviction are better than nothing.
