Incase under Order 26 rule 2 when commission was appointed to examine witness beyond jurisdiction and the judge of that location didn’t do that for an year ? What will be the next step ? Can court cancel it’s suo motto of commission and send advocate to record statements?

@@harpreetsinghkahlon2827 A commission under order 26 , rule 2 , CPC was issued by Delhi court to district judge Rohtak which was never executed for an year and no reply was received for an year. Court however canceled it’s suo moto of previous commission in exercises of its inherent powers and appointed an advocate to go to Rohtak to record statements of witness. Is that order of cancellation of previous commission correct .?

Sir agar koi in camera proceedings kerna chahata hai to kya tab bhi ye comms. Assign ho sakte hai..khastor pe agar ue kisi ladki ki dignity ka sawaal hai..pls help me thanks

Camera proceedings only conducted in court in which only advocates and parties would be present before the court and non others are allowed to enter in court

@@harpreetsinghkahlon2827 thank u very much sir..so based on this i can protest the application of petitiner whose cross was in process and its always in camera...even though he has dealyed the same and now he is praying on grounds of savi ng time..just bcoz i know he does not want to face court..thanks..pls reply

Sir in rule 8 - it is written evidence of commission shall not read as evidence without consent of party against whom offered, however in rulr 10(1) the report of commissioner nd evidence taken by him shall be evidence in suit, it is contradictory litlle bit confusing plz explain

Rule 8 is for the purpose of evidence recorded by commissioner and rule 10 is only for the purpose of local investigation by commissioner. For evidence through commissioner u/r 8 there is necessity for consent of party but for local investigation report u/r 10 there is necessity of cross examination of the commissioner by parties to verify the authenticity of the report.

If u want to examine a witness but not possible for him to come in court, and if court is satisfied that the witness is unable to come in a court for his evidence then court may sue moto appoint commission or ask the party to move an application
