COMMON MISTAKES IN SPOUSAL SPONSORSHIP APPLICATIONS

9. Miscellaneous DON’Ts
1. Using the wrong version of the application forms
All of IRCC’s application forms are available online at www.cic.gc.ca. However, these forms are updated frequently and without warning. Sometimes they are even updated several times within a year. If you submit your sponsorship application using an older version of the forms, IRCC could return the application to you without processing and ask that you complete the application again using the current forms.
This does not always happen, and sometimes it depends on how old the forms that you used are. For example, if the current forms are from July 2016, and you submitted forms from January 2016, the likelihood of your application being returned is less than if you submitted the forms from June 2013. You can tell what version of the forms you are using by checking the bottom left corner of the page for the form number such as IMM 5555 and a month and year such as (09-2016).
The reason IRCC updates the forms is because they ask for new or additional information than they had previously. The best way to avoid this problem is simply to ensure that you have the newest forms.
2. Answering questions incorrectly on the application forms
The most common mistake people make when applying to sponsor their spouse is not asking for help if they do not understand what a question means on the application. Frequently people mistake the meaning of a question and answer it with irrelevant or incorrect information.
One example is misunderstanding who can be listed as a dependant or a family member for the purposes of a sponsorship application. Just because someone is a relative who is financially dependent on you, does not mean that they can be counted as a dependant on your sponsorship application. If you are not sure of the meaning of a question, you can call IRCC’s call centre or you can talk to a professional such as an immigration consultant or lawyer.
3. Leaving questions blank on the application forms
It’s very important to answer all questions on the application forms. Leaving a question blank not only omits important information, but it also looks suspicious to IRCC. If the information on a question does not apply to you, always write “N/A” or “Not Applicable” in the answer space.
Leaving questions blank is a sure-fire way to have your application returned to you.
4. Misunderstanding who is the Sponsor and who is the Applicant
IRCC, like all government offices, uses many terms that are specific to their field. It is easy to get confused by all of the legal jargon which means one thing in everyday language but something totally different in terms of an application with IRCC.
For a spousal sponsorship application, the Sponsor and the Applicant have to fill out separate forms. The “Sponsor” is the person who is a Canadian citizen or permanent resident who is bringing their loved one to live in Canada; the “Applicant” is the person who is applying to come and live in Canada as a permanent resident.
Make sure that each person fills out the appropriate form to send to IRCC. If the forms are completed by the wrong person, the application will be returned to you.
5. Incomplete or inadequate supporting documents
Every sponsorship application contains documents in addition to the application forms as proof that your relationship is real and genuine.

    Hi Admin, hope you are doing well. I would like to know if you can make a video regarding canadian citizen outside of canada and sponoring wife outside canada..I have come across a sponsorship rule 130 (2) in immigration law which allows a canadian citizen living outside canada to sponsor his/her spouse outside canada but need to prove that they will return to Canada once the spouse receives PR. what are the main requirements and also what proof is required to prove that return is happening and what else if you can elaborate in details please.     You don't want to do that. If you sponsor your spouse from outside of Canada, you indeed have to prove that you will live in Canada. It's an additional burden you have to meet. If you move back to Canada, you do not have to meet this burden.

    Hi, My application has returned because of missing a document, now I've completed it, but some of pages of some my application forms has earmark of date and RECEIVED word, should I print and sign this forms again and post them back without any earmark on them?

    Any form with a signature box actually needs to be printed off, signed, scanned and uploaded.

    Please i have problem filing up the form imm1344 question number 8, your current marital status ..? I and my fiance are into conjugal but the drop down menu in question 8 has got no conjugal option as to the answer of current marital status.. So how do i fill it up by chosen the right answer from the drop-down menu

    no, it has no engaged in the options. rather it has '' legally separated, married, divorce, annulled marriage, unknown, single, common law, widow..'' please, what could be the right answer to the listed option to current marital status . my current marital status is conjugal partner, but it is not in the dropped down menu of options. i am confused dont know the right answer ,,,,

    Sorry, I misunderstood the question initially because I didn't realize the IMM 1344 was the sponsorship application (I don't have the form numbers memorized). You need to have a good reason to sponsor some you have a conjugal relationship with. Normally, you need to be married or common law before filing the sponsorship. So get married and then sponsor your partner. Sorry for any confusion.

    im not sure if anybody can help here, but ive submitted our sponsorship back in March, but one mistake i did was send her passport size photo without her personal info and studio info at the back, should i wait for them to ask for it or should i send the right photos with a follow up cover letter, please advise, thank you!

    No, you do not need to list your travels. That question is intended for principal applicant, your husband.

    thanks for the vid., my fiancee lives in CA. and i live in Germany., we wish to apply under conjugal family class, but she has no job yet to be able to sponsor me . does it affect the sponsorship application

    Conjugal sponsorship is not normally for the average couple. In order to be eligible for conjugal sponsorship you need to be unable to marry. You should get married, and then she can sponsor you as a spouse.

    Hello Immigrqtion group, cic asking missing specific country requirement form that my spouse from India and I can see he missed IMM5562 also do he has to signed this IMM5562? as I can not see any signature required on this form. I am hoping your kind response? Can he re send same forms file with added IMM5562? Thanks in an advance

    If there's no space for a signature, he doesn't need to sign it. Yes, he can re-send the other forms with the additional form added.

    The processing time in general is supposed to be around 12 months but it depends upon whether the sponsored spouse is currently and which visa office is responsible.

    There are lots of factors at play and I don't have enough information. It depends how and when she got her refugee status and when she is becoming a permanent resident. Then it depends upon when she submits the sponsorship application. From the time she submits a correct sponsorship application, it will be one year. But that's the end of the process.

    As long as he has legal status in Russia, you can sponsor him from Russia, rather than Uzbekistan.

    If you are not going to be sponsored, you have to immigrate the same way as everyone else, as an "economic" immigrant, meaning working in Canada and then becoming permanent, or immigrating as a skilled worker.

    She has to become a permanent resident, once she is a permanent resident she should be able to sponsor you.

    As long as you qualify for the work permit, and can prove you have ties to Pakistan, you should be able to get one.

    IMM5532 - Part B, Question 2 (Page 3) asks the Principal Applicant: Do you have any relatives (including aunts, uncles, cousins, etc.) living in Canada? Currently have an Aunt and Uncle who live in Canada. What happens if I have had zero contact with the Aunt for over 10 years and we are not on good terms? We can't get their information such as place of birth, current address, etc. Can we just leave the Aunt out or is it best to put their name and NA with an explanation why?
