The Apex Court in Chief Conservator of Forests, Government of A.P. Vs. Collector, AIR 2003 SC 1805, has observed that the requirement of provision contained in Section 79 CPC as well as Order 27, Rule 1 CPC is not merely a procedural formality, but is essentially a matter of substance and of considerable significance whereby the special provision as to how the Central Government or the State Government may sue or be sued has been indicated. the authority to be named as plaintiff or defendant, as the case may be, shall be- a) in the case of a suit by or against the Central Government, [the Union of India], and b) in the case of a suit by or against a State Government, the State.

No, only plantiff give notice to govt when he instituted a suit against her.

sir if in any state no goverment exist president rule is imposed than where where the notice is to been send and where we take the immediately relief??

Quick question why union of India was selected and not the govt .of india

Sir, Does the govt also has to issue a notice to private person before institution of a suit? Sir this question is arising in my mind because the name of the section whole chapter is suits by or against the government.

sirji if suit is filed by two or more parties, do they all have to sign & verify the notice & plaint, because in a case there were 63 persons & notice was signed & verified by only two persons, It was held to be insufficient. ? please answer

In that case a separate page containing the signature of parties be attached in the plaint, without signing how can a person claim anything, the defendant always has an opportunity to take a ground of defence,

O 6 rule 14 and 14a are general rules of pleading, whereas sec 80 is different to these sections.
