    @dianayount2122 I've seen all the hearings on this. The law in Idaho is the right to have private counsel on any case. To qualify for DP CERTIFICATION, an attorney must have already been on a DP case to get certified. Prior, I'm sure applied.Chad was asked if he still wanted to keep Prior as private counsel, and he said yes.And Chad wasn't indigent at the time, another law in Idaho. Chad did not qualify for a State DP appointed attorney. This is why Prior owns Chad's house and 4acres.

    Only court appointed defence attorneys have to be death penalty certified. Private council is retained by the defendant at his own cost and he has the right to choose whom he pleases. The only possible issue is the fact that Prior requested assistance from the state but no one who was DP certified could be found. Too few such attorneys in Idaho and those there are have a huge case load.

    There is a video explaining why, it was a strategy used by Chad. They showed an earlier trial video where Pryor didn't want to disclose what he would do in this situation. Now by staying quiet, he didn't admit any guilt- for appeals and since being on Dp he has more money and resources paid to by the state. In my opinion he's not going anywhere but yes today was a strategy,planned early on. Great YT video explaining it, I just don't remember the channel sorry

    Yeh, strategy for the first appeal. That chad did not have the right to stick with prior and also have access to publicly funded mitigation experts. Articles 6 and 14 contradict each other, and apparently there's grounds for an appeal there.

    You might want to go watch the video from PD Questions. Prior has a strategy up his sleeve, and it just may help. I don’t think Chad will ever be free, but a new rial, eventually, is quite possible.

    “Phlebotomists” not “phlebotonists.” JJ was 7. Judge Boyce asked Daybell if he wanted to continue with Prior, his private, non-death penalty qualified attorney. Judge Boyce was very clear and had Daybell respond on the record acknowledging his choice of attorney. What was the point of this interview?

    In Idaho, a defendant facing the death penalty is allowed to hire private attorneys of their choosing, even if those lawyers don’t have any experience in capital cases. But a court-appointed attorney must be death penalty certified. The court, judge, did NOT appoint Prior, it merely refused his motion to withdraw. it is not the same thing since the courts, the judge, did not ever actually choose or select Prior from any list of lawyers or from any means. Prior was involved by his and Daybell's personal choice, not the courts and not the judges choice. Idaho Law does NOT require or inforce that a defendants lawyer must be death penalty certified so the overturning effort, should one arise, will be complicated at best.

Defense contested it because they didn't have nearly enough time to review prior to the trial, so they made a deal to take death penalty off the table in exchange for the trial going forward without delay

    I don’t think it will be either but it’s just my personal thoughts.The crimes were too brutal and cruel with two children involved as victims. He is also a risk of gaining a following with his religious insanity.This is the main reason I’m glad he did get the DP. He needs to be contained and kept separate from others - even prison inmates.

    I’ve made this type of comment before about this same expert. She’s made comments on another case I was following which were completely inaccurate. She’s a guest on so many shows and I don’t understand her reasoning or her interpretations of these cases; it’s puzzling. Many people make negative comments about her inaccurate recollection of the cases she discusses.

    @@PoliticalJunky101 yes, she is a popular talking head. She gets her facts wrong more often than not. She is not a lawyer in Idaho but she is talking about appellate issues in Idaho. A state with very unique laws including the fact that insanity defense is not allowed in Idaho. There are many Idaho lawyers they could have interviewed to get more info on possible appeals.

    Inaccurate, speculative, misstates/misrepresents the facts, etc. (Aggravating factors don't need to be guessed, it is spelled out for the jurors along with the charges.) Get the real info from East Idaho News, Court TV, someone who watched the trial, someone who watched daily recaps of the trial, etc.

    The DP was omitted on Lori because the State did not file a document on time. I think there was some other papers that were wrong. Because of this and after Chad's trial, I think the clerks office needs to find someone or replace someone that are making these mistakes. It's a good thing Judge Boyce found the wrong death date on Tylee as being JJ's. This could have caused a mistrial or something worse. Prior caught it, but was going to sit on it until it was time to let the bomb go off. When Lindsey was giving her very last recross, the date was wrong on what she was reading. Somebody is making too many mistakes!

    The jury did not hand down a sentence, y’all need to pay attention. The jury noted that aggravating circumstances applied and were not mitigated sufficiently to make the death penalty unjust. The judge then applied the penalty. Not the jury. Jury decides if factors are met or not. Judge tells jury what the factors are then subsequently, if applicable, hands down the penalty.

    Ordinarily I respect Jennifer Coffindafer's opinions, but not on this.Chad Daybell waived his right to a death penalty qualified attorney! And he also waived his right to more counsel. And John Prior did not try to get off this case, early on as she said. About 2 months before Chad was to go to trial J. Prior wanted to get off the case and the judge wouldn't allow him to do so, because it was understandably too close to trial. As it is, Chad was just sentenced to death today and it's been almost 5 years since these murders were committed, it was beyond time to get this case to trial!!

    I'm curious as to why chad was allowed to wear street clothes for two days post verdict - don't prisoners normally wear prison garb after conviction? Additionally, he was wearing both a ties and a belt...that seemed odd.

    Why should Chad Daybell's death sentence(s) be overturned? He had no trouble getting rid of his wife Tammy, as well as making sure Lori's children were murdered and buried in his own yard. As for John Prior's eligibility, or lack thereof, he knew from the very start (since mid 2020) that this would be a death penalty case. The state had made that perfectly clear. Therefore, if Prior knew the nature and complexity of the case, he should have 1) Stepped away and found a qualified attorney to replace him; or 2) Found an attorney to assist him. All this ought to have happened when Prior initially took the case. As it happens, John Prior claimed in court, at least once, that he was perfectly capable of handling the case.

    Prior represented Chad from the day of his arrest in June 2020. He tried to withdraw in Jan 2024. Less than 3 months before the trial date which would seriously have delayed this trial. And the reason lethal injections are failing - it is because states are not able to get the correct drugs as there are export restrictions on them to stop them being used in executions.

    #FACTS: JJ Vallow was 7yrs old...not 6. Please maintain accurate reporting. In addition, the deceased children were gone prior to Chad & Lori even getting married...evidence suggested none of their family members even knew about these 2 angels until they were found. It wont be overturned...you need to know the whole case before making such a claim 😂

    It was Chad’s choice to have Prior as his attorney, so how could he use that upon appeal as not death penalty qualified?

    There are some many news reports where Tammy is referred to as Chad's ex-wife. No, she was not his ex-wife. She was his wife when she was murdered. And, no, Tylee and JJ weren't his step-children. They killed those children before they killed Tammy and were married. The state announced they would be seeking the death penalty in August 2021. John Prior had plenty of time to find a co-counsel to work with him on the case. At least I think 2 1/2 years is plenty of time. When John Prior tried to withdraw from the case earlier this year, Judge Boyce questioned Chad and asked him if he wanted Prior to be his lawyer. Chad said he wanted Prior to represent him. All he needed to do was say he didn't want Prior and we'd still be waiting for Chad's trial. Also, Chad didn't want any mitigating factors to be presented. Judge Boyce questioned him closely about this decision. He had 2 chances to make and allocution and he didn't do that either.

    Prior waited until the eve of trial to say Chad was out of money. The state offered to pay someone to 2nd chair. Chad got a very vigorous defense and a different lawyer would not have made a difference in the outcome.

    🙄 Actually, ALL of the possible grounds to overturn the DP were addressed by Judge Boyce already. 🤷🏽‍♀️ Of COURSE Pryor will appeal, make a circus of it and argue, that is partly his job and Pryor is not the one to care much about the details of legality. He will make as much noise as possible - but if we all know that he'll try to torpedo the verdict, don't you think that Judge Boyce knows it and is well prepared for it too?

    The appeal process takes twenty years in itself. Therefore, justice has only been proposed, not served. When Chad is put to death, that is when justice will be served.

    No it won’t. He paid Prior and Chad opted out of any other attorney and Prior waited too late to say anything about not being a death penalty attorney. Judge Boyce is nobody’s fool

    Oh man, this woman knows nothing. JJ was murdered at seven years of age. Furthermore, Dumbell was asked by Judge Boyce whether he wants Mr Prior to stay on the case and he answered with yes. He had his chance to tell his side during trial, he could have presented mitigating factors, could have people speaking on his behalf. He chose not to. This sentence will not be overturned. Please, if you bring experts on, have them prepare themselves or bring actual experts on. Thank you.

    Until an actual appeal is filed, the grounds will not be known. There was a widely publicized screwup by the prosecution during the trial, and whether or not that can be used to overturn the sentence on a technicality, remains to be seen. At least the fact that he is now a convicted child killer, will keep this bloated toad in his cell for 23 hours a day, "for his protection," of course.
