    You know what's funnier? The court reporter can't add in "laugh" or whatever in the transcript, so it's going to read as deadpan 🤣

    I know that in Supreme Court transcripts, the reporter sometimes writes "Laughter" or "General laughter" in parentheses. Take a look at page 20 of this one: www.supremecourt.gov/pdfs/transcripts/1987/86-1278_12-02-1987.pdf

    For all commenting on the professionalism of this and taking offense, it is a practice deposition conducted by the attorney or team that will be representing the doctor in a civil suite. It is not a formal deposition merely a practice session.

    @@bpmarshall Yes, it seems so, as opposing counsel is present, and stating objections. They wouldn't be there for a practice. Surprised there isn't a Date/Time stamp. Wonder how many women found this to be funny. I wasn't impressed.

    Let me translate this comedy show for everyone. The Doctor fucked something up so royally, that both sides know he is going to lose. It's a civil claim so it isn't like the Doctor is in fear of losing his license. All both sides have to do now is settle with his malpractice insurance, which is probably represented by one of the lawyers sitting in the room. Then the lawyers take their cut and convince the patient that it's a good deal.

    To all the sillys, the reason they are not really giving a shit is because its a deposition. The guy asking the off color question was the interrogator, he decides what parts of the written transcript are submitted for trial (assuming this didn't go to settlement which it seemed it was going too). Its not uncommon practice to soften a deponent up a bit by throwing some weird stuff at them. The other lawyer also did his job by objecting to form which is all he can do and all a good professional would do.

    Deposition will be the worst thing you ever experienced. No rules....did you stay in a hotel last night? Did you go to the bar? They have your bar bill. You will be asked how many drinks you had, and if you are alcoholic and God knows what else. Deposition is the lawyer's chance to destroy you, your credibility and your life if they can. Brutal!

    Unprofessional? Perhaps. But it never hurts to try to break the ice with a good joke. Depositions are stressful environments. Even the deposing attorney wants the deponent to feel comfortable (Even better when the deponent believes the deposing attorney is on their side). If that means a little more money for merely seconds worth of seemingly unnecessary talk, then so be it. It may have enabled your attorney to gather far more information than being either bullying or straight to the point.

    This is a civil malpractice case. We work on contingency fee, meaning we take about 1/3 of whatever we get from the settlement or jury verdict. Nothing if we lose. But good for you counting other people’s money!

    I film a lot of depos in East Texas where I live and it's not too uncommon to see some lawyers wear jeans and a polo. East Texas is known for its small communities so in some cases it's pretty casual.
