Fraud, in regards to a will or a trust, is defined as deceiving, tricking, coercing, or lying to the grantor to cause them to establish a will or a trust that favors the person that was committing the bad acts.
Some common examples of fraud related to Wills and Trusts include:
 Fraud in the Inducement; and
 Fraud in the Execution
Fraud in the inducement occurs when someone convinces a testator or grantor --
through a deception -- that something fraudulent is true and that the will or trust, or
provisions thereof resulted from that deception.
Fraud in the execution occurs when a person misrepresents a document in an attempt
to get a testator or grantor to sign a will or a trust.
It’s a tough first step to take, but filing a Florida will contest or trust dispute if you believe that the will was procured by fraud is the responsible action to take.

    @@panamablack9671 You should not have to if you have an attorney If the person has passed you have a right to the documents depending what state you’re in usually upon demand, within 10 days learn the laws in your state and hire someone

    The legal system has become a good scam for people - there is no time limit in traditional law, a wrong is a wrong / theft / trespass and not corrected until remedy is brought. I am sorry to get to this point but i now say, may the wrong follow all perpetrators through all jurisdictions of spirit until they bring remedy to their wrongs and trespasses.

    @@BloodworthLawPLLC Thank you kindly for your message, but it is a lawyer who was involved in instigating the fraud and theft of our inherritance - so i have no trust in lawyers or this legal system that has been created to masquerade as law. Law is based in honour and righting wrongs. This does not seem to happen in the legal system. No offence to you here, you may be a rare decent one, but it is time for the fraud and abuse by those in the legal system to stop. Best wishes to you, and i mean that.

    I’m battling my custodian of my UTMA account for access since I’m passed the age of majority and I was told by the clerk that the probate court is limited in its capacity. They refused to do my motion for summary judgment. I’m trying to get my case transferred to Civil court but the clerk isn’t returning my calls. They said they’d call back on Thursday and never did. I called and left a message. I also just placed a motion to transfer. I’m appalled how slow the probate courts are. I’ve been going in this a year so far. I heard it takes years. It shouldn’t be like this to get justice from an abusive custodian!

    If an attorney and the executrix knowingly filed fraudulent documents of material misrepresentation in court, lied and mislead the heirs, court and judge on the sale of a real estate asset of the estate, didn’t follow the judge’s order confirming the sale, then took a higher court ruling and altered and manipulated it to again, mislead the judge, court and heirs this time to take money from another case!

    Wondering how this applies if I just found out that money was embezzled in a divorce settlement when I was a minor then a trust set up and hidden from me even to this day?

    @@gwyneth7812 I filed a claim/ motion to compel and my trustee hit me with a protective injunction. Corruption abounds. I got attacked after. I kept applying pressure even after the courts buried the suit and revived it. What a nightmare. Good luck

    @@tashatorrid They are vile, dark and corrupt and i am sad that i have got to the point, but i really hope they go to hell. How did you get attacked? In my case my half brother, i believe and have evidence to show, made a fraudulent will, colluded with a solicitor and accountant in it, concealed valid wills in England and Spain, concealed bank accounts and investments, ordered false adjudications, committed share fraud, violated and perjured a court order. I beleive that the court and police colluded with them to let them off. My half brother said to me once 'everyone's got a price'. It certainly seems that way. There are so few people with honour. I am sorry to get to the point bur say again after 15 years of seeking honour and justice; may they go to hell

    My brother and I never get along ,hes older , and owners a company , so when mom passed away he ran up there grabbing everything..with his contractor crew , trucks trailers, my mom told me before she passed ,she just redid the will in my favor , I get car and a whole lot of other stuff ,,, I never got nothing ... I dont know how to find the lawyer , Wichita falls tx. ,moms name laresa Turnbow... please help me get justice please...🙏

    Can, if a person doesnt want to contest but can prove beyond a preponderance that the other person commited fraud or engaged in undue influence, can they still file charges and request an investigation? Also, can they be sued civilly for fraud while not technically filing to contest?

    @@BloodworthLawPLLCyes my next ( $500 per hour) consult is next week. I love him but he's so busy and as new information unfolds about my case I am gathering my talking points to be as educated as possible to decide what to do. I've also decided to hone in on probate law and I want to bring two motions into the courts. I want to have the “ probable cause” clause mandatory in every state to protect beneficiaries from unsavory trustees and be sure their no contest wills are ignored when there's probably cause. It's in American. I also want to bring a pkea in the Federal courts to demand that in every State there is a mandatory video and or audio recordings of every change amendment or codicils..anything like that and it to be mandatory the person audibly and coherently give a brief explanation of what they are signing. I just found out that my sisters lawyer allowed a witness to a will change who is also a beneficiary so cant wait to see how this unfolds. Sorry for rambling lol. I'm just so sick of unethical people and the lawyers who collaborate with them,

    My father died in 1992 and his father passed in 1993. I was the sole heir and I was only 13. I accidentally located a warranty deed with vendors lean than says I was the grantor of the home as a minor with no guardian (false). The executrix sold the property to her children for $10, who happen to be the current owners. We (my mother and myself) were never informed of this. Its been a long time and I only discovered this yesterday while searching the database for a DBA. Is there a remedy in Tx available? I read that if I bring a claim within one year of learning about it no matter what the time frame is. Any guidance would be appreciated. The deed transfer was in 1993.

    What about learning that you and your siblings would receive so much a month and you need a lump some now? If we all live another 20 yrs. we would only receive less than half. The remainder goes to a local college upon our death.
