    It's the suspects responsibility to wriggle out of their handcuffs, kick open the window, and escape from the stuck car and do a ninja roll to the side of the train tracks so they can avoid the train and the car before it gets hit and turns into a crumpled soda can

    What always gets me mad is how the case is treated in situations where the person “is lucky to be alive”! If they’re lucky to be alive, shouldn’t the person who tried to unalive them have a more serious charge. Luck should not have anything to do with it. If statistics say she should have died, charge them with murder!

    There is absolutely no doubt the officers knew they were on the train tracks. There is literally a railroad crossing sign right in front of both vehicles!! Not to mention they arrested the person 5 feet past them before putting her into the police car! Stop making excuses for your incompetence!

    That cop was more worried about her makeup and hair. Reminds me of that female cop that got caught sleeping with half the police department recently. Of course, she racially profiles the victim.     Well I saw the video that isn't shown here and let's not forget to add the cops we're laughing and acting just fine after the car was hit, continuing to search her truck. Smh.     @@ht3261 A cop was standing near the car and ignored the train horns but jumped away just before the car was crushed. That cop and the one who locked her in the car are being sued by the victim. They all should have been banned from being cops anywhere ever. I am not convinced this was a for real accident. The prosecutor got extremely light sentences for them.

    Right, handcuffed suspect in the car, second officer runs away from the oncoming train wielding a rifle for what reason???? There was no resisting arrest currently happening, the situation was under control, I'm not sure who he was planning on killing that night. He certainly didn't have a tazer drawn to disable anyone cuffed that tried to run; he was out for human.

    I am so disgusted. My father in law was an L. A. cop. His son an i divorced, but i never met a kinder more level headed human in my life- in the 50+years I knew Ken, i never heard him swear or cuss. He would have jumped in that car and covered her with his own body .. that police caring a RIFLE! against a 21 yr.old petite female + multiple cops .. maybe they should relook and who's doing the hiring..

    this helplessness is on another level. Its on thing to be on train tracks with a train coming, and your doors wont open. Its a whole nother thing being handcuffed, train on its way, and there are not just people, but police officers(multiple) standing just outside the car.... help is literally feet away.. and nothing.

    It's against the law for anyone to stop on railroad tracks let alone park on them! The police write tickets all the time for that! They act so privileged stopping in the middle of streets, blocking the road while they casually chat with each other. Parking on the tracks,leaving the vehicle and with a cuffed suspect in it shows their clear disdain for the woman. 😡

    @@calvingaston7934 Let's assume she was right and they really couldn't see. I saw the entire video when this happened. The problem I have is that there was a good 30 second period from the time they FINALLY woke up and realized they were on the train tracks until the moment of impact. All one of them had to do was jump in the car and drive it 10 feet forward. THAT'S IT! Just 10 feet and all of this would have been averted. Now I can hear some people say, "But they couldn't tell how far away the train was. It was dark and noisy and scary." And to that, I say, 1. they created the problem in the first place, it's their job to fix it. 2. it's their duty to not put people they arrest at risk and most importantly, 3. it's their job to not be cowards. It's the whole reason why cops make the money they make and get life-long pensions with nothing more than a high school degree and less training than it takes to get through beauty school! At the moment where they were supposed to show their character, they all thought, "Welp, I hope she lives, but I'm not risking my life!"

    the female officer on trial said there was no reflective signs or indications of a railway but there was literally a stop sign and a post saying rail crossing (at 1:44) even multiple signs indicating there was train tracks but regardless, they had their flashlights on and the blue and red lights flashing how could they not see it!? ALL need to be held responsible.

    There is a person who took part in the accident but is overlooked in this trial: The locomotive-driver. Such an accident can kill the locomotive-driver or lead to a trauma. Such an accident can also cause the locomotive to get off the rails and crash with 1.000 tons load into the environment. Therefore any modern nation has a special law about „endangering rail road traffic“, a felony for everyone who places an obstacle on a rail roads. I‘m wondering wether these Cops are charged with that. And they should loose their driver license too.

    Well, fire fighters with the Detroit Fire Department a few years ago parked a firetruck 🚒 on a double set of railroad tracks while responding to a car accident. An Amtrak came along and destroyed the truck. The truck was less than a month old!

    I was just about to type the same thing. I can understand the officer not seeing the actual tracks themselves, but not the stop sign and especially not the railroad crossing sign (which is highly reflective). There's no way she didn't understand there was a train track there. And if she truly is that unobservant, then she definitely should not be a cop.

    As a former law enforcement official the last place you want to park a patrol vehicle is on train tracks. And for a misdemeanor offense the woman should have been given a notice to appear in court to answer the charges levied against her. Now granted every state in jurisdiction has different laws so that's taken into account. But duty and care to a prisoner was not taken into account. As a result or party should be fired from the department. Civil and medical damages need to be paid.

    The call they pulled her over for was, road rage involving a firearm, so kind of not at fault for that in the moment. That said as soon as the 'suspect' was handcuffed they should have moved the police vehicle off the tracks.

That lady officer told the court “ I thought this stop was going to end up in a gun fight “ these police hope every stop turns into a gun fight. Picture this, if a police office was hit by a train and a civilian causes it, that person would be charged with these charges.     Every time a cop screws up, it's the same story. "I didn't know what they would do. I thought it would be a gun fight. I was scared for my life, and miles outside my jurisdiction (i don't know how that's supposed to help her, if anything it supports why she shouldn't have been there). Something something something split second decisions, something something something and the totality of the circumstances, the only logigal choice was to put the prisoner in the car parked on the train tracks." And they'll probably get excused and apologized to for taking up their time with this.

    The traffic stop itself was illegal. They were searching her truck to “find evidence” to cover they first crime. This is why there were in such a hurry and forgot about the train tracks.

It was a justified stop, possible 4th amendment violation for cuffing her and putting her under arrest given the nature of the crime she had committed (akin to being arrested for illegally parking), and then they searched her car to justify it, which was definitely a 4th amendment violation when one cop said to the other that they weren't sure if she ditched a weapon out of the car. So someone here has no fucking clue what they are talking about and it's you 🤡

    Not necessarily, theres certainly times where officers need to go out of jurisdiction. In real life going out of jurisdiction isnt some get out of jail free like in movies. Usually just requires an officer in that jurisdiction to be present.

    I remember this story WELL and saw the full video numerous times. Here's the problem I have. Even if we are to believe EVERYTHING the cops said, there was about a 30 second period from the time they FINALLY woke the f*!k up til the moment of impact. All they had to do was get in the car and drive it 10 feet off of the tracks. 10 FEET! People always say being a cop is difficult and dangerous. THOSE ARE THE MOMENT WHERE THEY'RE SUPPOSED TO PUT THEIR LIFE ON THE LINE!!! Instead, every single one of them thought, "Welp! Hope she lives, but I'm not risking my life for her!" Obviously, they should back up the Brinks truck and pay this woman whatever she wants for pain and suffering. For the rest of her life, just hearing a train horn is going to make her freak out. This is why there needs to be higher standards to be a cop. All of them together didn't have enough common sense to say, "Wait. Is that a train horn? OH CRAP! The car is on the tracks!", and one of them jump in and actually move the thing. They're cowards and completely incompetent and I wouldn't trust them to walk my dog!

    they could have just pulled her out but they shouldn't have even parked there to begin with. I had a cop in my home town fall asleep parked on some tracks by the road, woke up to a train about to hit him, and got out of the car just in time. I think he was embarrassed because he tried to push the PD to sue the train company for not stopping for a police car but that's NOT HOW TRAINS WORK. Thankfully they knew better than to waste their money on that but I thought about that incident everytime I drove past those tracks. Cops really think the universe cares that they're cops and should bend the rules for them

    The police officer that parked on the tracks should not have a driver license let alone be on the force. The only excuse would be vehicle broke down or is stuck flat out not smart enough to have this kind of job.

    The amount of fear she experienced seeing that train coming and knowing she could do nothing is torture within itself. They should be forced to hear a recording of her account of how she felt in that car with no one helping her, but rather running away from the car like cowards.

    Probably defecated. I bet anyone would have. Dumb of her to not pull further past the tracks when she got pulled over, too. I am not sure what I would have done as the officer. Probably would have pulled off road on the same side of the tracks as the perp to maintain enough distance in a gun fight. I bet that situation will be taught in future LEO classes.

    ​@@jmfs3497First of all, gross. No one was asking for weirdly specific details when it comes to bodily fluids. Secondly, don't make excuses for the officers. The woman's injuries are on the officers, not her. It's hard to believe officers could be stupid enough to park on railroad tracks and then proceed to place someone in handcuffs into that very vehicle. These officers are obviously too stupid to work in law enforcement.

    @@jmfs3497 officer’s typically would have used the intercom saying “pull foward further from the tracks” they’ve used the intercom when I was younger to get us out of the car after a police chase and then when I was a teen they also used it to get my friends and I out of the car on another chase

    That's the operative word here "coached." I sincerely hope that's actually the case here. That this officer does actually feel guilty for what her carelessness caused and is only going along with this story due to her own trauma from the incident. Because If she's saying this on her own, it implies either absolute stupidity and lack of awareness, or a complete lack of morality.

    @@ivaneames4354 She worked in law enforcement from what I remember and was accused by someone of having a firearm which is what they stopped her for and were searching for but could not find. It was airport security and anti terrorism from what I remember her job. So there was zero excuse.

She was also employed in law enforcement providing airport security and anti terrorism. So that bit would not wash.

There's a crossing about 3 miles away, and if it's quiet I can hear the whistle. There's zero probability that not a single one of them heard anything until the whistle sounded. Zero.
