It doesn't matter b/c you know the K9 was going to "alert" and that gives them PC to search. Then after the cops don't find anything, file the lawsuit and have his lawyer pull the K9s certification records to show how many times the K9 alerts on "random" cars vs how many times drugs aren't found. That should lead to hopefully someone calling out the cops on their shady tactics in stopping and profiling people and making illegal searches.

I have a strong feeling that these officers are in BIG trouble because they done barked up the wrong tree with this one!

I live in Australia, and I feel for you man. Those cops need a lesson. Get them into court and destroy them. They'll be flipping burgers in McDonald's if you do.

I live in Colorado. Wow plenty of issues with this stop. Supreme Court has made it clear. You cannot extend a stop beyond what it takes to write the ticket. Then they claim they have probable cause he possesses drugs but the officer can’t articulate other than some detective followed him. Didn’t say they witnessed anything. As a matter of fact the officer explained that the detective said he MAY or MAY NOT have drugs. That is not reasonable suspicion. Lawsuit!!!

How many times does a dog make a false indication before it is withdrawn from service? Never, it gives police probable cause to search in the hope of finding anything that can result in a charge that they wouldn't have legally had.

Amazing the difference a car makes. In the West Midlands of the UK a BMW is the drug dealer car, I couldn't have one until I moved up to Yorkshire. Owned many since that time. Good grief, don't that idiot cop run off at the mouth, copspeak at it's best. No drug cop followed your car followed you otherwise they would be there to get the credit for your arrest. He made a mistake by allowing a search. That takes the control away from being in the car and giving the police the opportunity to plant evidence to support their stop.

They pulled him over for a tail light but really detectives followed him from a part of the city where drugs might be sold and he has a BMW and he is black, so he was profiled and this is a completely illegal stop in my opinion

They can’t hold him there all day. The police is only allowed a reasonable amount of time for a traffic stop.

This man will win his suit against the Police, just listening to the Officers, making statements, you could tell that it’s story was BS!!.

Unfortunately the SCOTUS case Pennsylvania v. Mimms, does allow officers to remove anyone from a vehicle during a traffic stop. If they order you and any occupants from your vehicle, remove the keys from the ignition, lock the doors as you get out and put the keys in your pocket. They cannot open the vehicle without your consent absant reasonable articulable suspicion or your permission.

The only thing you might be able to beat is excessive force if they use excessive force to remove you and you'll have to be able to prove that IF you can get the body cam video or IF you had your own video they did not erase. You're still gonna be fighting charges you most likely will not beat. SCOTUS ruled they can remove you.

Actually it is not that clear cut. If the dog was already there or close when they did the stop, they can do it while working on his paperwork. What they can’t do is hold you for 30 min to wait for a dog when the ticket should take 15 to write. As for getting him out of the car we can thank Pennsylvania v. Mims where a cop can pull you out of the car for any reason during a legal traffic stop. The real problem is years of laws being passed the public would never be ok with if they knew the true purpose and way they are used. Things like frames around plates, air fresheners hanging from center mirror, etc. These are examples of laws made just really to give officers more stopping power hidden behind fake reasoning.

In this situation yes, the tag was bad so he did have to get out. And like I said they can't hold you to do a drug sniff if they stopped you for tags. Cops can't just stop people for a traffic infraction or some other reason and then be like oh by the way while I'm calling a dog while i write your ticket. There is no reasonable suspension of a drug crime or probable cause of a drug crime, therefore they can't keep you detain to investigate for a drug crime.

And lastly, last time I check 4th amendment says WARRENT SIGNED BY A JUDGE with oath or affirmation by a cops sworn statement. 1 is a k9 a judge? Obviously not. 2 does a k9 posses the ability to testify in court to what the k9 smelled or can the k9 write and affidavit that's punishment is jail if it's found lieing? Of course not so on it face all of that is unconstitutional.

@@favrefaw except for the fact that drug detectives asked for the car to be stopped. So the chances may be a little higher then you would like to represent that a dog was close. Don’t get me wrong I don’t agree with it, just pointing out none of your statements are 100% true or factual. “In Rodriguez v. United States, the U.S. Supreme Court held that, unless they have reasonable suspicion of a crime, the police can't extend a traffic stop in order to conduct a dog sniff. Otherwise, though, officers are generally entitled to use dogs to sniff cars during traffic stops.” This is the case law on what you are talking about. Without more facts it’s hard to say, but based on the length of his video they kept it to 20 min or so and most of that was him arguing. Don’t do that. The more you argue with the officer longer the officer has to get there with a dog. Also we don’t know what the detectives had or what RAS they had. There is always more to the story, again I think the cops are shady in the video, but it’s better to let them dig their own grave then fight them in the street if you have the money to go to court.

I hope this guy file a lawsuit against these cop for wrongly accusing

I hope you Sue all of them and maybe teach them a lesson but they won't learn

Time to hold canine accountable. Take the dog to court.

The canine did not alert for drugs. If they smell drugs they are to sit. The dog did not alert. The cop was lying.

The sad part is they know his right ! They are profiling him .

We can’t let them continue to do this to us.

Rich but very angry. Just goes to show, money don't make you a good/better person, most of the time it's the opposite. Rich but expired tags, some people just NEVER get it.

You have to get out if they request it, but you do not have to allow them to search your car without a warrant.

From what I've watched before ... you don't have to get out of your car unless a crime has been, is being or looks like it will be committed. I guess each territory has it's own rules/laws??? They can only search your vehicle if you give them permission or they have a court order of some sort.

Definitely take these clowns to court. That was a bogus search and the one cop said, drug detectives were following you? Naw! You definitely have a solid case. However in California you have to exit the vehicle if the cop requests it, otherwise it’s a charge. But the search has to be consented by the driver or they need a warrant. I subscribed! 1st. You do have to exit the vehicle. That is the law. Pennsylvania vs Mimms. Yes, not getting out of the car is a crime. 2. Do NOT consent to a search ever. Yes, the tag is good enough. No, you don’t know the law as well as you think. That being said, the big guy shouldn’t have said anything about drugs. No, you can’t delay a traffic stop to get the dog. Naw, the driver is responsible for some of this as well. He did have an expired tag. Never consent to a search.

This is a current tactic to harass people until they get so frustrated they succumb to the overreach or commit an actual action that then allows the LEO to perform a "search" of subject or vehicle.

I hope this guy has a lawsuit against this department and these officers.

I do not understand why unfit, fat officers are not made to lose weight. That first officer was obese.

If they pulled him over for expired tags, it is unlawful for them to extend a traffic stop longer than is reasonably necessary to complete the citation. If they extended the stop to bring out the drug dog, then a card board cut out of a lawyer could get anything that they found/planted thrown out in court. Never ever give police consent to search your car. It will never help you.

WOW, I don't think that cop knows what profiling is. 😂 He profied him to his face. 😂😂😂 Edit: They never said what the probable cause was, other than that completely made up story by the cop that obviously watched Power.

FOIA every one of them and their command... and records, complaints and infractions. Let us ALL look at these fascist cop's histories.

The fuel time and energy they use trying to find a person guilty of something would all be reduced if you just admit to a crime treat it as a civic duty.

Too many cases of cops claiming the dog hit for probable cause, then officers getting caught thinking they are slick planting things.
