Supreme Court had agreed to examine whether allowing access to CDRs, Hotel reservation details , IDs furnished would be violative of right to privacy , what happened further in SC?

In husbands and wifes there is no any privacy so this act should never use in domestic matter

SC should give permission to either of the parties to extract such private details as only these will become the evidences to prove the commission of such type of cheating in marriage. If SC doesn't allow then such cases will arise and none of the side of the party will be ashamed of doing such cheating towards their partners and there will be breakdown of marriages.

If not jail term, then some financial fines should be there. It's not a good way to proceed as a society. This decision is going to cause I'll effects on the minds of children. They may develop passive hatred against one of the parent who cheats the other parent. They may live their whole life in that hatred against that parent. It's not a good thing. Cheating should be discarded

Madam ji my wife involved in adultary with husband of her real younger sister at their house. My wife destroyed her phone and keeping new phone secretly. So third person evidence is not possible. What's to do in this case.

Everyone here (most of them) are discussing how Supreme Court is wrong for decriminalization of adultry.. but in country like India it is emotionally and socially draining process when it comes to divorce.. In India or anytwhere, adultry is not moral but practically it is present bcz of lack of acceptance for a divorce.. If a marriage is not healthy anymore it is better to go for divorce instead of cheating but when it comes to divorce the extreme sociatal and family pressure ruins freedom.. Not only person himself/herself is forced to cheat but the other partner also suffers emotionally.. I think society needs to be more open in such cases.. and yes, decriminalization of anything does not make it legal.. some people needs to understand this too.. what is wrong is wrong, but why that wrong is happening that too is a important thing.

A examination between ambedkrite written constitutional govt systematic judiciary/ snattan judiciary must mandatory immediately so that the citizens of country to get awore about that which is fraud or which is best which is convicted and which is puzzling torchering etc

For bringing truth on the record, there should not b any right to privacy. The ultimate aim should b to bring truth on the record. On technical grounds this element should not b discarded.Justice should b real and should not b denied on technical grounds.

Removing 497 IPC by SC was a blunder mistake.

Presenter must choose words wisely. Criminal case if has to be done, can be done but the person must have vast knowledge if not about law, then intelligence to prove its point. The case can be done under mental cruelty and cheating. But yes it would hard to prove and most will fail in doing so. Its better to be on a safer side and avoid getting flown away in emotions. Constitutional rights should not me mingled with matrimonial laws, both are to be kept seperate you cannot hide from your responsibility where you have obligation, duties and responsibilities as a partner that is also you have seprate personal laws of marriage and no where in personal laws adultery is allowed, marriage is sacramental where two bodies join or come in contract with each other to perform certain duties in marriage how can it be allowed for a third person to enter and pollute the relationship between the two, and you allow adultery to be fine.
