Can you be put on Child Support if you are not on the Birth Certificate?

In short - yes. You can be put on child support if you are not on the child's birth certificate. It actually doesn't matter whether or not your name is on the birth certificate of your child in the state of Florida. What matters is if you've been established as a legal parent of the child.
For mothers, they are the legal parent as soon as the child is born in Florida. For fathers, it's not that simple. Fathers can establish paternity by either being legally married to the mother (before the child is born) or by petitioning for paternity in court. Only after you've been established as the legal parent will child support be assessed.
So, fathers can't even be asked for child support until they are established as the legal parent - however, that also means that fathers have no rights to see their children if they are not established as the legal parent. It's in the father's best interest to establish paternity and pay child support if the mother will not allow him to see his children.

I understand that Dads feel that way because when a Mom gives birth, she is the only legal parent. When Mom delivers the baby, she is asked by the hospital who she believes the father is. If she gives a name, the hospital will not allow his name to be put on the birth certificate unless he is present and willing to sign the birth certificate. If the man is not present and/or unwilling to sign the birth certificate, he will not be put on the birth certificate. If Mom gives a father's name during a court proceeding, the alleged father can deny paternity and ask for a DNA test.

Basically young men do not have kids. It’s sad to admit but having kids give women all the power and control. If they want to have kids adopt so that way it automatically a 50/50 spilt with no child support. It is sad to go ti this extent but having kids with women naturally will cost the man a fortune while making the women money in the process

Can someone decide after 15 years they don’t want the rights after they have established rights? Someone I know got a call from a ex saying she thinks her 15 year old is his because the other “dad” doesn’t want to pay child supposed and wants a DNA test now after 16 years. They weren’t married when the kid was born but he signed the birth certificate AND notarized something establishing parental rights.

The easiest way to establish paternity is through a DNA test, whether you go to court or not. If the father is unwilling to take a DNA test, then taking the matter to court is the only option.

If you are married and your wife becomes pregnant with someone else's baby, the law presumes you are the father. You are still "on the hook." If you plan to divorce, the baby will need to be addressed. If you plan to stay married, you are agreeing that this new baby is yours and you will be responsible for the child - including financially responsible. There are things to consider and you should consult an attorney for more specific information regarding your case.

@@FloridaFamilyAttorney that's crazy because if it were reverse the same rule does not apply. for example, if the mother gets pregnant by someone else, then marries another person, the original person that got the woman pregnant is responsible.. so shouldn't the rule apply when the mother is married after she has the baby, where the new husband now takes responsibility for the baby?

Well, it depends. If you were never married to mom, did a court determine you were the father and establish paternity and enter a child support order? Is there an outstanding court order or is mom trying to go after you now with a new order? If you discovered you are the father of a 30 year old, how did you discover that information? You may want to talk to an attorney to make sure all of the facts are considered. You are welcome to call my office at (863) 295-9300 for further advice.

If you didn't have sex with woman, no, you are not the legal father, the mother is and should provide the wants of child herself. Look at this story another way, what if the judge presiding over such a case used the restroom and a woman ran in after and took his sperm, and got pregnant, should that judge be forced to pay child support or sign the birth certificate? Seriously what would any judge in their right mind do in such a situation?

2:13 Then why don't you as an attorney do something to help put a law in place to protect fathers? Sure, you know everything about it, sure you can explain in great detail how fathers are getting a shaft, amd I've watched a 1000 videos similar, but why aren't people helping fathers instead of just taking their money?
