Namaste mam. Mere wife ne jhoothi jewelry list di hai and uske badle paisa maanga hai jo ki trade bill maana jaa sakta hai. Now as per order 37, bill of exchange ke saath bhi suit chalaya jaa sakta hai. To kya false jewelery list ke saath order 37 lagake damage compensation maanga jaa sakta hai ? Thoda technical hai lekin possible hai kya ?

With the respect to the complaint under section 138 of the NI Act, the plaintiff can also proceed with the summary suits as per Order 37 for recovery of money.

Can you explain Form No 4 defendant Appendix - B Sch - I- CPC suit summons received and appeared before before the court and filed vakalth and registered address to plaintiff counsel Leave to defend I can file written statement. and defend the case the summary suit has lost is chraractor and ordinary suit there is no deed for to wait for summons for judgement Form No 4 - A it will apply only to person who is not appeared beore the court with in 10 days other procedure to be foll owed

A guy has took 5k from me by saying he's having finanical crisis at his home, so I lend him the momey and he siad that he will definitely give my momey back within a week. Now it's been more than a month he's not paying my monry back. Could you pease suggest what action can I take against him or what are the possible ways to came out from this problem?

Notice is against the respondents or accused meanwhile summons are issued to those person who are part of the proceeding or investigation they may be eyewitness, respondents, lab expert , manger etc.

Sir , ek Banda hai vo mujhe phone thodhe saste me dilwa Raha tha 30K me Mene usse 15K diye and usne apni taraf se 15K lagaye iPhone XR dilwa Raha tha toh ess amount me possible hai and hamari baat hue parents se baat kar waye uski personal details li and all. Lekin ab 6 months hone aaye hai phone toh aaya nhi usne bola refund kar Raha hu Lekin vo bhi shayad usne use kar Liya mere pass WhatsApp chats hai usko paise transfer kiya hai uska proof hai and all the detailed chats evidence. Kya me uspe case kar sakta hu ? And kya mera case strong Hoga ?

Yes . You can file summary suit under order 37 CPC. As well as you can file criminal case under section 406 ( criminal breach of trust) and sec 417 ( cheating).
