Book Launch: Constitutionalizing Criminal Law, by Colton Fehr

The Centre for Constitutional Studies is excited to present the launch event for Constitutionalizing Criminal Law by Professor Colton Fehr. Professor Fehr’s book calls for an overhaul of the way the Supreme Court has conceptualized and developed the relationship between criminal and constitutional law. It argues that the Court should abandon the use of principles of instrumental rationality - a defining feature of its section 7 jurisprudence - and rely instead on enumerated Charter rights (or in some instances, principles of criminal law theory) when striking down unjust criminal laws.
