Copyright Law for Video Games

From the Interactive Media & Games Seminar Series; Todd Smithline, Principal of Smithline PC addresses how the rules and mechanics of a game have historically not been protected by copyright. A recent spate of cases involving clones of mobile video games, however, is challenging that understanding with consequences already being felt well beyond the phone. Todd explores these new cases and considers how they may limit creative choices for all kinds of game developers.

    @@raquelblanco2098 hola Raquel!! Estudié Derecho en Granada y ahora estoy estudiando el Máster a Distancia en la UNIR a la vez que trabajo. El máster de llama Derecho de Propiedad Intelectual y Derecho de las Nuevas Tecnologías. En general, me está gustando bastante y aprendo un montón. Hay una asignatura dedicada al software y se incluye algún supuesto de videojuegos y se los trata también en otras asignaturas como obras complejas, al mezclar programas de ordenador y elementos audiovisuales con interacción. Sin embargo, a veces siento que los textos a leer están un poco desactualizados y por desgracia pasa también en alguna otra asignatura, aunque en general es un máster profundo y que ofrece muchos conocimientos, fomentando el trabajo autónomo. Si estás interesada en este campo lo que tienes que hacer es buscar masters en propiedad intelectual y buscar en su programa referencias a software o incluso a videojuegos. Es posible que existan masters en los que solo se hable de software o videojuegos, aunque no estoy seguro. Espero haberte ayudado. Saludos!! :D

    copyright law makes it possible for a lot of people that make a living with their art, but it also allows market forces to drive out imagination. by that i mean presenting worlds that are real viable alternatives to anything our own world has ever known. i know one might think it would encourage diversity by discouraging imitation. well if diversity were a bigger market it might. but as long as markets gravitate to the familiar, its more of a handicap. it doesn't encourage the breaking of familiar molds.

    Good presentation. Although the fundamentals in this presentation is still actual today, there have been tons of new challenges in this field since 2015 such as AI integration

    The saying “play stupid games win stupid prizes” comes to mind because ppl willingly steal ideas from another game and then play dumb/innocent in court as if they’re a victim when they’re justly accused of stealing….

    Im in the game industry, what about every first person shooter, first person shooter with matches, modeled after real world, the issue is that there is by default overlap and how it should be handled

    So, if I copy a particular weapon from a game, not a standard one, and the weapon isn't essential for the experience of the gameplay or anything, is it legal? I'm referring to Scarborough Fair form Bayonetta 1, and the art isn't the same, because mine is a 2D 32x32 sprite.

    You weren’t listening or didn’t comprehend what you heard. Basically to answer your question yes that would be copy infringement. You could get away with it if you have permission from the owner of the copyright or if your copy of that sword/game is not being sold…if your game is not well known it will fly under the radar and you’ll get away with it til you dont…visuals and audio are always copyrighted- its general ideas/rules are considered abstract/generic enough to not be copyrighted

    A story by itself can't be protected by copyright I guess. Also, if a story is similar to another one and the characters are different, I think there aren't problems. Copyright protects more concret parts of a game, so if the game doesn't focus only on the story, I think it is fine to be similar. It is also difficult to copy a story at 95% without knowing.

    @@zenP0 If you simply don't know if you are copying and you are adding "new" mechanics to your game, not obvious ones, there are low change to accidentally copy them. Be creative and you will be fine.

    Well there’s a game called worlds adrift that was completely shut down after the devs brought it down and there’s a new group of devs that are making a extremely similar game of it because they were sad that it was taken down. The devs are making a game called voids adrift and linked this video to prove that what they were doing was completely legal. I know it’s been 7 months but I think that if you want to make a cs nexus zombies then you can (probably if you don’t copy everything from it).

    You are fine CS nexus zombies is a modification for counter strike, it is basically a taken on Killing floor, COD infected is similar, CS nexus zombies is not copyrighted. And you are fine to proceed since it would be consider interpretative art anyway. Anyone who would go after you would have no case, it would be as stupid as Rambo pressing charges against John Wick because they are both action movies.
